HomeMy WebLinkAboutReso 99-143RESOLUTION NO. 99- 143 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PURSUANT TO SECTION 5.1 OF THE MUNICIPAL CHARTER, CALLING FOR A GENERAL ELECTION TO BE HELD ON TUESDAY, SEPTEMBER 14, 1999, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE OF THE CITY OF SUNNY ISLES BEACH THE NAMES OF ALL QUALIFIED CANDIDATES FOR ELECTION TO THE POSITION OF CITY COMMISSIONER, SEAT 01 (NORTHERN RESIDENTIAL AREA), AND OF CITY COMMISSIONER, SEAT 03 (SOUTHERN RESIDENTIAL AREA); PROVIDING FOR A RUN-OFF ELECTION, IF NECESSARY, TO BE HELD ON TUESDAY, OCTOBER 12, 1999; PROVIDING FOR CITY COMMISSION DESIGNATION OF TWO REGISTERED VOTERS WHO SHALL SERVE WITH THE CITY CLERK, CITY MANAGER, AND THE CITY ATTORNEY AS THE CANVASSING BOARD FOR SAID GENERAL ELECTION; PROVIDING FOR CONDUCTING THE ELECTIONS, VOTING PRECINCTS, VOTER REGISTRATION, NOTICE OF ELECTIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 5.1 of the Municipal Charter of the City of Sunny Isles Beach, provides: "A general election shall be held in each odd -numbered year, on the second Tuesday following the first Monday in September. A run-off election, if necessary, shall be held on the second Tuesday following the first Monday of October"; and WHEREAS, City Ordinance No. 99-65, provides for the City Commission to designate two registered voters who shall serve with the City Clerk, City Manager, and the City Attorney as the Canvassing Board. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Calling A General Election In accordance with the Municipal Charter of the City of Sunny Isles Beach, Florida, and the general laws of the State of Florida, a General Election is hereby called and directed to be held in the City of Sunny Isles Beach, Florida, from 7:00 a.m. to 7:00 p.m. on Tuesday, September 14, 1999, for the purpose of submitting to the electorate the names of all qualified candidates for election to the positions of City Commissioner, Seat 01 (northern residential area), and of City Commissioner, Seat 03 (southern residential area). R99- Calling General Election Page I Section 2. Calling A Run-off Election. If Necessary In accordance with the Municipal Charter of the City of Sunny Isles Beach, Florida, and the general laws of the State of Florida, a Run-off Election, if necessary, is hereby called and directed to be held in the City of Sunny Isles Beach, Florida, from 7:00 a.m. to 7:00 p.m. on Tuesday, October 12, 1999, for the purpose of submitting to the electorate of the City the question as set forth hereinafter. Section 3. Designation Of Two Registered Voters To Serve On The Canvassing Board That the City of Sunny Isles Beach Commission hereby designate: Mgmy Pine, and Norman Edelcuu , two registered voters, to serve with the City Clerk, City Manager, and the City Attorney as the City of Sunny Isles Beach's Canvassing Board for the September 14, 1999, General Election, and if necessary, the October 12, 1999 run-off election. Section 4. Conducting the Elections That the City Clerk is authorized to utilize the services of the Miami -Dade County Supervisor of Elections and his staff of officials for assistance in the conduct said General Election, and run-off Election, if necessary. The Miami -Dade County Election Officials shall furnish the official returns for each precinct to the City Clerk of the City of Sunny Isles Beach as soon as the ballots from all precincts have been tabulated, and the City of Sunny Isles Beach Canvassing Board's certification of the duly accepted results of said elections shall be accepted by the City Commission. Section 5. Voting Precincts That said voting precincts in the City of Sunny Isles Beach for said Special Election shall be as established by the proper and appropriate Miami -Dade County Supervisor of Elections and his staff of officials. All electors shall vote at the polling places and the voting precincts in which the OFFICIAL REGISTRATION BOOKS show that the said electors reside. A list of the voting precincts and the polling places therein (subject to change by the Miami -Dade County Supervisor of Elections, in accordance with the laws of Florida) is attached hereto as Exhibit A. Section 6. Voter Registration That registration of persons desiring to vote in said General Election, and if necessary, a run-off election, shall be in accordance with the general laws of the State of Florida governing voter registration. Qualified persons may obtain registration forms to vote at the Office of the City Clerk, City Hall, Suite 250, 17070 Collins Avenue, Sunny Isles Beach, Florida, 33160, Monday through R99- Calling General Election Page 2 Friday, except legal holidays, until August 16, 1999, between the hours of 9:00 a.m. and 5:00 p.m., and at such other voter registration centers and during such times as may be provided by the Miami - Dade County Supervisor of Elections; (and for a run-off election, if necessary, until September 13, 1999, between the hours of 9:00 a.m. and 5:00 p.m.). Each person desiring to become a registered voter shall be responsible for properly filling out the registration form and returning it to the Miami - Dade County Elections Office. All completed registration forms must be received by the Miami -Dade County Elections Office and clocked -in no later than August 16, 1999, at 5:00 p.m., for the General Election (and no later than September 13 , 1999, at 5:00 p.m. for a run-off election, if necessary) in order for a person to vote in said elections. Notice of Elections That not less than thirty days notice of said General Election shall be given by publication in a newspaper of general circulation in Sunny Isles Beach, Miami -Dade County, Florida. Such publication shall be made at least once each week for four consecutive weeks next preceding said Election. Section 9. Effective Date. This resolution shall become effective upon adoption. It is also recommended that the City Commission adopt the attached Resolution which provides for conducting a General Election on September 14, 1999, and if necessary, a run-off election of October 12, 1999. REASONS: This resolution provides the required details regarding the conduct of the upcoming general election, and if necessary, a run-off election. Pursuant to City Ordinance No. 99-65, the City Commission must designate the two registered voters to serve on the Canvassing Board of these specific elections. The two registered voters who would serve on the Canvassing Board should be willing to remain neutral during the upcoming campaign process.
