RESOLUTION NO. OO-Z-47
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVINGTHE
REQUEST OF WILLIAMS ISLAND OCEAN CLUB, INC.,
REQUEST FOR MODIFICATION OF CONDITION 2 OF
RESOLUTION 98-Z-18 ALONG WITH CERTAIN NON USE
VARIANCES, SUBJECT TO CONDITIONS; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Williams Island Ocean Club, Inc., applied for the following:
1. Modification of Condition 2 of Resolution 98-Z-18 passed and adopted by the City
Commission of the City of Sunny Isles Beach on the 13th day of August, 1998 reading as
follows:

That in the approval of the plan the same be in accordance with that
submitted for the hearing entitled "Williams Island Ocean Club Inc.,"
prepared by Arc-tech Associates Incorporated dated 6/22/98.and plans
entitled "Williams Island Ocean Club, Inc.", prepared by Bradshaw Gill &
Associates dated 6/16/98 on sheet P-l and dated 6/22/98 on sheet P-2 &
P-3.
To:
Plans are on file and may be examined in the Building, Planning and
Zoning Department entitled "Williams Island Sunny Isle Condominium
Two Story Parking Structure ", prepared by Robert M. Swedroe
Architects-Planners dated stamped received 3/20/2000 consisting of 3
sheets.
2. Non Use Variance of Lot Coverage requirements to permit the proposed parking garage
with a lot coverage of 60% (40% permitted).
3. Non Use Variance of Setback requirements to permit the proposed parking garage
varying in setback from 10 to15 feet from the rear (east) property line (25 feet required).

WHEREAS, the public hearing of the City Commission was advertised and held as
required by law and all interested parties concerned in the matter were heard, and upon due and
proper consideration having been given to the matter and to the positive recommendations of
Resolution No. 00-2-47, Williams Island Ocean Club, Inc. I

both the Zoning and Code Administrator and the Director of Community Planning and
Development with respect to all requests:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
1. The requests be, and the same, is hereby approved subject to the following conditions:
A. That a site plan be submitted to and meet with the approval of the Building Official
upon the submittal of an application for a building permit; said plans to include
among other things but not limited thereto, location of structure or structures, types,
sizes and location of signs, light standards, off street parking areas, exits and
entrances, drainage, walls, etc.
B. That in the approval of the plan, the same be substantially in accordance with that
submitted for hearing entitled A Williams Island Sunny Isles Condominium Two
Story Parking Structure @, prepared by Robert M. Swedroe Architects-Planners dated
stamped received 312012000 consisting of 3 sheets.
C. That the use be established and maintained in accordance with the approved plans.
D. That the applicant provides 24-hour valet parking for the guests and that the valet
operation be handled in such a manner that it does not compound the current
pedestrian jaywalking problem.
E. That the parking structure have gated access control and site lighting. That the final
building plans indicate a method to screen headlights to minimize impact upon
adjacent properties.
F. That the night lighting for the proposed parking lot shall be designed so that any
overspill of lighting onto adjacent properties be limited to not exceed one-half (2 foot
candle power vertical) and one-half (1120 foot candle power horizontal) illumination
on adjacent properties or structures. An outdoor lighting installation shall not be
placed in permanent use until a letter of compliance from a registered engineer or
architect is provided stating that the installation has been field checked and meets the
requirements as set forth above.
G. That the applicant obtain a Certificate of Use and Occupancy from the City, upon
compliance with all terms and conditions, subject to cancellation upon violation of
any of the conditions.
H. That the applicant complies with all conditions and requirements of the Department
of Environmental Resources Management (DERM), the Fire Department and the
Florida Department of Transportation.
I. That the applicant submit to the Building Official for its review and approval a
landscaping plan which indicates the type and size of plant material prior to the
issuance of a building permit and to be installed prior to the issuance of a Certificate
of Use and Occupancy.
J. That the applicant provides a recordable Unity of Title between the hotel/beach club
and the parking lot parcel to provide for a total of 617 parking spaces.
K. That, within 90 days of this approval, the applicant submits to the City, a copy of the
executed lease by and between Williams Island Ocean Club and the Temple B'Nai

Zion Synagogue, for shared parking facility and, that a shared parking plan with the
synagogue be incorporated into an agreement that is recorded,
1" That the applicant constructs an architectural fa~ade acceptable to the Zoning &
Planning Director of the City of Sunny Isles Beach.
M. This terms of this Resolution are conditioned upon the terms of Resolution No. OO-Z-
46, and 98-Z-18.
2. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 13th day of April, 2000.
