RESOLUTION NO. 99-Z-37
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING
FLORIDA BELLEVUE ASSOCIATES, LTD.'S REQUEST FOR
MODIFICATION OF CONDITIONS, SUBJECT TO CERTAIN
CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida Bellevue Associates, Ltd., applied for the following:
1. Modification of Condition A & G of Resolution 98-Z-20, passed and adopted by the City
Commission of the City of Sunny Isles Beach on the 17th day of September, 1998 reading
as follows:

The applicant provide a Declaration of Non-Modifiable Restrictive
Covenants that the property will remain an apartment/hotel, rental
apartments and all services provided by a hotel, including daily linen
services, front desk, valet and all services connected with a hotel
operation, including a covenant that no unit will be sold as a condominium
unit in perpetuity.
The applicant provide a Declaration of Non-Modifiable Restrictive

services, front desk, valet and all services connected with a hotel
operation.
That the applicant agrees that all units will be made for rental and no more
than five percent (5%) of all individual apartment units shall be occupied
for more than six (6) months.
The applicant agrees that there shall not be the sale, conveyance, or long-
term lease or sublease (for more than six (6) months) of five (5) percent or
more cumulatively, ofthe units to the same buyer, lessor or sublessor.
The purpose of this request is to modify conditions of a previously approved resolution to allow
the applicant to sell the units in perpetuity

WHEREAS, a public hearing of the City Commission was advertised and held as
required by law and all interested parties concerned in the matter were heard, and upon due and
proper consideration having been given to the matter and to the positive recommendation of the
Zoning and Code Administrator;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
1. The modification of conditions are hereby approved subject to the following conditions:
a. The applicant provides a revised Declaration of Non-Modifiable Restrictive
Conditions that the property will remain an apartment/hotel, rental apartments and
all services provided by a hotel, including daily linen services, front desk, valet
and all services connected with a hotel operation and that there shall not be the
sale, conveyance or long-term lease or sublease (for more than six (6) months) of
five percent (5%) or more cumulatively, of the units to the same buyer, lessor or
sublessor.
2. This Resolution shall become effective upon adoption.
