A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING TO THE
CITY COMMISSION OF SUNNY ISLES BEACH, THE ORDINANCE
AMENDING THE CITY'S ADOPTED COMPREHENSIVE PLAN TO
PROVIDE FOR THE ST ATE MANDATED REQUIREMENTS FOR A
TEN-YEAR WATER SUPPLY FACILITIES WORK PLAN, BY
AMENDING THE INFRASTRUCTURE ELEMENT AND BY CREATING
WATER SUPPLY FACILITIES WORK PLAN SUB-ELEMENT,
ATTACHED HERETO AS EXHIBIT "A", AND THE REQUIRED
TRANSMITTAL TO THE STATE DEPARTMENT OF COMMUNITY
AFFAIRS PURSUANT TO CHAPTER 163.3191 OF THE FLORIDA
STATUTES; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach, Florida was incorporated on June 17, 1997;
and
WHEREAS, pursuant to the provisions of the Local Government Comprehensive Planning
and Land Development Regulation Act, on October 5, 2000, the City of Sunny Isles Beach
adopted its Comprehensive Plan; and
WHEREAS, the Department of Community Affairs has found the Sunny Isles Beach
Comprehensive Plan in compliance with the Local Government Comprehensive Planning and
Land Development Regulations Act; and
WHEREAS, Chapter 163, Sections 163.3184 and 163.3187, Florida Statutes, provides
procedures for amendments to adopted local comprehensive plans; and
WHEREAS, Section 265-8 of the City of Sunny Isles Beach Land Development (ode
provides for amendments to the City's Comprehensive Plan; and
WHEREAS, the City of Sunny Isles Beach proposed an amendment to provide for the
State mandated requirements for a Ten-Year Water Supply Facilities Work Plan by amending the
Infrastructure Element and by creating Water Supply Facilities Work Plan Sub-Element of the City
of Sunny Isles Beach Comprehensive Plan; and
WHEREAS, the City Commission serves as the Local Planning Agency ("LP A"), and
whereas the LP A is required to review amendments to the City's Comprehensive Plan; and
WHEREAS, on December 18, 2008, _ the City Commission reviewed the proposed
amendment, held an advertised public hearing, provided for participation by the public in the
process; and
WHEREAS, the LP A has determined that it is in the best interest of the City and its
residents to recommend approval of the proposed amendment to provide for the State mandated
requirements for a Ten-Year Water Supply Facilities Work Plan by amending the Infrastructure
LPA R2008- Transmittal ofComp Plan 10- Yr Water Supply Facilities Work Plan to DCA
Element and by creating Water Supply Facilities Work Plan Sub-Element of the City of Sunny Isles
Beach Comprehensive Plan, for transmittal to the State Department of Community Affairs.
NOW THEREFORE, BE IT RESOLVED BY THE LOCAL PLANNING AGENCY
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendments to the Comprehensive Plan. The Local Planning Agency
hereby approves the Plan Amendment to provide for the State mandated requirements for a Ten-
Year Water Supply Facilities Work Plan by amending the Infrastructure Element and by creating
Water Supply Facilities Work Plan Sub-Element of the City of Sunny Isles Beach Comprehensive
Plan, attached as Exhibit "A".
Section 2. Transmittal of Draft Comprehensive Plan. The Local Planning Agency hereby
recommends transmittal of the Plan Amendment to the City of Sunny Isles Beach Comprehensive
Plan to the State Department of Community Affairs.
Section 3.
Effective Date. This Resolution shall take effect immediately upon adoption.
