A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AWARDING BID NO. 99-08-01 TO RECIO &
ASSOCIATES, IN THE AMOUNT OF $260,785.75, FOR
BEAUTIFICATION OF S.R. AlA, SOUTH OF WILLIAM
LEHMAN CAUSEWAY; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE THE
CONTRACT ATTACHED AS EXHIBIT "A"; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach issued a Request For Proposals, No. 99-08-01, for
beautification of S.R. AlA, south of William Lehman Causeway; and
WHEREAS, proposals were received by the due date of September 9,1999, and reviewed by
the Finance Director, Accountant and the Executive Secretary; and
WHEREAS, Rosenberg Design Group Inc., the City's Independent Landscape Architect
recommended the low bid;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Bid No. 99-08-01, is hereby awarded to the firm of the Recio & Associates, Inc.,
in the amount of $260,785.75, for beautification of S.R. Al A, south of William Lehman
Causeway.
Section 2. The City Manager is hereby authorized to execute the Contract attached hereto as Exhibit
«A "
Section 3. The Resolution shall take effect immediately upon adoption.

The Contract will be awarded on the basis of the TOTAL BID AMOUNT.

The City reserves the right to increase, decrease or delete any item of the work. The following unit
prices shall be utilized as the basis of computation for any increases, decreases or deletions to any item
of the work.
The Bidder hereby acknowledges receipt of the following addenda:

It is mutually agreed that time is of the essence of this contract and should the Contractor fail to
complete the work within the specified time there shall be deducted from the compensation due the
Contractor the amount of three hundred dollars ($300.00) per calendar day as fixed, agreed as
liquidated damages for each calendar day elapsing, beyond the specified time for completion or any
authorized extension thereof. It is further agreed that said sum is not a penalty but is the stipulated
amount of damages sustained by the City. The City may deduct such amount of assessed liquidated
damages from Contractor's Progress Payments at the sole discretion of the City.
AWARD OF CONTRACT AND TIME OF COMPLETION
The contract, if awarded, shall be to the lowest responsive, and most responsible bidder whose bid
conforming to the specifications is the most advantageous to the City, considering prices bid, the
experience, the qualifications of the bidder, and the bidders current and immediately available
resources. The Bid Proposal must comply with the re uirements necessary to render it formal.

The WORK will be entirely completed within ccessive days from the commencement date stated
in the Notice to Proceed.
The Bidder understands and agrees that the Total Bid Amount is inclusive of all work and materials
necessary to complete the project as described in the Contract Documents.

CONTRACT
THIS CONTRACT made and entered into on the day of A.
D., 19 , by and between the City of Sunny Isles Beach, Florida, the first party, and Recio &
Associates Inc., the second party.
WITNESSETH: That the second party, for the consideration hereinafter fully set out, hereby
agrees with the first party as follows:
1. That the second party shall furnish all materials, equipment, machinery, tools, apparatus,
means of transportation, and labor necessary to perform the following work in accordance with
the Plans and Specifications therefore, the Instructions to Bidder and the Proposal, all of which are
hereby a part hereof by reference as is fully set forth herein, at the following described location.

SUNNY ISLES BEACH, FLORIDA
2. That the second party shall commence and complete the work to be performed under this contract
as set forth in the Proposal. The WORK will be entirely completed within 60 successive days
from the commencement date stated in the Notice to Proceed. The bid amount is $260,785.75.
3. The first party hereby agrees to make payment to the second party for the faithful
performance of this contract, subject to additions and deductions as provided in the Plans and
Specifications or Proposal, by cash, as follows:
a. The first party shall make partial payments to the second party within 30 days of
receipt of an estimate duly certified and approved by the City Manager, of work performed during
the preceding calendar month by the second party, less ten percent (10%) of the amount of such
estimate which is to be retained by the first party until all work has been performed strictly in
accordance with this contract and until such work has been accepted by the first party.
b. Upon submission by the second party of evidence satisfactory to the first party that
all payrolls, material bills and other costs incurred by the second party in connection with the
construction of the work have been paid in full, final payment on the account of this contract shall
be made within thirty (30) days after the completion by the second party of all work covered by
this contract and the acceptance of such work by the first party.

counterpart, be deemed an original contract.
