A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, APPROVING A SPECIAL EXCEPTION FOR
SITE PLAN APPROVAL FOR FIVE SEAS INVESTORS, INC., SUBJECT TO
CERTAIN CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Five Seas Investors, Inc., applied for the following:
1. Special Exception for site plan approval to permit a condominium hotel in the BU-2 district.
SUBJECT PROPERTY:

WHEREAS, a public hearing of the City Commission was advertised and held as required
by law and all interested parties concerned in the matter were heard, and upon due and proper
consideration having been given to the matter and to the positive recommendations of both the
Zoning and Code Administrator and the Building Official;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
1. The request for Special Exception for site plan approval to permit a condominium hotel in
the BU-2 district is hereby approved, subject to the following conditions:
a. That a site plan be submitted to and meet with the approval of the Building
OfficiaL upon the submittal of an application for a building permit; said plans to
include among other things but not limited thereto, location of structure or
structures, types, sizes and location of signs, light standards, off street parking
areas, exits and entrances, drainage, walls, etc
b. That in the approval ofthe plan, the same be substantially in accordance with that
submitted for hearing entitled "Westgate Condominium" prepared by Kobi Karp
consisting of 31 sheets dated 7/10/98 and landscape plans prepared by Witkin
Design Group dated 7/14/98 consisting of 3 sheets. Plans may be modified at
public hearing.
c. That the use be established and maintained in accordance with the approved plans.
d. That the Applicant submit to the Building Official for its review and approval a
landscaping plan which indicates the type and size of plant material prior to the
issuance of a building permit and to be installed prior to the issuance of a
Certificate of Use and Occupancy.
e. That a recordable agreement be submitted to and meet with the approval of the
Building Official providing for permanent and safe access for pedestrian and
vehicular traffic within the garage and particularly for fire, police and other public
service personnel and vehicles. Such agreement shall be executed by the property
owners and any and all parties having an interest in the land, such as mortgages,
etc. and its improvements.
f. That the Applicant voluntarily proffers a Declaration of Restrictions and Unity of
Title acceptable to the Building Official provided required parking for the hotel
and condominium hotel on the parcel directly across Collins Avenue.
g. That the Applicant complies with all conditions and requirements of the
Department of Environmental Resources Management (DERM), the Fire
Department and the Florida Department of Transportation.
h. That the Applicant will abide by all City and County ordinances relating to the
hours of operation for construction commencement and termination.

Planning Recommendation

RECOMMENDATION
Staff recommends that the City Commission find the proposed site plan to be in accordance with
the requirements of the zoning code and to be in compliance with the requirements of the Land
Use Element of the Comprehensive Development Master Plan.
REASON & ANALYSIS
The proposed project is to be located on the site of an existing hotel complex which is located within
a BU-2 zoning district. The underlying land use designation of the current Comprehensive
Development Master Plan is "Business/Office". The comprehensive plan specifically designates
"Hotel"use as being a "Business/Office use(See"Business and Office"on page I-35 of the CDMP).
The comprehensive plan lays out specific guidelines for use in making site plan and zoning
determinations such as are appropriate in this instance.
"In reviewing zoning requests or site plans,the specific intensity and
range of uses, and dimensions, configuration and design considered
to be appropriate will depend upon locational factors, particularly
compatibility with both adjacent and adjoining uses,and availability
of highway capacity, ease of access and availability of other public
services and facilities. Uses should be limited when necessary to
protect both adjacent and adjoining residential use from such impacts
as noise or traffic..."'
The subject site is located on the shoreline east of Collins Avenue at the intersection of two
roadways which are designated as"Major Roadways"on the Land Use Plan Map of the CDMP. It
is one of the most accessible sites within the city. The parcel is located within an area where all of
the adjacent and adjoining properties consist of large scale residential high rise towers.Immediately
to the south are three (3) 29 story towers. The parcel to the north contains a 24 story tower.
Immediately west of the proposed project is a large parcel of land zoned BU-2 which is scheduled

