HomeMy WebLinkAboutReso 99-175RESOLUTION NO.99- 1jS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EMPLOY KPMG PEAT MARWICK TO DO AN ANALYSIS ON THE COSTS ASSOCIATED WITH THE INSPECTION ENFORCEMENT PROVISIONS OF FLORIDA STATUTE SECTION 125.56 AND THE BUILDING CODE ADOPTED BY MIAMI-DADE COUNTY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Associated Builders and Contractors, Inc., as a trade association and national advocacy coalition have been asked to asses local government compliance with Section 125.56(2) and 166.222, Florida Statutes; and WHEREAS, the Attorney General Opinion 89-28 advises that "inspection fees collected pursuant to Section 125.56 Florida Statutes may only be used to defray the costs of inspection and enforcement of the provisions of Section 125.56 and the building code adopted by the County pursuant to that section;" and WHEREAS, the City Manager wishes to establish that the City of Sunny Isles Beach has complied with State law; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: 1. Employment of KPMG Peat Marwick. The City Manager is hereby authorized to employ KPMG Peat Marwick to do an analysis on the costs associated with the inspection enforcement provisions of Florida Statutes Section 125.56 and the building code adopted by Miami -Dade County. 2. REASONS I believe it is prudent for the City to have this study done at this time, since we have received notification from the Association of Builders and Contractors that State Statutes require that building fees be in line with the costs of the Building Department. Since the operation cost of the Building Department encompasses not only the salaries of the employees ofthe department, but also all of the associated support costs, I feel that it is appropriate to engage this firm to do this study at time. KPMG LLP (KPMG) is pleased to submit this Engagement letter to the City of Sunny Isles Beach (the City) to provide professional consulting services for the development and preparation of a Full Cost Allocation Plan. The plan will utilize fiscal year's 1999 actual costs, and will be prepared in accordance with Federal Circular A-87, Cost Principles for State and Local Governments. We estimate that an elapsed calendar time of sixty days from the date of commencement would be required to develop and prepare the cost allocation plan, with commencement occurring within two weeks from the notice of contract award. This time frame, of course, is dependent upon the timeliness of requested information furnished by the City. The City will be responsible for the collection of all statistical information used as allocation bases. Our fees for professional services are based on the time and staffing requirements of the engagement, and include all expenses incurred by us. Our total contract costs to perform the professional consulting services will not exceed $10,000. The engagement fee will be billed to the City as follows: 50% of the fee thirty days after the initial fieldwork date. 25% upon delivery of the draft report, and 25% upon delivery of the final report. This engagement will be managed and staffed by Ken Carey, with additional assistance provided by Heidi Powell. Both Heidi and Ken are experienced cost allocation consultants.
