AN RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, PROVIDING THAT,
EXCEPT FOR THE EQUAL OPPORTUNITY EMPLOYMENT
AND SEXUAL HARASSMENT POLICIES AND COMPLAINT
PROCEDURES WHICH ARE APPLICABLE TO EVERYONE,THE
CITY CHARTER POSITIONS AND EMPLOYEES OF THE
OFFICE OF THE CITY ATTORNEY AND THE OFFICE OF THE
CITY CLERK ARE EXEMPT FROM THE PROVISIONS OF THE
EMPLOYEE POLICIES AND PROCEDURES MANUAL ISSUED
BY THE CITY MANAGER, EXCEPT AS THE APPLICABILITY
OF THOSE PROVISIONS MAY BE SPECIFICALLY AGREED
UPON BETWEEN THE CITY ATTORNEY AND CITY
MANAGER, AND THE CITY CLERK AND CITY
MANAGER;FURTHER PROVIDING THAT THE CHARTER
POSITIONS SHOULD BE EXCLUDED AS NON-CLASSIFIED
EMPLOYEES WITH RESPECT TO POSITION
CLASSIFICATIONS AND COMPENSATION PLANS UNDER THE
MANUAL; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Office of the City Manager has issued an Employee Policies and
Procedures Manual, setting forth policies and procedures for all paid employees of the City of
Sunny Isles Beach; and
WHEREAS, the City Charter positions are directly responsible to the City Commission;
and
WHEREAS, the employees of the Office of the City Attorney and the Office of the City
Clerk are directly responsible to those Charter positions and not the City Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS:
Section 1. Exemption for City Charter Positions. Except for the Equal Opportunity
Employment and Sexual Harassment Policies and Complaint Procedures, which are applicable to
everyone in City Hall, the City Charter positions and employees of the Office of the City
Attorney and Office of the City Clerk are exempt from the provisions of the Employee Policies
and Procedures Manual issued by the City Manager except as the applicability of those terms
may be specifically agreed upon by and between the City Attorney and the City Manager and the
City Clerk and the City Manager.

Section 2. Charter Positions as Non-Classified Employees. The three charter positions shall
be classified as non-classified employees with respect to position classifications and
compensation plans.
Section 3. Effective Date. This resolution shall be effective upon adoption and shall be
included in the Employee Policies and Procedures Manual, as may be amended from time to
time.
