A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING
THE STAFF'S DECISION TO TERMINATE WALTER H.
KELLER & ASSOCIATES, INC., AND DIRECTING THE
CITY MANAGER, ON AN EMERGENCY BASIS, TO
RETAIN THE FIRM OF JACK LUFf CONSULTING. INC.,
AS CERTIFIED PLANNERS, TO PREPARE THE
COMPREHENSIVE PLAN FOR THE CITY OF SUNNY
ISLES BEACH, AND WAIVING ALL BIDDING
REQUIREMENTS OF ORDINANCE NO. 97-10; FURTHER
DIRECTING THE CITY MANAGER TO RETURN TO THE
CITY COMMISSION A CONTRACT ON THIS MATTER
FOR COMMISSION APPROVAL AND TO TAKE ALL
SUCH FURTHER ACTION NECESSARY TO
EFFECTUATE THE INTENT OF THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on or about July 22, 1998 in accordance with Resolution 98-61, the then
City Manager, James DiPietro, retained the firm of Walter H. Keller & Associates, Inc. in joint
venture with Beiswenger, Hock & Associates, Inc, (hereafter referred to as "Walter H. Keller &
Associates, Inc.") to serve as the city's comprehensive plan consultant and to prepare the City's
Comprehensive Plan (the "Plan") which is due in June, 2000 in accordance with F.S. 9163.3167
(4)(1999); and
WHEREAS, Walter H. Keller & Associates, Inc., failed to produce a first draft of that
Plan in a timely manner and when the first draft of the Plan was finally delivered one week prior
to the scheduled LP A meeting, it was extremely deficient, among many other problems, causing
City Staff to believe the consultant had breached its contractual duties to the City; and
WHEREAS, the City Staff, as a result of its conclusion, terminated the services of
Walter H. Keller & Associates, Inc., and is now recommending the services of LUFT
CONSULTING. INe., to be retained, on an emergency basis, in order to meet the deadline of the
State Department of Community Affairs for the production of the City's Comprehensive Plan,
pursuant to Florida Statutes 9163.3167(4)(1999);
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES AS FOLLOWS:
1. Ratification of Termination and Authorization of City Manager to Retain New
Planning Consultants. The termination of the services of Walter H. Keller &
Associates, Inc., is hereby ratified, and the City Manager is hereby directed, on an
emergency basis, to retain the firm of LUFT CONSULTING. INC., as certified
planners, to prepare the comprehensive plan for the City Of Sunny Isles Beach, and
Termination of City Planner Res.

hereby waives, by unanimous vote, all bidding requirements of Ordinance No. 97-10,
finding it impractical to comply under the circumstances.
2. Contract Approval. The City Manager is further directed to return to the City
Commission, for approval, a contract on this matter and to take all such further action
necessary to effectuate the content of this Resolution.
3. Effective Date. This Resolution becomes effective upon adoption.

Re: Comprehensive Plan Scope of Services
Dear Ms. Dumas,
In response to your phone message of February 7th. I am
hereby submitting the requested proposal for a scope of
services to complete the Comprehensive Plan for the City
of Sunny Isles Beach.
Thank you for this opportunity to provide comprehensive
planning services to your community. I have been a
professional in the planning field for thirty two years and
have extensive experience in comprehensive master plan
preparations. From 1965 to 1969 I worked as a senior
planner with Howard Needles Tammen & Bergendoff in
their Kansas City headquarters office and authored master
plans for several communities in Kansas, and Missouri. In
1970 I joined the City of Miami Planning Department and
served as a senior planner for twenty years during which I
authored the Master Plan for Coconut Grove, was lead
planner for the 1978 City-wide Comprehensive
Development Master Plan, prepared the master
development plans for Virginia Key, Watson Island and
Dinner Key. In 1989 I was the Planner in charge and
principle author for the Downtown Miami Master Plan.
Since establishing my independent practice in 1998 I have
written the Town Center development Master Plan for the
City of Coral Springs Florida and served as planning
advisor for master plan updates in Surfside.
The Chesapeake Group (TCG) will be assisting us with this effort.
In several capacities (as planner, Planning Director for the City
of Miami and in private practice) I have known lCG and its

president - Howard Kohn - for more than twenty-five years.

