A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AWARDING BID NO. 99-07-01 TO TROPIC
LANDSCAPING, INC., IN THE AMOUNT OF $136,676.50, FOR
LANDSCAPING THE PERIMETER OF THE 2.84 ACRE PARK
AT NORTH BAY ROAD; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE THE
CONTRACT ATTACHED AS EXHIBIT "A"; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach issued a Request For Proposals, No. 99-07-01, for
landscaping services for the perimeter of the 2.84 acre park at North Bay Road; and
WHEREAS, proposals were received by the due date of July 28,1999, and reviewed by the City
Manager and the Public Works Superintendent; and
WHEREAS, Rosenberg Design Group Inc., the City's Independent Landscape Architect
recommended the low bid;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Bid No. 99-07-01, is hereby awarded to the firm of the Tropic Landscaping, Inc.,
in the amount of $136,676.50, for landscaping the perimeter of the 2.84 acre park at
North Bay Road.
Section 2. The City Manager is hereby authorized to execute the Contract attached hereto as Exhibit
«A "
Section 3. The Resolution shall take effect immediately upon adoption.

CONTRACT
THIS CONTRACT made and entered into on the 6 day of August, A. D., 1999, by and between
the City of Sunny Isles Beach, Florida, the first party, and Tropic Landscaping and Lawn Maintenance,
INC., the second party.
WITNESSETH: That the second party, for the consideration hereinafter fully set out, hereby
agrees with the first party as follows:
1. That the second party shall finnish all materials, equipment, machinery, tools, apparatus,
means of transportation, and labor necessary to perform the following work in accordance with
the Plans and Specifications therefore, the Instructions to Bidder and the Proposal, all of which are
hereby a part hereof by reference as is fully set forth herein, at the following described location.

2. That the second party shall commence and complete the work to be performed under this
contract as set forth in the Proposal.
3. The first party hereby agrees to make payment to the second party for the faithful
performance of this contract, subject to additions and deductions as provided in the Plans and
Specifications or Proposal, by cash, as follows:
a. The first party shall make partial payments to the second party within 30 days of
receipt of an estimate duly certified and approved by the City Manager, of work performed during
the preceding calendar month by the second party, less ten percent (10%) of the amount of such
estimate which is to be retained by the first party until all work has been performed strictly in
accordance with this contract and until such work has been accepted by the first party.
b. Upon submission by the second party of evidence satisfactory to the first party that
all payrolls, material bills and other costs incurred by the second party in connection with the
construction of the work have been paid in full, final payment on the account of this contract shall
be made within thirty (30) days after the completion by the second party of all work covered by
this contract and the acceptance of such work by the first party.

IN WITNESS WHEREOF, the parties hereto have executed this contract on the day and date first
above written in four (4) counterparts, each of which shall, without proof or accounting for the other
counterpart, be deemed an original contract.

The provisions and limitations of Section 255.50 or Section 713.23, Florida Statutes, whichever is applicable to

Dear Mr. Arazoza:
This is to confirm that the City Commission has authorized the bid award to you, as low
bidder, for the Collins Avenue landscaping improvements, located generally between 16r
Street and Bay View Drive, in the amount of $309,752.25. The execution of the contract
by the City is being delayed while the State ofFlorida completes a joint project agreement,
relating to Collins Avenue safety with the City of Sunny Isles Beach. This agreement will
result in a portion of the S309,752.25 project being refunded by the State to the Ci
Accordingly, I anticipate the following schedule.
A The State is to forward an agreement to the City within two weeks, with
a Special City Commission Meeting to be called to sign the contract
within one week thereafter.
B. Obtaining of State of Florida signature for joint project agreement by
September 30, i'99.
C. Requesting you (as contractor) to commence the project on October 1,
1999 and completing in a timely fashion as called for in the agreement.
Accordingly, I would appreciate it if you would meet with the City architect, Bill
Rosenberg, and ensure that all the necessary contracts have been prepared and readied
for signature on short notice.
