AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, RELATING TO THE SEA
TURTLES PROTECTION, TURTLE NESTING PROTECTION
REGULATIONS; PROVIDING FOR PURPOSE AND INTENT;
PROVIDING FOR DEFINITIONS; PROVIDING FOR PROHIBITED
ACTIVITIES; PROVIDING FOR LIGHTING STANDARDS ON
EXISTING AND NEW DEVELOPMENTS IN THE PUBLIC BEACH
AREA IN THE MUR DISTRICT; PROVIDING FOR PENALTIES
FOR VIOLATION; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEALER; PROVIDING FOR CODIFICATION; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with Florida Statues Chapter 370 and the U.S. Endangered
Species Act of 1973, the City of Sunny Isles Beach ("City") is authorized to adopt regulations
designed to prevent the killing, molesting, harassment or cause direct or indirect injury to any species
of marine turtle in the City of Sunny Isles Beach or within its jurisdictional water; and
WHEREAS, the City deems it to be in the best interest of its marine species and for the
safeguarding of these animals, and to provide citizens, and visitors with guidelines
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Purpose and Intent. The purpose of this ordinance is to reduce the impacts of artificial
coastal lighting on threatened and endangered sea turtles that nest on the beach of the City of Sunny
Isles Beach by restricting artificial lighting and other activities that disorient turtle hatchlings,
causing them to crawl toward land rather than toward the ocean. This ordinance is intended to
provide overall improvements in nesting habitat degraded by light pollution, and increase successful
nesting activity and production of hatchlings. The restrictions and constraints ofthis ordinance shall
be effective within the incorporated areas of the City of Sunny Isles Beach and apply to any coastal
lighting or other activity that has the potential to adversely impact sea turtles within city limits.
Section 2.
Definitions. The following definitions shall apply under this Ordinance.
Artificial Light means any point source of light emanating from a device
made by humans, including but not limited to incandescent mercury vapor,
metal halide, sodium lamps, fluorescent, flashlights, spotlights, streetlights,
vehicular lights, construction lights, security lights, bonfires, or any light
emanating from any reflective surface of the device.
Beach means that area of sand that extends landward from the mean low-
water line of the Atlantic Ocean, to the place where there is a marked change
in material or physiographic form, or to the lie of permanent vegetation.
Bug type bulb means any yellow or other colored light bulb that is marketed
as being specifically treated in such a way so as to reduce the attraction of
bugs to the light.
Coastal Construction Control Line (CCCL) means the line established by
the State of Florida pursuant to F.S. S 161.053, and filed in the public records
of the county, which defines that portion of the beach dune system subjected
to severe fluctuations based on a 1 DO-year storm surge, storm waves or other
predictable weather conditions.
County means Miami-Dade County.
Cumulatively illuminated means ilIuminated by numerous artificial light
sources that as a group ilIuminate any portion of the beach.
Directly illuminated means ilIuminated as a result of glowing elements,
lamps, globes, or reflectors of an artificial light source, which is visible to an
observer on the beach.
Dune means a mound or ridge of loose sediments, usually sand-sized, lying
landward of the beach and deposited by any natural or artificial mechanism.
Floodlight means a reflector-type light fixture that may be attached directly to
a building, other structure, or freestanding, and is unshielded.
Frontal dune means the first natural or artificial mound or bluff of sand that
is located landward of the beach and that has sufficient vegetation, height,
continuity and configuration to offer protective value.
Ground-level barrier means any vegetation, natural feature or artificial
structure rising from the ground that prevents beachfront lighting from
shining directly onto the beach-dune system.
Hatchling means any species of marine turtle, within or outside of a nest,
which has recently hatched from an egg.
Indirectly illuminated means ilIuminated as a result of glowing elements,
lamps, globes, or reflectors of an artificial light source that is not visible to an
observer on the beach.
Interior lights mean any light source located inside of a building or unit to
include balconies of any unit.

Section 3.
Low-profile luminaries means a light fixture set on a base that raises the
source oflight to higher that 48 inches off the ground, and designed in such a
way that light is directed downward from a hooded light source.
Marine turtle means any marine-dwelling reptile of the families Cheloniidae
or Dermochelyidae found in Florida waters or using the beach as a nesting
habitat, including the species: Caretta caretta (loggerhead), Chelonia mydas
(green), Dermochelys coriacea (leatherback), Eretmochelys imbricate
(hawksbill), and Lepidochelys kempi (Kemp's ridley). For purposes of this
section, marine turtle is synonymous with sea turtle.
Nest means an area where marine turtle eggs have been naturally deposited or
subsequently relocated.
Nesting season means the period from April 1 thru October 31 of each year.
New Development means new construction and remodeling of existing
structures when such remodeling includes alteration of exterior lighting.
Nighttime means the time period between sunset and sunrise within the city
limits of Sunny Isles Beach.
Person means individuals, firms, associations, joint ventures, partnerships,
estates, trusts, syndicates, fiduciaries, corporation, and all other groups or
combinations.
Pole lighting means a light fixture set on a base or pole that raises the source
of the light higher than 48 inches off the ground.
Prohibited activities disruptive to marine turtles.
A. The following activities involving direct illumination or construction activity
of portions of the beach are prohibited on the beach at nighttime during the nesting
season for the protection of nesting marine turtle females, nests and hatchlings:
(1) The operation of all motorized vehicles, except emergency and law
enforcement, or beach maintenance vehicles or those permitted on the
beach for marine turtle's conservation and/or research.
(2) The building of campfires or bonfires.
(3) Fireworks displays, except those that have City special event permits and
approved by the City of Sunny Isles Beach and Miami-Dade County.

B. Special events. Special events taking place on the beach during nesting
season that may have lighting needs shall require a permit from the City of Sunny
Isles Beach and Miami Dade County.
C. Lighting standards for new development. It is the policy of the City of Sunny
Isles Beach that no artificial light shall illuminate any area of the beach. The
following applies to lighting that directly illuminates the beach and interferes with
turtle nesting. To meet this requirements, all public and private properties and use
involving new construction, or renovations exceeding 50 percent of the value of the
structures as determine by the Building Official shall comply with the following:
(I) Exterior artificial light fixtures shall be designed and positioned so that
the point source of light or any reflective surface or the light fixtures is
not directly visible from the beach
(2) Exterior artificial light fixtures within direct line-of-sight of the beach
shall include only fixtures, or recessed fixtures having non reflective
interior surfaces. Interior fixtures will be in compliance with the
requirements of the code.
(3) All fixtures shall be mounted as low in elevation as possible through use
of low-mounted wall fixtures, wall fixtures fitted with hoods, low
bollards and ground-level fixtures, so that no light is directly visible from
the beach or illuminates the beach.
(4) Floodlights, upward-oriented lights, spotlights or search lights for
decorative and accent purposes, or used as security lights, are prohibited
if they would be directly visible from the beach, or would indirectly or
cumulatively illuminate the beach.
(5) Pole lights, ifused, shall be shielded in such a manner that light will be
contained primarily within the area that is landward of the pole, and light
shall not be directly visible from the beach.
(6) Parking areas and structures shall be designed and located to prevent
vehicular headlights from directly or indirectly illuminate the beach.
Parking area and parking structures lighting shall be shielded from the
beach through the use of shields that direct light away from the beach.
Such ground-level barriers shall not interfere with the marine turtle
nesting or hatchling emergence and shall not cause short or long-term
damage to the beach/dune system. Entrances and exits to parking
structures shall not face the ocean. Surfaces or parking areas shall not
contain ground glass or other reflective material.

