RESOLUTION NO. 98-35
RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AMENDING RESOLUTION NO. 97-16, TO
INCREASE THE PAY AND BENEFITS FOR THE CITY CLERK OF THE
CITY OF SUNNY ISLES BEACH ON TERMS AND CONDITIONS
NEGOTIA TED BY THE MAYOR.
WHEREAS, on November 20,1997, the City Commission ofthe CITY OF SUNNY ISLES
BEACH adopted Resolution No. 97-16, appointing Richard Brown-Morilla as the City Clerk on
terms and conditions negotiated by the Mayor; and
WHEREAS, the City Commission strives to provide terms and conditions of employment
that are competitive with other municipalities; and
WHEREAS, pursuant to the powers and duties vested in the Mayor and the City Commission
by 93.5 of the Charter of the City of Sunny Isles Beach,
NOW THEREFORE BE IT RESOLVED, BY THE MA YOR AND THE CITY
COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, that:
Section 1. Resolution No. 97-16 is amended to increase the annual rate of pay and benefits
for Richard Brown-Morilla, the City Clerk ofthe City of Sunny Isles Beach, Florida on the terms and
conditions negotiated by the Mayor and described in the attached letter as "Exhibit A-I" to this
resolution to be ratified by the Commission by virtue of the passage of this Resolution.
Section 2. This Resolution shall take effect immediately upon adoption.

Dear Mr. Brown
Subject to confirmation of the City Commission, it is a pleasure to address your employment agreement
regarding salary and benefit changes as follows: $50,000 annual rate of pay from March 1, 1998 through
September 30, 1998, lmd the salary rate from October 1, 1998 through September 30, 1999 will be
$53,000, The City will pay the premiums for your employee health, dental and $25,000 life insurance
policies The CIty will pay 10% above base salary into a 401 Plan, with 100% immediate vesting, You
will earn vacation at the rate of three weeks per year and sick time at 12 days annually (both retroactive
to 01/01/98) Currently Sunny Isles Beach is honoring all national holidays, A formal holiday schedule
WIll be established in the next 60 days (10 to 13 days per year as determined by the City Commission)
In accordance with the City Charter, you serve at the pleasure of1he City Commission, In the event the
City Commission wishes to terminate the City Clerk, it shall do so in accordance with Section 3,1 (b) of
the City Charter. In the event you are terminated other than for cause ("for cause" being defined as an act
of fraud, dishonesty or conviction of any criminal act, except for minor traffic infractions) you will receive
2 months severance pay,
Please be advised that the hiring agreement between you and 1he City dated November 6, 1997 is
superseded by any new terms set forth herein.
The City Manager and I are pleased at the adjustments the three of us have agreed upon!
