RESOLUTION NO. 99-Z-32
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE
REQUEST OF CABANAS, INC., FORA NON-USE VARIANCE
OF SETBACK REQUIREMENTS, SUBJECT TO CERTAIN
CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Cabanas Services, Inc., has applied for the following:
I Non Use Variance of setback requirements to permit an existing gazebo and metal shed to
setback 1.6 ft. from the rear east property line (5 ft required).
SUBJECT PROPERTY: Lot 1 Blk. 12 Golden Shores Ocean Blvd. Est. Sec "D" pb 53 pg48
ADDRESS: 18655 North Bay Road.
and
WHEREAS, a public haring of the City Commission was advertised and held as required by law
and all interested parties concerned in the matter were heard, and upon due and proper consideration
having been given to the matter and to the positive recommendation of the Zoning & Code Administrator;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, THAT:
I. The request of Cabanas Services, Inc., for Non Use Variance of setback requirements to permit
an existing gazebo and metal shed to setback 1.6 ft. from the rear east property line (5 ft required) is hereby
approved, subject to the following conditions:
A. That a site plan be submitted to and meet with the approval of the Building Official upon the
submittal of an application for a building permit; said plans to include among other things but
not limited thereto, location of structure or structures, types, sizes and location of signs, light
standards, off street parking areas, exits and entrances, drainage, walls, etc.
B. That in the approval of the plan, the same be substantially in accordance with that submitted for
hearing entitled "Site Plan" prepared by applicant dated 4/6/99.
C. That the use be established and maintained in accordance with the approved plans.
D. That the applicant apply for and obtain a building permit for the gazebo and utility shed from
the Building, Planning and Zoning Department of City of Sunny Isles Beach within 90 days
from the date of this resolution.
E. That the applicant comply with all conditions and requirements of the Department of
Environmental Resources Management (DERM), the Fire Department and the Florida
Department of Transportation
.. 2. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 17th day of June, 1999.
