RESOLUTION NO. 01-Z-65
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING ZONING
APPLICATION OF THE CITY OF SUNNY ISLES BEACH Z2001-10
FOR REFORMATION OF RESOLUTION NO. 00-Z-48, TO
CORRECT A TECHNICAL ERROR IN THE LEGAL
DESCRIPTION; PROVIDING FOR AN EFFECTIVE DATE.
I. RECITALS.
WHEREAS, on May 18, 2000, the City Commission of the City of Sunny Isles Beach
passed and adopted at public hearing, Resolution No 00-Z-48, approving the zoning application
of Mandalay LLC, a Florida limited partnership; and
WHEREAS, the City of Sunny Isles Beach ("Applicant") submitted an application for a
Reformation of Resolution to correct a technical error in the legal description of the property
approved under Resolution 00-Z-48 requesting the following:
1. The City of Sunny Isles Beach is applying for a Reformation of Resolution 00-Z-48
passed and adopted by the City Commission of the Sunny Isles Beach on the 18th of May,
2000, to correct a technical error in the legal description of the property known as the
Mandalay, reading as follows:
FROM:
Lots 95 and 96 and riparian thereto, of Tatum's Ocean Beach Park,
according to the plat thereof, recorded in Plat Book 50 Page 76.
TO:
The North 59 ft. of Lot 95 and the South 41 ft. of Lot 96, of Tatum's
Ocean Beach Park, according to the plat thereof, recorded in Plat Book 5
Page 35, all lying East of State Rd AlA (AKA Collins Avenue).
LEGAL:
The North 59 ft. of Lot 95 and the South 41 ft. of Lot 96, of Tatum's
Ocean Beach Park, according to the plat thereof, recorded in Plat Book 5
Page 35, all lying East of State Rd AlA (AKA Collins Avenue).
LOCATION:
16275 Avenue, Sunny Isles Beach, Fl. 33160

WHEREAS, on December 13, 2001, the City Commission conducted a public hearing
on the application submitted by Applicant; and
WHEREAS, the public hearing of the City Commission was advertised and held as
required by law and all interested parties concerned in the matter were heard, and upon due and
proper consideration having been given to the matter and to the positive recommendation of the
Zoning Director; and
WHEREAS, the City Commission has reviewed the application, and finds substantial
competent evidence to support a showing by the applicant that the variances maintain the basic
intent and purpose of the zoning, subdivision or other land use regulations, which is to protect
the general welfare of the public, particularly as it affects the stability and appearance of the
community and that the non-use variances will be otherwise compatible with the surrounding
land uses and would not be detrimental to the community;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
II. APPROVALS
The applicants request for a reformation of a prior resolution to correct an error in the legal
description is hereby approved without conditions as follows:
a. The City of Sunny Isles Beach is applying for a Reformation of Resolution 00-Z-48
passed and adopted by the City Commission of the Sunny Isles Beach on the 18th of
May, 2000, to correct a technical error in the legal description of the property known
as the Mandalay, reading as follows:
TO: The North 59 ft. of Lot 95 and the South 41 ft. of Lot 96, of Tatum's
Ocean Beach Park, according to the plat thereof, recorded in Plat Book 5
Page 35, all lying East of State Rd AlA (AKA Collins Avenue).
