RESOLUTION NO. Ol-Z-57
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE ZONING
REQUESTS OF MARIUS AND CLAUDETTE ROURE, SUBJECT TO
CERTAIN CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Marius and Claudette Rome ("applicant"), have applied to the City
Commission for approval of the following zoning modifications:
1 Non Use Variance of lot coverage requirements to permit an existing residence with a lot
coverage of 41 %(35% required).
2 Non Use Variance of setback requirements to permit an existing residence to setback
17.4 ft. from the front (south) property line (25 ft required), and setback 18.85 ft from the
rear (north) property line (25 ft required).
3 Non Use Variance of setback requirements to permit an existing residence to setback
5.15 ft from the interior (east) side property line (7.5 ft required), and setback 0 ft from
the interior (west) side property line (7.5 ft required).

And,
WHEREAS, a 'public hearing of the City Commission was advertised and held as
required by law and all mterested partIes concerned in the matter were heard, and, upon due and
property consideration having been given to the matter;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
1. Modifications 1 through 3 are hereby approved subject to the following conditions:
a. That a site plan be submitted to and meet with the approval of the Building
Official upon the submittal of an application for a building permit; said plans to
include among other things, but not limited thereto, to exits and entrances,
drainage, walls, etc.
b. That in the approval of the plan, the same be substantially in accordance with that
submitted for hearing entitled "Boundary Survey" prepared by "Blanco, Danial &
Assoc Inc." dated 08/23/2000.
c. That the uses be established and maintained in accordance with the approved
plans and cannot be further altered by enclosing the approved terraces and
carport.

d. That the applicant applies for, and obtains, a fully executed building permit for
the carports and terrace from the City of Sunny Isles Beach.
e. That the applicant complies with all conditions and requirements of the
Department of Environmental Resources Management (DERM), the Fire
Department and the Florida Department of Transportation.
2. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 18th day of January, 2001.
