RESOLUTION NO. 99-J 53
A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AWARDING BID NO. 99-07-02 TO AROZOZA
BROTHERS CORPORATION, IN THE AMOUNT OF
$309,752.25, FOR LANDSCAPING THE COLLINS AVENUE
CENTER MEDIANS FROM THE NEWPORT SOUTH TO THE
CITY LINE; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE THE CONTRACT ATTACHED
AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach issued a Request For Proposals, No. 99-07-02, for
landscaping the Collins Avenue center medians from Newport south to the City line; and
WHEREAS, proposals were received by the due date of August 5, 1999, and reviewed by the
City Manager and the Public Works Superintendent; and
WHEREAS, Rosenberg Design Group Inc., the City's Independent Landscape Architect
recommended the low bid;
NOW THEREFORE, BE ITRESOL VED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.
That Bid No. 99-07-02, is hereby awarded to the firm of the Arozoza Brothers
Corporation, in the amount of$309, 7 52.25, for landscaping the Collins Avenue center
medians from the Newport south to the City line.
Section 2.
The City Manager is hereby authorized to execute the Contract attached hereto as Exhibit
"A."
Section 3.
The Resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED this 6th day of August, 1999.

CONTRACT
THIS CONTRACT made and entered into on the 6th day of August, 1999, A.D., by and between
the CITY OF SUNNY ISLES BEACH, FLORIDA, the first party, and AROZOZA BROTHERS
CORPORATION, the second party.
WITNESSETH: That the second party, for the consideration hereinafter fully set out, hereby
agrees with the first party as follows:
1. That the second party shall furnish all materials, equipment, machinery, tools, apparatus,
means of transportation, and labor necessary to perform the following work in accordance with
the Plans and Specifications therefore, the Instructions to Bidder and the Proposal, all of which are
hereby a part hereof by reference as is fully set forth herein, at the following described location.

SUNNY ISLES BEACH, FLORIDA
2. That the second party shall commence and complete the work to be performed under this
contract as set forth in the Proposal.
3. The first party hereby agrees to make payment to the second party for the faithful
performance of this contract, subject to additions and deductions as provided in the Plans and
Specifications or Proposal, by cash, as follows:
a. The first party shall make partial payments to the second party within 30 days of
receipt of an estimate duly certified and approved by the City Manager, of work performed during
the preceding calendar month by the second party, less ten percent (10%) of the amount of such
estimate which is to be retained by the first party until all work has been performed strictly in
accordance with this contract and until such work has been accepted by the first party.
b. Upon submission by the second party of evidence satisfactory to the first party that
all payrolls, material bills and other costs incurred by the second party in connection with the
construction of the work have been paid in full, final payment on the account of this contract shall
be made within thirty (30) days after the completion by the second party of all work covered by
this contract and the acceptance of such work by the first party.

IN WITNESS WHEREOF, the parties hereto have executed this contract on the day and date first
above written in four (4) counterparts, each of which shall, without proof or accounting for the other
counterpart, be deemed an original contract.
