HomeMy WebLinkAboutReso 99-163RESOLUTION NO.99-1(50-3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE STATE OF FLORIDA DEPARTMENT OF MANAGEMENT SERVICES TO NEGOTIATE AN AGREEMENT FOR SERVICES WITH JAMES A. CUMMINGS, INC., OF FT. LAUDERDALE, FLORIDA AS THE CONSTRUCTION MANAGER -AT -RISK; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on August 19th, a selection committee appointed by the City Manager, selected and ranked James A. Cummings, Inc., as the top candidate for the position of construction manager -at -risk for the Government Center Project; and WHEREAS, upon ratification of this selection by the Commission, the Department of Management Services shall enter into negotiations with the construction manager so selected; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: 1. The Department of Management Services, State of Florida is hereby authorized to negotiate a construction manager -at -risk agreement with James A. Cummings, Inc., of Ft. Lauderdale, Florida, based on their selection by the committee as the most responsible, responsive bidder. 2. The City Manager is hereby authorized to take whatever action that may be necessary or required by the Department of Management Services to assist it in negotiating such agreement, which agreement shall be brought before the City Commission for ratification. 3. Cummings, Inc. as general contractor at risk for construction of the Government Complex. REASONS On August 19, 1999, a selection committee composed of staff from the Florida Department of Management Services and Sunny Isles Beach interviewed nine (9) prospective construction companies. The selection committee ranked the following as the top three candidates. 1 James A. Cummings, Inc. 2. Centex -Rooney Construction Company 3. Metric Constructors The top three companies were invited to make presentations before the City Commission. However, the companies ranked two and three declined. Therefore, number one, James A. Cummings, Inc. is being recommended. Cummings, Inc. of Fort Lauderdale, Florida. The selections were conducted according to Department of Management Services rule, pursuant to Chapter 60D-5.008 which authorizes Building Construction to select and enter into a contract with James A. Cummings, Inc. James A. Cummings, Inc. was selected over the three other short-listed contractors for the following reasons. The team had completed a similar project for the Town of Davie, with Spillis Candela A/E and DMS managed. The team that would work on the project communicated well with each other, which gave the committee a sense of confidence. The Cummings team showed how they worked together with Spillis Candela on the Town of Davie and on other similar projects such as Adventura, a similar project which was on schedule and in budget. Their approach to cost control was "real market pricing" which takes the pricing to the streets and tells what construction cost are today and not historic data which is just that.
