A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
RESOLUTIONS NO. 98-80 AND NO. 98-107, WHICH
ESTABLISHED THE CITIZENS' PLANNING ADVISORY
COMMITTEE, TO PROVIDE FOR THE CONTINUATION OF
EXISTENCE FOR ONE YEAR FROM THE ORIGINAL
CREATION AND EACH YEAR THEREAFTER AT THE
DISCRETION OF THE MAYOR; TO PROVIDE FOR THE
APPOINTMENT OF FIFTEEN MEMBERS TO THE
COMMITTEE AND THE APPOINTMENT OF THE CHAIR
AND VICE CHAIR; PROVIDING FOR ITS SPECIFIC
ADVISORY CAPACITY; RENDERING THE COMMITTEE
SUBJECT TO THE SUNSHINE LAWS; PROVIDING FOR
APPOINTMENTS AND REAPPOINTMENTS TO BE MADE
IN WRITING EFFECTIVE UPON THE ONE YEAR
EXPIRATION OF THE COMMITTEE FORMATION DATE
AND UPON SUBMISSION TO THE CITY CLERK OF
HIS/HER ACCEPTANCE AND FILING OF A FINANCIAL
DISCLOSURE FORM 1; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, by Resolution No. 98-80 adopted on August 13, 1998, the City Commission
of the City of Sunny Isles Beach established a Citizen's Planning Advisory Committee to encourage
greater citizen participation in governmental affairs and to work with the Commission to develop
information and recommendations in various areas which was subsequently amended by Resolution
98-107 to increase the number of committee members to twenty-one; and
WHEREAS, one year shall have lapsed on August 13, 1999, for the composition of the
Citizen's Planning Advisory Committee; and
WHEREAS, the Citizen's Planning Advisory Committee was advised, at the time of its
composition, that the Committee would sunset in the Spring and, therefore, Resolution No. 98-80
must be revised to provide for appointment or re -appointment of the members and the chair and vice -
chair; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. A Citizen's Planning Advisory Committee shall be reconstituted and shall continue
to exist for one year from the date of the adoption of this Resolution and may be renewed upon the
expiration of one year from the original creation and each year thereafter at the discretion of the
Citizen's Planning Advisory Res. 98-80 Amendment -1-
Mayor. The membership to be appointed as follows:
a. Each Commissioner shall appoint three members for the composition of a fifteen (15)
member Citizen's Planning Advisory Committee. Each Commissioner may re-
appoint current members or appoint new members as they deem fit. The names shall
be submitted to the City Clerk within fourteen (14) days from the date of this
Resolution and the committee shall be constituted no later than August 13,1999.
b. In accordance with Section 2.2 of the Charter of the City of Sunny Isles Beach the
Mayor shall appoint both the chair and vice -chair of the committee.
Section 2. The powers and duties of this committee shall be solely of an advisory nature and the
purview of its lay recommendations shall include:
a. Recommendations relative to the preparation of the City's Comprehensive
Plan and subsequent land development regulations during the Comprehensive
Planning Process.
b. Recommendations relative to the economic development and redevelopment
policies as they may relate to the Comprehensive Plan.
C. Recommendations and monitoring of proposed Local, State and Federal
Laws and trends in governments as they should be known to the City of
Sunny Isles. Beach.
Section 3. This Committee shall be subject to the Sunshine Laws and, as such shall maintain
minutes of all meetings and give proper notice as to meeting times and dates. Meetings shall be
called at such times and at such dates as the Chair shall determine. In no event shall such meetings
be held simultaneously when the Commission is sitting as the Local Planning Agency during the
Comprehensive Planning Process. The City Attorney may conduct a workshop to educate all
members regarding public records, sunshine laws and rules of procedure as adopted by the
Commission prior to the convening of the Committee.
Section 4. The appointments once made in writing in accordance with Section 1 hereinabove
shall become effective immediately upon the filing with the Clerk of the City his/her acceptance and
filing of a financial disclosure (Form 1-Statement of Financial Interest-1998) as required by law.

Section 5. The provisions of this Resolution authorizing recreation of this committee on the
foregoing terms and conditions shall become effective immediately upon adoption.

107 REGARDING THE CITIZEN'S PLANNING ADVISORY
COMMITTEE.
RECOMMENDATION
It is recommended that the City Commission adopt this resolution amendment on
the Citizen's Planning Advisory Committee.
REASONS
Last year on August 13,1998, this Commission created a Citizen's Planning
Advisory Committee and submitted names to the Mayor for constitution of the
Committee. At that time, it was advised that the Committee would sunset in the
Spring. However, as the Comprehensive Plan continues to be developed and as
issues relative to economic development and re -development are being raised on
a continuing basis, and at the request of Commissioner Iglesias, I have revised
Resolutions No. 98-80 and No. 98-107 to provide for the recreation of a fifteen
member committee with one-year terms for the members of the Committee; to
allow each Commissioner to appoint three members for the Committee which may
include re -appointments of current Committee members or a selection of new
members, as each Commissioner may deem fit.

The Committee's function will continue to be threefold; (1) to serve as the lay
recommending body relative to the preparation of the City's Comprehensive Plan,
its land development regulations; (2) to be responsible for following State, Local
and Federal government trends in which the City of Sunny Isles Beach may be
interested; and (3) to address issues relating to economic development and re-
development as they relate to the Comprehensive Plan.
The Committee's existence shall be for a period of one additional year from August
13, 1999 and each year thereafter at the discretion of the Mayor. The Committee
shall be governed by the same rules of procedure as adopted by this Commission
and shall continue to be governed by the Sunshine laws and each member shall be
required to file with the Clerk, as indication of his/her acceptance of the position,
a Form 1- Statement of Financial Interest-1998.
