A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE FINAL REPLAT
OF LOTS 4, 5, 6 & 7 OF BLOCK 1, SUNNY ISLES SHORES SECTION A,
PLAT BOOK 53 AT PAGE 95, LYING IN SECTION 11, TOWNSHIP 52
SOUTH, RANGE 42 EAST, LOCATED AT NORTH BAY ROAD,
BETWEEN 180 DRIVE AND 182ND DRIVE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Marina Bay Club, Inc., a Florida corporation, has secured a tentative plat of
the Marina Bay Club in order to vacate certain easements to allow the property owner to utilize
its property; and
WHEREAS, Lauris Boulanger, president of Marina Bay Club, Inc., now presents to this
Commission in accordance with Section 28-8 of the Code of Miami -Dade County and Section
177.071, F.S. (1977) a final replat of certain lands lying in the City of Sunny Isles Beach, said
plat to be known as the Marina Bay Club, the same being a replat of lots 4, 5, 6 & 7 of Block 1,
Sunny Isles Shores, Section A, as recorded in Plat Book 53, at Page 95 of the Public Records of
Miami -Dade County, Florida, located between 180'h Drive and 182nd Drive west of North Bay
Road; and
WHEREAS, it appears that all requirements of the law concerning said plat insofar as
the authority of this Commission is concerned, have been complied with;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS:
Section 1. Final Plat Approved. This final replat is hereby approved. A dedication of
streets, alleys and other rights of way however designated or depicted on said plat is hereby
accepted; that any easements to be vacated are hereby so vacated; that plat restrictions as may be
listed on the plat are approved and are to be enforced; that the approval of the plat is not a waiver
of any zoning regulations and that this approval is conditioned upon proper execution of all
documents required by the City Attorney's office.
Section 2. Effective Date. This Resolution shall become effective upon adoption.

RESOLUTION APPROVING FINAL PLAT OF MARINA BAY
CLUB

RECOMMENDATION:
It is recommended that the City Commission approve the attached Resolution
approving the final plat of Marina Bay Club.
REASON:
On September 17, 1998 and November 12, 1998, by Resolution Nos. 98-Z-20 and
98-Z-26, the Commission approved Marina Bay Club's request for Modification of
Conditions and Non Use Variance. In order to vacate some easements and to dedicate
such roads and drives as shown on the attached plat, together with all existing and
future planting, trees, shrubbery and fire hydrants, dedication of perpetual use of the
public for proper purposes and ensuring that all new electric and communication
lines, except transmission lines within this subdivision shall be installed
underground, with a plat restriction of a 10' utility easement as indicated being
reserved for the installation and maintenance of public utilities and a 10' drainage
utility easement as indicated on the attached plat, being reserved for the installation
and maintenance of drainage as a public utility.
Since it appears that all requirements of law concerning the plat have been met, the
last step of this process is for the municipality of the City of Sunny Isles Beach to
approve the final plat. By your resolution, that action will be so taken.