to contain a parking facility which will serve the needs of this project as well as provide accessible
public parking for beach access through Samson Park.It should be noted that Samson Park provides
added setback buffer between this project and the existing high rise structures to the south. The
proposed project meets all of the zoning requirements for the BU-2 district.No variances of any kind
are required to permit the construction of this project as submitted.All setbacks are adequate.There
is adequate open space to permit the requested height and,the Hotel use itself was approved by Dade
County decades ago for this parcel.
The proposed high rise tower is similar in nature and configuration to adjoining and adjacent high
rises. However, it should be stressed that all of the adjacent and adjoining high rise structures
required numerous variances to permit their construction.Virtually all of these large scale structures
have height, setback, FAR and lot coverage variances. This proposed hotel structure requires no
variances whatsoever. It meets all of the requirements of the zoning code.
As has previously been pointed out,the proposed project site is easily accessed. The site, located at
the junction of two major roadways, is also located within the designated Dade County Urban
Boundary. Traffic concurrency is not a requirement for development within the Urban Boundary.
However, all available data regarding traffic flow rates and levels of service on the subject effected
roadways indicates that there will be no adverse impact to the planned level of service for either road
as a result of this development. There is adequate water and sewer capacity to service this project.
There is adequate solid waste capacity to accommodate this development. The project is located on
a public beach within .5 miles of the Haulover Beach Park facility. This hotel project will increase
the accessibility and quality of the outdoor recreational opportunities available to Floridians and to
tourists alike. It represents a major investment in the improvement of already existing beach hotel
facilities. Unlike the construction of condominiums and rental apartments, this project will not
appreciably increase the population of a Coastal High Hazard area. It will not adversely impact
schools. It will not adversely impact emergency services. It will not adversely impact sensitive
coastal habitat. It is a commercial hotel facility,not a residential development. The Land Use Plan
Map of the CDMP anticipates exactly this type of development along the beach through its
designation of this area as"Business Office".The zoning map anticipates such development as well
through the BU-2 designation of the subject parcel. Staff finds that this proposed development is
consistent with the Land Use Element of the Comprehensive Development Master Plan.Staff further
finds that the proposed project meets or exceeds the requirements necessary for a finding of"site
plan approval".

Subject: FIVE SEAS INVESTORS, INC. ( Z98-12)
RECOMMENDATION
Staff recommends approval with conditions of the applicants request for a special exception for site plan
approval for a condominium hotel.
REASONS
The proposed project is located between Collins Avenue and the Atlantic Ocean, north of Sunny Isles Blvd.
and consists of 5.3 acres. The property is zoned BU2 and is currently being used as a hotel site. The 2005-
2015 Comprehensive Development Master Plan (CDMP) designates the property as Business and Office use. The
Land Use Element of the CDMP permits,residential uses and the mixing of residential use with commercial, office
and hotel uses within the Business/Office land use designation.
The property has a history consisting of several public hearings. The property owner requested variances
from the zoning code as well as modification of plans, when it was under the jurisdiction of Miami Dade
County. After a review of previous resolutions and plan approval that the county had on record, staff
concluded that the County never approved a plan which showed the entire subject property with all its
amenities. Although there is a legal argument from the property owner that the proposed tower can be built
as of right, it is staff's opinion that the applicant has to come before the City for site plan review and
approval for the proposed building.
The applicant is requesting a special exception for site plan approval to permit a 40 story condominium hotel.
The proposed new structure is to be located along the southern portion of the property abutting the existing
11 story hotel. The parcel to the south of the subject property has 3 existing towers of 29 stories each. The
parcel to the north has a 24 story tower. While the applicant is proposing a building which is 11 stories
higher than the structures in the adjoining property, staff acknowledges the fact that the proposed and
existing buildings on the site do not require any variances from the code. The proposed tower is providing
a greater setback, less mass and area than the buildings on the properties to the north and south.
Staff recommends approval with conditions of the applicants request. The proposed building does not create
an unfavorable effect to the economy of City of Sunny Isles Beach while meeting the levels of service
required by the County. The proposed and existing buildings on the site are compatible with other buildings
along the Collins Avenue corridor. Staff's review of the site plan will ensure the City that the proposed and
existing structures on site are under full compliance of the code, thereby eliminating any previous
discrepancies that had occur under previous resolutions.

approval to allow for project parking to be located across Collins Avenue,west of the subject parcel.