(7) Lighting provided for any outdoor recreational feature on or abutting the
beach (such as tennis courts, swimming pool, etc.) shall be shielded to
prevent light from directly or indirectly illuminating the beach.
(8) Temporary security lights at construction sites shall not be mounted more
than 8'-0" feet above ground. Illumination from the lights shall be the
minimum necessary to assure security, shall not spread beyond the
boundary of the property being developed, and in no case shall such
lights illuminate the beach.
D. Lighting standards for new development that has already been permitted. The
provisions of subsection (C) of this section shall not apply to any structure for which
the City of Sunny Isles Beach Building Department has issued a building permit prior
to the effective date of this ordinance. Such structures shall be governed by the
provisions of subsection (E) of this section.
E. Lighting standards for existing development. It is the policy of the City of
Sunny Isles Beach that no artificial light shall illuminate any area of the beach. To
meet this intent, lighting of existing structures, shall be in compliance with the
following:
(1) These standards do not apply to interior lights as defined in this
Ordinance.
(2) Within six months of the effective date of this article, existing artificial
light fixtures shall be repositioned, modified, or removed so that:
a) The point source of light or any reflective surface of the light
fixture is not directly visible from the beach;
b) Areas seaward of the frontal dune are not directly or indirectly
illuminated; and
c) Areas seaward of the frontal dune not cumulatively illuminated.
(3) Within one year of the effective date of this article, the following
measures shall be taken to reduce or eliminate the negative effects of
existing exterior artificial lighting that cannot be brought into compliance
with the provision of these standards:
1. Reposition fixtures so that the point source of light or any
reflective surface of the light points away from the beach;
11. Replace non directional fixtures with directional fixtures
that point down and away from the beach;
111. Replace pole lamps with low-profile, low-level luminaries

so that the light source or any reflective surface of the light
is not visible from the beach;
IV. That cannot be bought into compliance '.'/ith the provision
of these standards.
F. Publicly-owned lighting. Streetlights, existing lighting at parks, publicly owned
parking facilities and publicly owned walkways shall be subjected to the
following:
(1) Lighting at parks, publicly owned parking facilities and publicly owned
walkways shall be shielded or shaded during nighttime hours of nesting
season so that such lighting does not illuminate the beach and visibility is
reduced from the beach. Such shielding or shading shall not create a
safety hazard for pedestrians.
G. Unlawful to kill, molest, or injure turtles. In accordance with F.S. Ch. 370 and
the U.S. Endangered Species Act of 1973, it shall be unlawful for any person to
kill, molest, harass, or cause direct or indirect injury to a species of marine turtle
in the City of Sunny Isles Beach or within its jurisdictional waters. It shall be
unlawful to collect or possess any part of a marine turtle, turtle nest and/or egg( s).
The City of Sunny Isles Beach will cooperate with appropriate state and federal
agencies in prosecuting violations of the Act.
Enforcement and Penalties.
(a) The provisions of this Ordinance shall be enforced in accordance with
Chapter 14 of the Code of the City of Sunny Isles Beach. The
Community Development Department shall be responsible for the
enforcement of the provisions of this Ordinance.
(b) Other person or persons responsible for lighting or management of the
property may also be served with notice if determined appropriate by the
city administration. Upon refusal, failure or neglect of the person or
persons served with a notice of violation to cure the violation within ten
days of such notice, or when the violator or the violator's representatives
do not appear at the hearing granted pursuant to this Code, or when an
order finding a violation is entered against the violator, the enforcing
agency shall notify the property owner, in writing, ofthe extemallighting
source causing the violation, and possible liens that may be imposed until
compliance is obtained.
(c) No permit may be issued by the City of Sunny Isles Beach to improve or
expand any facility constructed or modified in violation of this Ordinance
until the violation has been corrected, and all associated code
enforcement fees are collected.
(d) Violations of this section shall be deemed an infraction and subject to

