RESOLUTION NO. 00-Z-51
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, DENYING THE APPLICATION OF
ARLEN HOUSE EAST CONDOMINIUM ASSOCIATION, ET AL.,
APPEALING THE ADMINISTRATIVE DECISION OF THE ZONING
DIRECTOR (ASPR99-0l) FOR SITE PLAN REVIEW; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, on May 11, 2000, Arlen House East Condominium Association, et al
("Applicant"), applied for an appeal of Administrative Decision ASPR 9901 of the Zoning
Director on the grounds that the Director erred in his decision approving a site plan for an
apartment development;
LEGAL
All of Lots 17 and 18, Bay Point Subdivision, according to the plat thereof as
recorded in Plat Book 46 Page 98 of the Public Records of Dade County, Florida,
and a portion of the south 50 feet of Lot 82 of Tatum's Ocean Beach Park,
recorded in Plat Book 5, at Page 35, Dade County, Florida, all being more
particularly described as follows:
Begin at the Southwest comer of said Lot 18; thence on a bearing of North along
the westerly lines of Lots 17 and 18, said westerly line also being the Easterly
line of Tract A, Arlen House East, according to the plat thereof as recorded in
Plat Book 97, page 5 of the Public Records of Dade County, Florida for 205.95
feet to the Northwest comer of said LotI 7; thence North 59059'22" East along the
northwesterly line also being Dade County Bulkhead line according to the plat of
Royal Palm Waterway as recorded in Plat Book 74, page I, sheet of the Public
Records of Dade County, Florida for 62.16 feet to the most northerly recorded
point of said Lot 17; the following course being along a line parallel with and 50
feet North of the South line of said Lot 82, Tatum's Ocean Beach Park, said
South line also being the North line of Lot 17; thence North 85051'44" East for
79.79 feet to a point on the westerly right of way line of State Road A-I-A
(Collins Ave) as shown on the said plat of Bayview Point Subdivision; thence on
a bearing of South along said westerly right of way line also being the easterly
lines of said Lots 17 and 18 and its northerly projection thereof for 200.01 feet to
a point of curvature; thence southwesterly along a 25.00 foot radius curve leading
to the right through a central angle of 80051 '00" for an arc distance of 35.38 feet
to a point of tangency; thence South 80051'00" West along the southerly line of
said Lot 18, said southerly line also being the northerly right of way line of
Bayview Drive as shown on said plat of Arlen House East for 113.83 feet to the
Point of Beginning. Lying and being in Section 14, Township 52 South, Range
42 East, City of Sunny Isles Beach, Miami-Dade County, Florida.
LOCATION: Northwest comer of Bayview Drive (158 St) and Collins Ave.

WHEREAS, a public hearing on the matter was held on July 20, 2000, which was
continued on August 14,2000, and again on September 14,2000, so that Applicant could revise
plans and seek approval from the Florida Department of Transportation for such revision; and
WHEREAS, the public hearings of the City Commission were advertised and held as
required by law and all interested parties concerned in the matter were heard, and upon due and
proper consideration having been given to the matter and to the recommendation of the Zoning
Director;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
I. The Applicant's appeal of Administrative Variance ASPR99-01 is hereby denied. It is
hereby recommended that the Applicant re-submit an engineering plan with
modifications to create a safe traffic pattern of ingress and egress to the property, at the
sole expense ofthe Applicant, to be approved by the City's Staff.
II. This Resolution shall become effective upon adoption.
PASSED and ADOPTED this 14th day of September, 2000.

Vice Mayor Morrow moved and Commissioner Turetsky seconded the motion to deny the
appeal, and upon a roll call the vote was 5- 0 in favor:
