A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, GRANTING JACK NEUSTADT, AS INTERIM
CITY MANAGER, A CAR ALLOWANCE IN THE AMOUNT
OF $500 MONTHLY AND HEALTH INSURANCE
ALLOWANCE IN THE AMOUNT OF $418.98 MONTHLY AND
FURTHER GRANTING JACK NEUSTADT THE ABILITY TO
RETURN TO HIS FORMER POSITION AS DIRECTOR OF
FINANCE AT SUCH TIME AS A PERMANENT CITY
MANAGER IS APPOINTED; PROVING FOR AN EFFECTIVE
DATE.
WHEREAS, on September 17th at a public hearing the City Commission voted to install
Jack Neustadt as Interim City Manager, with an increase of his salary at 25% above the proposed
salary budget in the new budget from his position of Director of Finance; and
WHEREAS, while other benefits have been established by budget, the issues of car
allowance and health insurance and the oral representation upon his employment as Interim
Manager that Jack Neustadt will be permitted to return to his position of Director of Finance
upon the appointment of a permanent City Manager have not been reduced to writing;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Benefits and Assurances. The City Commission hereby agrees to grant to Jack
Neustadt, during his term as Interim City Manager the following items:
a. Car Allowance in the amount of $500 monthly
b. Health Insurance Benefits in the amount of $418.98 monthly
c. That Jack Neustadt be permitted to return to his position as Director of Finance when
he resigns from his position as Interim City Manager.
Section 2. Effective Date. This Resolution shall become effective upon adoption.

In the recent summary of activities from September 17 to October 1.1999, presented to
the Mayor and Commission on October 4,1999, it was pointed out that the City Charter
provides for the City Commission to determine the salary and benefits of the City
Manager. At the public hearing on the budget held on September 17, 1999. the City
Commission established the salary of the Interim City Manager. While the Fiscal Year
2000 Budget adopted at that time provides for benefits of the City Manager, those were
established by the contract of the previous City Manager. Therefore, the benefits to be
provided currently are to be determined by the City Commission. The benefits to be
determined are health insurance and car allowance, which vary from other benefits that are
standard for all management employees.
Attached for the consideration of the City Commission in determining the benefits to be
provided to the Interim City Manager are the existing benefits for management employees
as to health insurance and car allowances.
You will note in the attached schedule the many inconsistencies «Zthin the budget, which
inconsistencies the Commission, on August 17' authorized me to address (I propose to
address them as of October 1 st.) In the interim, however, please advise as to the figure I
should use for myself.

MEDICAL AND DENTAL INSURANCE:
The City shall provide medical and dental coverage in the amount provided fnr all
department hads together with life insurance policy equal to the salary amount.
Medical and dental coverage shall be effective as of hire date or City will pay
COBRA until effective date.
VACATIONS, SICK LEAVE, AND HOLIDAYS:
The Director shall be entiticd to three (3) weeks vacation of which one (1) v.eek
can be converted to cash allowance. In addition, the Director shall be entitled to
twelve (12) days sick leave, five (5) of which may be converted to cash. The
Director shall be entitled to such holidays as may be provided for all City
employees.
PROFESSIONAL DEVELOPMENT:
Subject to City policy, the City shall agree to pay reasonable professional dues
and subscriptions necessary for the continuation of the education of the Director
and, specifically, shall pay for the Urban Land Institute Certification Program,
including tuition and expenses to complete the program.
TERMINATION:
In the event you are asked to leave the City for reasons other than "cause"
(defined as, an act of fraud, dishonesty or conviction of any criminal act, except
for minor traffic violations), the City will pay severance pay in an amount no less
than three (3) month salary, plus pay ;r.y. accrued vacati.on. benefits (up to 300
hours) and any unused sick time benefits (up to 300 hours).
In the event of voluntary resignation, there will be no three months severance pay,
but the vacation and sick time payments will remain.
If the foregoing accurately represents your agreed upon negotiations with the
Manager, please indicate so by executing the acknowledgement set forth below.
Finally, on behalf of the City, we wish to express our excitement at the prospect
