RESOLUTION NO. 98-Z-16
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, FOR 17070
COLLINS AVENUE SHOPPING CENTER, LTD., FOR
APPROVAL OF MODIFICATION OF PLAN AND NON-USE
VARIANCES FOR PARKING, ADDITIONAL SIGN AND
HEIGHT OFFENCE, SUBJECT TO CERTAIN CONDITIONS.
WHEREAS, 17070 Collins Avenue Shopping Center, Ltd., has applied for the following:
Modification of Condition #2 of Resolution 5-ZAB-200-94 as further modified by Resolution 5-
ZAB-354-95 passed and adopted by the Zoning Appeals Board on the 6th of September, 1995,
reading as follows and only as it applies to the site plan. :

That in the approval of the plan, the same be substantially in
accordance with that submitted for the hearing entitled ' Proposed
Tenant Improvements at RK. Commercial Center' as prepared by
Roger Piper Architecture, consisting of 4 sheets, dated 12-15-94, a
'Sketch of As-Built Survey' as prepared by Zurvelle Whittaker, Inc.
dated stamped received April 6, 1995, a 'Liquor Survey' as prepart:(d
by Fortin, Leavy, Skiles Inc. consisting of 5 sheets: 'Store No.
T17032. T17082, T250A, Till (T266 & T267), plans dated 2-8-95:
Chistine Lee's Restaurant at RK. Commercial Center' as prepared by
Roger Piper Architecture dated 5-8-95., except as herein modified to
exclude the parking variance and to comply with the previously
approved plans as it pertain to the parking.
That in the approval of the plan the same be substantially in
accordance with that submitted for the hearing entitled "RK. Centre
at A ventura Beach" prepared by Kobi Karp Associates dated stamped
received 4-7-98 and plans entitled "detached Sign" prepared by
unknown dated stamped received 4-7-98.
The purpose ofthis request is to allow the applicant to revise the site plan to show dedicated parking
for the City of Sunny Isles Beach Police Department and to show an additional sign for the shopping
center and reduce the amount of parking spaces.
1. Modification of Plans approved pursuant to resolution 4-ZAB-2-91, passed and adopted by
the Zoning Appeals Board on the 16th of January, 1991, reading as follows:

prepared by Norman M. Giller and Associates, Inc., dated revised 12-
7-90; revised parking for Coffee House @ 201, 202 & 203; and to
add 54 sq. ft. wall sign, and replace pylon sign; and revised 10-24-90
to add curve cuts, show patron areas, correct Taco Bell Layout; plans
for 'Partial 1 st & @ 2nd floor plans (east) for Coffee House Layout,'
as prepared by Norman M. Giller & Assoc. Inc, dated revised 12-7-
90; plans for 'Liquor Survey,' as prepared by Fortin, Leavy, Skiles,
Inc., dated 12-19-90 and 'Pantry Pride,' illuminated sign reading
'Food Emporium,' dated 11-26-90 and ' Pantry Pride Super Markets,'
as prepared by Mc Neal Signs, Inc., dated 1-31-90.
To: That in the approval of the plan the same be substantially in
accordance with that submitted for the hearing entitled "RK. Centre
at A ventura Beach" prepared by Kobi Karp Associates dated stamped
received 4-7-98 and plans entitled "detached Sign" prepared by
unknown dated stamped received 4-7 -98., only as it applies to the site
plan.

2. Non Use Variance of parking requirements to permit 600 parking spaces (1,108spaces
required) (1,052 spaces previously approved.
3. Non Use Variance of sign requirements to permit a 4th detach sign (not permitted) 32 sq ft.
in size (3 detach signs previously approved) (2 detach signs permitted).
4. Non Use Variance offence height requirements to permit a 12 ft. high chain link fence (8
ft. high permitted).
LEGAL:
The East 700' ofthat part ofthe North 400' of Lot 1 of "Tatum's Ocean Park", according to the plat
thereof as recorded in Plat Book 1 0 at Page 64 ofthe public records Dade County, Florida. Lying
West of State Road A. LA (Collins Avenue) the aforesaid property is a parallelogram land, The
Easterly and Westerly line thereofbeing 401.92 feet and the Northerly and Southernly lines thereof
being 700.0 feet.
The East 773'-6" ofthat portion of the South 200.0 feet of Lot 2, Tatum's Subdivision, recorded in
Plat Book 10 at Page 64 of the public records of Dade County, Florida, lying Westerly of the
Westerly Right -of- Way line of State Road A.l.A (100.0 feet wide and also known as Collins Avenue
and/or Ocean Boulevard), as said Road is recorded in Plat Book 46 at Page 40 of the public records
of Dade County, Florida, said south 200.0 feet or Lot 2 Bounded on the West by the Easterly Line
of the Intracoastal Waterway (Florida East Coast Canal), as said Waterway is recorded in Plat Book
37 at Page 4 of the public records of Dade County, Florida.
Less and excepting from said land described above, that land described in a Right- of- way Deed to
Dade County, Florida as described below:
That portion ofthe South 200.0 feet of Lot 1 of Tatum's Subdivision in Section 11, Township 52
South, Range 42 East, according to the Plat thereof recorded in Plat Book 10 at Page 64 ofthe public
records of Dade County, Florida, which lies within a strip ofland 50.0 feet in width, tying 30. feet
on each side of following described Centerline:
Commence (p.O.C.) at the S.W. corner of Lot 14, South Shore Estates, according to the Plat thereof,
recorded in Plat Book 52 at Page 59 of the public records of Dade County, Florida, and run West
along the South boundary line of the said South Shore Estates, along the North line of the South
300.0 feet of said Lot 2, a distance of25.03 feet to the Point of Beginning (p.O.B) of the here-in-
after described Centerline; thence run South at right angles to the last described line, a distance of
300.0 feet to the Point of Intersection (P.I.) with the South line of said Lot 2 at a point which is
1522.64 feet West of the Westerly Right-of- Way line of the above referenced State Road A.l.A as
measured along the Southerly line of said Lot 2, said P.1. also being the end of the herein described
Centerline. The above described land, less the excepted portion, is all the adjacent described Exhibit
"A" and Exhibit "B" and contains 536,422 square feet, more or less or 12.314 acres, more or less.

WHEREAS, the public hearing ofthe City Commission was advertised and held as required
by law and all interested parties concerned in the matter were heard, and upon due and proper
consideration having been given to the matter and to the recommendations of both the Zoning and
Code Administrator and the Building Official with respect to all requests;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, THAT:
The requests be and the same are hereby approved in accordance with the following conditions:
1. That a site plan be submitted to and meet with the approval of the Building Official upon the
submittal of an application for a building permit; said plans to include among other things but not
limited thereto, location of structure or structures, types, sizes and location of signs, light standards,
off street parking areas, exits and entrances, drainage, walls, etc.
2. That in the approval of the plan, the same be substantially in accordance with that submitted for
hearing entitled "R.K. Centre at A ventura Beach" prepared by Kobi Karp Associates dated stamped
received 4-7-98 and plans entitled "detached Sign" prepared by unknown dated stamped received
4-7-98., only as it applies to the site plan.
3. That the use be established and maintained in accordance with the approved plans.
4. This Resolution shall become effective upon adoption.