Dear Mr. Vera:
DERM has reviewed the subject application and has determined that it
meets the minimum requirements of Chapter 24 of the Code of
Miami-Dade County, Florida . Accordingly, the application may be
scheduled for public hearing. DERM has also evaluated the request
insofar as the general environmental impact that may derive from it,
and based upon the available information offers no objection to its
approval .
POTABLE WATER SUPPLY & WASTEWATER DISPOSAL
Public water and public sanitary sewers can be made available to this
property. Therefore, DERM will require connection to the public
water supply and public sewer systems .
Notwithstanding the foregoing, in light of the fact that the County' s
sanitary sewer system has limited sewer collection/ transmission and
treatment capacity, no new sewer service connections can be permitted
until adequate capacity becomes available. Consequently, final
development orders for this site may not be granted unless adequate
capacity in the sanitary sewer collection/transmission and treatment
system is available at the point in time when the project will be
contributing sewage to the system or if approval for alternative
means of sewage disposal can be obtained. Use of an alternative
means of sewage disposal shall be an interim measure, with connection
to the public sanitary sewer system required upon availability of
adequate collection/transmission and treatment capacity.
STORMWATER MANAGEMENT
A Standard General Environmental Resource Permit from DERM shall be
required for the construction and operation of the required surface
water management system. The applicant is advised to contact DERM in
order to obtain additional information concerning these requirements .
All stormwater shall be retained on site utilizing properly designed
seepage or infiltration drainage structures . Drainage plans shall
provide for full on-site retention of the stormwater runoff of a 5
year storm event . Pollution Control devices shall be required at all
drainage inlet structures .
Site grading and development shall comply with the requirements of
Chapter 11C of the Code of Miami-Dade County.
HAZARDOUS MATERIALS MANAGEMENT
Due to the nature of uses allowed in the existing zoning
classification, the applicant may be required to obtain DERM approval
for management practices to control the potential discharge and
spillage of pollutants associated with some land uses . The
Industrial Facilities Section of DERM should be contacted for further
information on required management practices for certain land uses
permitted under the existing zoning classification.
FUEL STORAGE FACILITIES
Section 24-12 .2 of the Code outlines regulations for any proposed or
existing underground storage facilities . The regulations provide
design, permitting, installation, modification, repair, replacement
and continuing operation requirements and criteria. In addition,
monitoring devices, inventory control practices and pressure testing
of fuel storage tanks is required. The Storage Tank Section of DERM
should be contacted for permitting requirements in this regard if any
fuel storage facilities are proposed.
OPERATING PERMITS
Section 24-35 . 1 of the Code authorizes DERM to require operating
permits for facilities that could be a source of pollution. The
applicant should be advised that the requested use of the subject
property may require an operating permit from DERM. It is therefore
suggested that the applicant contact DERM concerning operating permit
requirements .
TREE PRESERVATION
Section 24-60 of the Code requires the preservation of tree resources .
A Dade County tree removal permit is required prior to the removal
or relocation of any trees . The applicant is advised to contact
DERM staff for permitting procedures and requirements prior to
development of site and landscaping plans .
COASTAL
A Class I Permit for work in tidal waters will be required for any
proposed work on, over or upon tidal waters including but not limited
to seawalls, mangrove trimming or removals, etc .
Any encroachment waterward of the coastal construction control line
(CCCL) will require approval from the Florida Department of
Environmental Protection (FDEP) Division of Beaches and Shores . It
is the responsibilty of the applicant to contact FDEP for their
permitting requirements .
Pursuant to Section 24 .27 . 1, Miami-Dade County Code, species listed
under Policy 8I of the Conservation Element of the Conservation
Element of the Comprehensive Development Master Plan may not be sold,
propagated or planted. Likewise, the planting of controlled species,
such as Scaevola frutescens (S . taccada; S. sericea) (scaevola;
half-flower) , Wedelia trilobata (wedelia) and Washingtonia spp.
(Washington palm) are prohibited in this location. Additionally, if
exotic, invasive vegetation is present at the site, it shall be
removed prior to re-development and/or construction and may not be
relocated, sold or transported off-site pursuant to the
aforementioned Ordinance.
In summary DERM offers no objections to the request provided that the
applicant properly addresses all Code requirements contained herein.
Furthermore, this letter shall consitute DERM' s written approval as
required by the Code.

As per your request,this is to confirm that the City of North Miami Beach Public Services
Department is able and willing to serve this site with water service only.
There is an 8 inch water main on the east side of Collins Avenue along the frontage of the
property. There is also a 20 inch water main to the south of this property along Collins Avenue.
Water main extension approvals are reviewed out of this office. Water connection charges
(inplant fees and fireflow demand charges) are also calculated here.