rCG is currently under contract to Sunny Isles Beach, assisting
with economic development efforts. Most importantly, TCG
and its President have many years of experience providing
comprehensive planning services. They have been involved
with or have acted as the lead consultant for comprehensive
planning efforts in numerous communities throughout Florida
and the entire country. These include efforts in the past few
years in waterfront communities such as Racine, Wisconsin;
Cambridge, Maryland; Muskegon, Michigan; Fort Walton
Beach, Florida; Baltimore, Maryland; and Willoughby, Ohio.
Most importantly, they have significant experience with
community input and visioning processes, having provided such
services directly to communities as well as through the Enterprise
Foundation, C. Stewart Mott Foundation, the National Center
for Urban Ethnic Affairs, and the Ford Foundation.
Also assisting us will be Mark Alvarez, President of North
Meridian, Inc. who has nine years of professional planning
experience as a transportation planner. Mr. Alvarez has years
of experience in Florida with concurrency analysis,
transportation plans to support redevelopment, transit, and
transportation impact analysis. Specifically, has written the
transportation elements of the Comprehensive Plans for the
cities of Hialeah and Plantation, Florida, and he played a
critical role in the development of the Concurrency
Management System (CMS) for the City of Miami Beach,
Florida. While at the South Florida Regional Planning Council,
he reviewed comprehensive plan amendments for several local
governments in the three-county region.
The attached Scope of Services and fee structure will provide
for completion of the Comprehensive Plan.

WORK PROGRAM
COMPREHENSIVE PLAN & LAND DEVELOPMENT REGULATIONS
Work program premised upon review of what services were previously provided.
Phase I - (6 month TImeframe)
Task 3 Community Visioning Process - Public Participation Process (Task
Budget - $18,000.00)
The Consultant will conduct one-on-one interviews with selected key
property owners, residential interest leadership, and elected officials. A
maximum of 40 interviews will take place.
The Consultant in conjunction with the City, will conduct a community
visioning charrette to formulate a set of strategic goals and objectives for the
work program. During the charrette, the consulting team will present
different components of the community profile.
The objective of the visioning process will be to determine the City's overall
objectives and priorities for its comprehensive planning and development
regulation programs. As objectives and priorities are identified, they will be
recorded by the Consultant for possible inclusion in the City's goals,
objectives and policies. The City will be responsible for all meeting logistics
and turnout.
Task 4
Preparation of the Comprehensive Plan Elements (Task Budget -
$25,000.00)
The Consultant will prepare the Comprehensive Plan Elements in
accordance with all applicable State, regional, county and local
requirements, and in accordance with the City's objectives and priorities
identified during the community visioning process. The required and
proposed elements and components of the Comprehensive Plan include:

Drainage, Portable
Water and Natural Groundwater Aquifer Recharge
Element)
Conservation Element
Recreation and Open Space Element

Capital Improvements Element
Each element will contain goals, objectives and policies as discussed in Task
3. Additionally, the support document of the Comprehensive Plan will
contain data and analysis for each of the individual elements collected
during Task 2.
Task 5
Presentation & Revision of the Comprehensive Plan Work Products
(Task Budget - $8,000.00)
The Consultant will present the draft Comprehensive Plan work products to
the City administration for review, comment and correction. The Consultant
will then incorporate the comments and corrections requested prior to the
public workshop draft of the Comprehensive Plan.
The revised draft of the Comprehensive Plan will be presented by the
consultant at a public workshop before the City Commission who has been
designated as the Local Planning Agency (LPA). The consultant will
incorporate the revisions requested by the City administration and the LP A as
a result of the public workshops in the preparation of the public hearing draft
of the Comprehensive Plan. The final draft plan will then be presented to the
Local Planning Agency and the Local Governing Body. The Consultant will
incorporate the revisions requested by the Local Planning Agency and the
Local Governing Body during the public hearings for the transmittal draft of
the Comprehensive Plan. The Consultant will provide 1 reproducible copy of
the final draft Comprehensive Plan for this Task.
The Consultant will work with City Staff in developing appropriate responses
to Chapter 163 reviews and the ORC report from the State of Florida
Department of Community Affairs. A finding of Compliance is dependent
upon the City Commission's adopting the appropriate responses to DCA
requirements.
Phase II
(2 month TImeframe after completion of Phase I)
Task 7
Land Development Regulations (Task Budget - $19,000.00)
The Consultant will prepare the Land Development Regulations necessary to
implement the requirements of the Comprehensive Plan and to comply with
applicable State, regional, count and local requirements for Land
Development regulations. The exact nature and types of development
regulations will be determined as a result of the Community Visioning Process
and adopted Comprehensive Plan. At a minimum, these will likely include
zoning, subdivision, parking, signage, landscaping, property maintenance
and appearance, and concurrency-related regulations. The Land
Development Regulations will include graphics in addition to the text to
clearly describe the development requirements. The consultant will provide
one reproducible and disk.
