HomeMy WebLinkAboutResolution Zoning 98-Z- 22 RESOLUTION NO, 98-Z-22 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE REQUEST OF A VENTURA BEACH CLUB CONDOMINIUM ASSOCIATION, INC., FOR A NON-USE VARIANCE OF PARKING REQUIREMENT TO PERMIT AN EXISTING APARTMENT/HOTEL WITH 393 PARKING SPACES (603 REQUIRED) SUBJECT TO CERTAIN CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, A ventura Beach Club Condominium Association, Inc., has applied for the following: 1. Non Use Variance of parking requirements to permit an existing apartment I hotel with 393 parking spaces (603 spaces required). SUBJECT PROPERTY: PARCEL "A": The South 25.00 feet of Lot 6 and all of Lots 7, 8, 9 and 10, Block 2, VENICETTA BEACH SUBDIVISION, recorded in Plat Book 9 at Page 100, said lot boundaries extended Easterly to the Erosion Control Line of the Atlantic Ocean, as said Line is recorded in Plat Book 134 at Page 47; all recorded in the Public Records of Dade County, Florida. PARCEL "B": That certain Parcel of Land lying immediately West and adjacent thereto, being a portion of Section 2, Township 52 South, Range 42 East, and a portion of Ocean Boulevard, as shown on the above- referenced VENICETTA BEACH SUBDIVISION, described as follows: Bounded on the South by the Southerly line of Lot 10 produced Westerly; Bounded on the North by the Northerly line of the South 25.00 feet of Lot 6 produced Westerly; Bounded on the East by the Westerly line of Block 2 as shown on the above-referenced VENICETT A BEACH SUBDIVISION, and Bounded on the West by the East Right-of-way Line of State Road A-I-A, as shown on the State of Florida Right-of-Way Map, recorded in Plat Book 57 at Page 23 ofthe Public Records of Dade County, Florida. The above-described Parcels "A" and "B" more particularly described by metes and bounds as follows: Begin (P ,O.B.) At the Northwesterly corner of above-described Parcel "B" and run S. 880 Resolution No. 98.Z.22 -1- 05" E. Along the Northerly line of Parcels "A" and "B", 431.78 feet to the Erosion Control line of the Atlantic Ocean, recorded in Plat Book 134 at Page 47 of the Public Records of Dade County, Florida; Thence run S. 4 14'50" W. Along the Erosion Control Line, 1.83 feet; Thence run S. 30 01'22" W. 210.72 feet to the Southerly line of Parcels "A" and "B"; Thence run S. 880 03'55" W. 433.33 feet to the Southwesterly corner of said Parcel "B"; Thence run N. 10 54'25" E. 93.28 feet to the Point of Curvature (P .C.) of a circular curve concave Easterly and having a radius of2314.12 feet; Thence run Northerly along the arc of said curve, through a central angle of 3 0 40'24.30", 148.34 feet to the Point of Beginning (P.O.B.). ADDRESS: 19201 Collins Ave., and WHEREAS, a public hearing ofthe City Commission was advertised and held as required by law and all interested parties concerned in the matter were heard, and upon due and proper consideration having been given to the matter and to the positive recommendations of both the Zoning and Code Administrator and the Building Official; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, THAT: 1. The request for a Non-Use Variance of parking requirements to permit and existing apartment/hotel with 393 parking spaces where 603 is required, is hereby approved, subject to the following conditions: A. That the Condominium Association or the hotel commercial units be required by Restrictive Covenant, acceptable to the Building Official, to maintain a 24-hour a day valet service. B. That the Condominium Association agree by Restrictive Covenant acceptable to the Building Official to restrict all condominium owners, guests, tenants or facility users of any kind from access to the parking garage except through the use of the valet parking. C. That all garage and surface parking spaces be specifically designated for use by either the A ventura Beach Club Condominium Association or for the Residences of Sunny Isles, Inc., in order to ensure that each entity shall have the necessary required parking and that the designated parking plan shall be approved by the Building Official prior to the issuance of any Certificate of Occupancy for the use of the Residences of Sunny Isles. D. That a site plan be submitted to and meet with the approval ofthe Building Official upon the submittal of an application for a building permit; said plans to include among other things but not limited thereto, location of structure or structures, types, Resolution No, 98.Z.22 -2- sizes and location of signs, light standards, off street parking areas, exits and entrances, drainage, walls, etc. E. That in the approval of the plan, the same be substantially in accordance with that submitted for hearing entitled "A ventura Beach Club, a condominium" prepared by Zurwelle- Whittaker, Inc., dated revised 10/11/94. F. That the use be established and maintained in accordance with the approved plans. G. That the applicant provide a covenant acceptable to the Building Official that the property will be accessible for the use of the hotel/condo 24 hours a day, that 508 parking spaces be provided for the hotel/condo and that all parking of vehicles shall be through a 24 hour valet. H. That at all times during the construction of the project, the hotel shall have access and parking at the site 24 hours a day. 2. This Resolution shall become effective upon adoption.