citation. The penalties for violation of this article are as follows:
1) For the first offense a warning of Code Violation will be
issued;
2) Second offense a $100.00 Civil Violation
3) Third offense and any subsequent violations occurring within
one year of any other violation a $200.00 civil violation. Each
day that a violation exists shall be deemed a separate
violation.
Violations.
Each day a violation continues, shall be considered a separate offense.
Additionally, each sea turtle or eggs that are killed, injured, or molested shall
constitute a separate violation. Any other person, who commits, participates
in, assists in, or maintains such violation may each be found guilty of a
separate offense and suffer the penalties herein provided.
The City of Sunny Isles Beach, in addition to the criminal sanctions contained
herein, may take any other appropriate legal action, including but not limited
to injunctive action, to enforce the provisions of this article.
Severability. The provisions of this Ordinance are declared to be severable and ifany
section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to
be invalid or unconstitutional, such decision shall not affect the validity of the
remaining sections, sentences, clauses, and phrases of this Ordinance, but shall
remain in effect, it being the legislative intent that this Ordinance shall stand
notwithstanding the invalidity of any part.
Repealer. Any and all ordinances, resolutions and parts of ordinances or resolutions
in conflict with this Ordinance are hereby repealed insofar as they are inconsistent or
in conflict herewith.
Inclusion in the Code. It is the intention of the City Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become an appendix to the City
of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

PROPOSALS FOR PROPERTY
MANAGEMENT SERVICES
The Naranja Lakes Community Redevelopment Agency (the "CRA") is
solicning Proposals from qualified persons and entities to provide property
management services to the CRA for its Community Center located at
27555 SW 140 Avenue, Naranja, Florida.
Innially, the Community Center is intended to be used by the CRA for
its administrative purposes including holding ns Board meetings and
workshops, as well as serving the needs of ris Board Members and staff from
time to time. Depending upon policies yetto be adopted by the CRA, in the
future the Community Center may be used on a more intensive basis by the
CRA. Such uses may possibly require on"site personnel at the Community
Center on an as-needed, part-time or even full-time basis wrih such needs
yet to be determined. Accordingly, the Property Manager should be able to
demonstrate that ri has the ability to provide such personnel if required by
the CRA. Without limiting the foregoing, the Community Center may be used
for a variety of purposes including hourly or daily rental of the facilities for
special events for organizations and individuals. If the Community Center is
used for such purposes or otherwise, the Property Manager may be tasked
with the responsibility tor the coordination of such activities including,
but not limited to, necessary staffing, calendaring events, collecting fees,
follow-up, etc. Further, the CRA is also contemplating entering into an
agreement wrih the Miami-Dade Police Department ("MDPD") to allow the
MDPD to use a portion of the Community Center as a work station, which
mayor may not be staffed by MDPD on a 24 hour per day basis. The
Community Center work station would not be a tull service police station,
but merely a location utilized by officers to write police reports and make
phone calls. The Property Manager would be required to coordinate with
and assist MDPD in connection with its use of the Community Center.
The primary responsibilities of the selected Property Manager will be to
provide property management services to the CRA for the Community
Center including, but not limited to the following: maintenance and repairs:
accounts payable; budgeting; reporting and record retention; and servicing
of all inquires and complaints.

Sea Turtles Protection Regulations on the Beach Area Adjacent to
Existing and Proposed Developments
RECOMMENDATION:
It is recommended that the City Commission approve the attached Ordinance
creating guidelines for lights along the beach area, related to the protection of
turtles and turtles nesting.
REASONS:
The Community Development Department performed a study of various
municipalities and counties in the East and West Coast of Florida. The City of
Sunny Isles Beach does not have an ordinance that regulates the installation of
lights along properties located in the East side of Collins and adjacent to the
beach. As the City of Sunny Isles Beach area is a location used by turtles during
the month that expand from April 1 through October 31 of each year for nesting
purposes, this ordinance will provide additional protection for this type of
endangered animal species. Below is a list of the locations that were visited by
the Department during the survey that was conducted prior to the creation of this
ordinance, and the condition that was found during the visit:

The list identifies a total of (10) locations with issues related to lights on the
beach. There are total of (31) locations on the beach. The amount of work and
the cost involved to correct the issue is minimal, as indicated by the action of the
location. In fact all locations were issued a notice by means of our existing
lighting code Section 264-74 better known as the Exterior Light Standards under
the Section 265 of the Land Development Regulations and correction has been
obtained in all locations.
ADDITIONAL INFORMATION:
The ordinance also provides for exceptions when the light is an interior light
found in the inside of a building or balcony area.
