RESOLUTION NO. 98-Z-19
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, FOR COLLINS & 194TH ASSOCIATES, LTD.,
APPROVING REQUEST FOR NON-USE VARIANCE OF PARKING
REQUIREMENTS TO PERMIT 409 PARKING SPACES (449 REQUIRED);
TO PROVIDE AN EFFECTIVE DATE.
WHEREAS, Collins & 194th Associates, Ltd., has applied for the following:
1. Non-Use Variance of Parking requirements to permit 409 parking spaces (449 parking
spaces required).
SUBJECT PROPERTY:
A parcel of land lying in Section 2, Township 52 South, Range 42 East, Dade County, Florida, being
more particularly described as follows:
Begin at the southwest corner of SHERATON BEACH HOTEL TRACT according to the Plat
thereof as recorded in Plat book 128, at Page 73 of the Public Records of Dade County, Florida said
point being on a circular curve to the right, concave Easterly whose radius bears S 84027'03" E.
from said point, and said curve having for it's elements a radius of2314.12 feet and a central angle of
11 044 '19"; thence N ortherl y, along the arc of said curve, being the Easterly right -of-way line of State
Road A-I-A, also known as Collins A venue, 474.11 feet to a point of reverse curvature of a curve to
the left, concave Westerly and having for it's elements a radius of 1432.69 feet and a central angle of
09041'37"; thence, N ortherl y, along the arc of said curve, 242.39 feet to the Northwest corner ofthe
aforementioned Plat of SHERATON BEACH HOTEL TRACT; thence, departing from the Easterly
Right-of-Way line of said State Road A-I-A, S 88013'01" E. along the Northerly line of said Plat of
SHERATON BEACH HOTEL TRACT, 330.80 feet to the Northeast corner of said Plat of
SHERATON BEACH HOTEL TRACT; thence continue S 88013'01" E. for 7.31 feet to the
intersection with the Erosion Control Line as recorded in Plat Book 134, at Page 47, of the Public
Records of Dade County, Florida; S 04019'27" W. along said Erosion Control Line 359.09 feet;
thence S 04010'59" W. for 346.61 feet to the intersection of the Southerly line of the Plat of
SHERATON BEACH HOTEL TRACT; thence, departing from said Erosion Control Line, and
along said Southerly line of SHERATON BEACH HOTEL TRACT,N 88009'00" W. for431.66 feet
to the POINT OF BEGINNING.
ADDRESS: 19405 and 19455 Collins Avenue
and;
WHEREAS, the public hearing of the City Commission was advertised and held as required
by law and all interested parties concerned in the matter were heard, and upon due and proper
consideration having been given to the matter and to the recommendations of both the Zoning and
Code Administrator and the Building Official with respect to all requests;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
1. The requests be and the same are hereby approved including the acceptance of a voluntary
proffered Declaration of Restrictive Covenants as presented to the City Commission meeting of
August 13, 1998, attached hereto as Exhibits "A", and in accordance with the following conditions:
a. That a site plan be submitted to and meet with the approval of the Building Official
upon the submittal of an application for a building permit; said plans to include
among other things but not limited thereto, location of structure or structures, types,
sizes and location of signs, light standards, off street parking areas, exits and
entrances, drainage, walls, etc.
b. That in the approval of the plan, the same be substantially in accordance with that
submitted for hearing entitled "Ocean One" prepared by The Sieger Architectural
Partnership consisting of 5 sheets dated stamped received 5/7/98. Plans may be
modified at public hearing.
c. That the use be established and maintained in accordance with the approved plans.
d. That the applicant voluntarily proffered a Declaration of Restrictive Covenants
acceptable to the Building Official restricting the sale of only 20 private parking
spaces thereby reducing the required parking by 40 spaces only.
e. That the applicant provides the City with all appropriate joinders on the Declaration
of Restrictive Covenants that was provided to the City Commission as part of this
August 13, 1998 hearing prior to the issuance of any building permits for the
proposed request.
2. This Resolution shall become effective upon adoption.
PASSED and ADOPTED this 13th day of August, 1998.

zoning modifications, and upon a roll call the vote was 5 - 0 in favor:
