HomeMy WebLinkAboutResolution Zoning 03-Z- 76 RESOLUTION NO. 03-Z::..J..b A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, DENYING THE ZONING APPLICATION SUBMITTED BY SERGY ZLOBINSKIY, (Z2002- 04), SUBJECT TO CERTAIN CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. I. RECITALS. WHEREAS, Sergy Zlobinskiy, submitted an application to the City of Sunny Isles Beach, Florida requesting the following: I. Variance of Setback to permit an existing residence to setback 15 ft. from the front (north) property line (25 ft. required). 2. Variance of Setback to permit an existing utility addition to the residence to setback 5.62 ft. from the interior (west) side property line (7.5 ft. required). LEGAL: Lots 6 Blk. 10 of Ocean Boulevard Estates Sec A, PB 48 Pg 39. ADDRESS: 322-189 Street And, WHEREAS, on August 28, 2003, the City Commission conducted a public hearing on the application submitted by applicant; and WHEREAS, the public hearing of the City Commission was advertised and held as required by law and all interested parties concerned in the matter were heard, and upon due and proper consideration given to the matter and to the positive recommendation of the joint memorandum from the Planning and Zoning Administrator and Planning Consultant; and WHEREAS, notice has been provided to all interested parties and a neighboring jurisdiction regarding the application. WHEREAS, the City Commission has reviewed the application, and finds no substantial competent evidence to support a showing by the applicant that the request for setback variances maintain the basic intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community. 03-Z-_ Sergy Zlobinskiy JLV/ed Rev.HO/jb 8/29/03 1 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: 1. The applicant's variance request 1 and 2 hereinabove are denied. 2. If any section, subsection, clause of provision of this Resolution is held invalid, the remainder shall not be affected by such invalidity. All Resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed. 3. This Resolution shall become effective upon adoption. PASSED and ADOPTED this '2~day of ~~ * 2003.
