A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, IMPOSING AN ADMINISTRATIVE FEE TO
ALLOW FOR STRUCTURAL ENGINEERING REVIEW OF
BUILDING PLANS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE:.
WHEREAS, pursuant to Section 8.3 for the City Charter, the City has adopted the Code of
Metropolitan Dade County and by virtue of the Interlocal Agreement approved November 4, 1997,
by and between Dade County and the City of Sunny Isles Beach, the City has heretofore utilized the
services of Dade County Department of Planning, Development and Regulation to receive, review
and make recommendations on all zoning and planning applications and issue building permits; and
WHEREAS, on March 2, 1998, the City has created its own Building, Planning and Zoning
Department and shall accept all applications for zoning and permits; and
WHEREAS, the County requires that the official reviewing and approving building plans
must be a licensed structural engineer; and
WHEREAS, the effect of such changes to increase the cost of the permit process which said
costs must be borne by City's contractors and persons engaged in building activities;
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.
Structural Engineering Administrative Fees.
(A) In addition to the fee schedule as set forth by the Dade County Department of
Planning, Development and Regulation in effect as of June 3, 1997 and as adopted by
Section 8.3 of the City Charter of the City of Sunny Isles Beach, the City hereby
imposes a plan review fee ("structural engineering review fee") in the amount of the

actual costs of engmeenng serVIces to the City plus a seven ($7.00) dollar
administrative overhead charge to be passed through and imposed upon the contractor
or owner by the Building Planning and Zoning Department of the City of Sunny Isles
Beach in order to provide structural engineering review as mandated by the Miami
Dade County Code.
(B) This fee shall be paid by the contractor or owner to the City prior to the issuance of
a permit and shall, if not paid, constitute a lien upon the property for which a building
permit is sought.
(C) This fee shall be due and payable without regard to whether or not a permit is issued
by the department for the City.
Section 2.
Savings Clause. The structural engineering review fee provided by this
Resolution is in addition to, and shall not replace, any building permit and/or zoning and planning
application fees charged by the City.
Section 3.
Repeal of Conflicting Provisions. All provisions in conflict herewith are
hereby repealed.
Section 4.
Effective Date. This Resolution shall become effective immediately upon
adoption.

RECOMMENDATION
It is recommended that the City Commission approve a resolution granting the City Manager
the authority to impose an administrative fee for the structural review of building plans
submitted to the City in support of an application for a building permit.
REASONS
In 1994, Dade County imposed a requirement upon all municipalities mandating the use of
professional engineers as structural plans reviewers in all Building Departments. This forced
municipalities to either contract out these reviews or to hire in -house engineers. It is
anticipated that the volume of permits requiring the services of a P.E. will be minimal. It
therefore makes good sense for the City to outsource this service and "pay as we go." The City
would then simply pass through the cost of the review to the permit applicant plus a small
administrative fee to cover the costs involved in outsource communications.
The Commission should note that there is no other county in the State of Florida which
imposes such reviews upon its municipalities. Structural review is performed by either the
Building Official or the certified building plans examiner virtually everywhere else in Florida.
While there is no evidence to support the notion that a structural review by a P.E. has or will
improve the safety of structures, there is also no evidence to disprove the theory. In staff s
opinion, the additional cost involved should be passed on to the developer.
