RESOLUTION NO. 02-Z-70
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, WITHDRAWING WITHOUT
PREJUDICE ZONING APPLICATION OF WILLIAMS ISLAND
OCEAN CLUB, INC, Z2001-11 TO ALLOW THE APPLICANT TO
SUBMIT PLANS SHOWING THE REDESIGN OF THE PARKING
GARAGE, THE FA<;ADE OF THE BillLDING AND TO PROVIDE
A REVISED UNITY OF TITLE; PROVIDING FOR AN EFFECTIVE
DATE.
I. RECITALS.
WHEREAS, on May 14, 2002, the City Commission of the City of Sunny Isles Beach
conducted a public hearing on the application number 2001-11 submitted by Williams Island
Ocean Club, Inc., for the following,
1. Modification of Condition IB and IJ of Resolution OO-Z-46 passed and adopted by
the City Commission of the City of Sunny Isles Beach on the 13th day of April, 2000
reading as follows:

Zoning Department entitled "Williams Island Sunny Isle Condominium",
prepared by Robert M. Swedroe Architects - Planners dated stamped
received 3/20/2000 consisting of 26 sheets.
To:
Plans are on file and may be examined in the Zoning Department entitled
"Acqualina", prepared by Robert M. Swedrow Architects-Planners
consisting of Index of Drawing sheet, Site Plan, sheet A-I, A-2, A-3 dated
stamped received 11-26-01.

That the applicant provides a recordable Unity of Title between the
hotel/beach club parcel and the parking lot parcel to provide for a total of
617 parking spaces.

LEGAL:
Parcell: All of the portion of Tracts "A" & "B" of the subdivision of GULF STREAM PARK,
Plat Book 35, Page 51, and the portion of Collins Avenue shown of said Plat of GULF STEAM
PARK which was vacated by Plat of OCEAN BOULEVARD STATE ROAD 140 GOLDEN
BEACH SUNNY ISLES, Plat Book 44, Page 2, and above described property being contained in
the south 500' of Tract 5 of Subdivision of Government Lot 6, SectIon 2, TownshiI> 52 South,
Range 42 East, Government Lots 1,2, 4 and portions of Government Lots 5 & 6, -Section 11,
Township 52 South, Range 42 East, Plat Book 10, Page 64, more particularly described as
follows, to wit: That portIon of the north 200' of the South 500' of Tract 5 of Subdivision of
Government Lot 6, Section 2, TownshiI> 52 South, Ran~e 42 East and Government Lots 1,2,4
and portions of Government Lots 5 & 6, Section 11, Township 52 South, Range 42 East, Plat
BOOK 10, Page 64, measured at right angles to the South line of said Tract 5, lymg between the
East right-of-way line of State Road A-I-A, Plat Book 45, Page 39, and the high water line of the
AtlantIC Ocean, together with all of the Seller's interest and title in the riparian rights
appertaining.
Parcel 2: All of the portion of Tracts "A" and "B" of the subdivision of GULF STREAM
PARK, Plat Book 35, Page 51 and that portion of Collins Avenue shown on said plat of GULF
STREAM PARK which was vacated by Plat of OCEAN BOULEVARD STATE ROAD 140

line of State Road A-I-A, Plat Book 45, Page 39, and the high water line of the Atlantic Ocean,
together with all of the seller's interest and tItle in the riparian rights appertaining.

WHEREAS, the applicant, requested withdrawal without prejudice of the requested
item, and,
WHEREAS, a public hearing was advertised and held as required by law and all
interested parties concerned in the matter were heard; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
II. WITHDRAWAL
The request of the applicant to withdraw without prejudice application number Z2001-11 be
granted.
