HomeMy WebLinkAboutReso 2000-264RESOLUTION NO.2000-_2Lq A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A CHANGE ORDER, ATTACHED HERETO AS EXHIBIT "A", IN AN AMOUNT NOT TO EXCEED $20,000, FOR THE INSTALLATION OF ADDITIONAL GROUNDCOVER, UPGRADING OF GRASS FOR OPEN SPACES AT THE PASSIVE PARK, IN CONNECTION WITH THE EXISTING AGREEMENT BY AND BETWEEN THE CITY OF SUNNY ISLES BEACH AND TROPIC LANDSCAPING & LAWN MAINTENANCE, INC., PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Administration has made a concerted effort to redesign the Passive Park, taking into account every possible environmental, physical, and fiscal constraint; and WHEREAS, via Resolution No. 2000-234, adopted May 30, 2000, the City Commission authorized the expenditure of approximately $140,000 for the present improvements at the Passive Park, including but not limited to internal drainage, raised elevations, and significantly improved landscaping; and WHEREAS, in an attempt to develop an optimally functional park, the landscaping contractor and City environmental and recreation staff have, along with other various improvements, selected an upgraded grass that will not only withstand the rigors of the barrier island system, but will offer the best possible resistance to heavy foot traffic; and WHEREAS, including these upgrades and additions, the Passive Park Project is approximately $60,000 under budget. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Change Order. A change order, attached hereto as Exhibit "A," in an amount not to exceed Twenty Thousand Dollars ($20,000.00) to the existing contract by and between the City of Sunny Isles Beach and Tropic Landscaping & Lawn Maintenance, Inc., be, and the same, is hereby approved. Section 2. Authorization of the City Manager. The City Manager is hereby authorized to negotiate said change order as outline in Exhibit "A" attached hereto and do all things necessary to effectuate the agreement. Section 3. Effective Date. This Resolution will beco e effective upon adoption. Dannheisser City Attorney RE: S20,000.00 Passive Park Change Orders Richard Brown-Morilla City Clerk RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution authorizing the City Manager to expend funds on Change Orders for upgraded grass and additional work and materials for the Passive Park_, in an amount not to exceed $20.000.00. In response to citizen concerns about flooding in the Passive Park site at North Bay Road and 178`h Street, as discussed at the February 10, 2000 Commission meeting, the Office of the City Manager expended $78,761.00 for the transportation of fill, leveling, resodding, and temporary tree removal and storage, in order to raise the elevation of the park site. Via Resolution No. 2000-234, adopted May 30, 2000, the City Commission authorized the City Manager to expend both the above amount for said purposes, as well as $57,775.50 for the removal of 44 undersized suffering tree specimens, replacing them with 45 additional palms (five (5) different species), 78 additional trees (14 different species), and 165 shrubs (3 different species), as well as transplanting four (4) large short -leaf fig from the Active Park site and constructing internal drainage for the entire site. As can be readily seen, the park is massively improved in both design and function, with numerous accolades being conveyed upon the staff from senior, middle-aged, and adolescent citizens alike. Unfortunately, in our haste to push the park forward, we did not scrutinize the choice of grass that the previous landscape architect suggested. While we felt that `Bahia" grass would perform well due to its lush appearance 131 Agenda Item 9 D Date 9- 4 1)o at ground level and extreme drought tolerance, we had not fully considered the fact that it does not reproduce through rhizomes. thus never creating a thick, full, self -maintaining lawn. Moreover, while it can be sheared extremely close to the ground, it is not resistant to heavv foot traffic. Both of these items. in tandem with the consideration of neighboring resident aerial views of the Park. lead us to believe that "Bermuda' grass in the open field area, with "St. Augustine" in the remainder of the park, is the best possible solution. To confirm our decision, we have discussed this arrangement with several recreation professionals and landscape contractors within Miami -Dade County. All agree that the City will benefit enormously and be much happier by installing the proper grass for the intended purpose at this point in development. Of course, Tropic Landscaping and Lawn Maintenance, Inc. will credit the City in full for the budgeted Bahia sod, as has been done for all of the trees previously planted and removed. This, however, still results in an additional $11,000.00 for the preferred grass. With approximately S4.000.00 in additional required work and materials already performed, and a desire to add groundcover around the base of the large fig trees to discourage children from climbing and physically abusing the prop roots and trunks, we are requesting a Change Order for this project in an amount not to exceed $20,000.00. While we are comfortable that the unspecified quantity of groundcover shall be nowhere near $5,000.00, we would like to provide for a small contingency for minor oversights, which to date has never been requested by this Administration for this project. ADDITIONAL INFORMATION: It should be noted that David Santana, President of Tropic Landscaping has worked very closely with staff to help with practical decisions and has been very generous to offer us almost $8,000.00 in credit for the exchanged trees, which is the original cost to the City. Moreover, the additional funds requested for the Passive Park are reflective of what would have been spent originally had the park been planned in this fashion. The only money that the City has been unable to recoup is that spent on seeding the park last year. Even with these Change Orders, to date, the City is approximately $60,000 under budget for the Passive Park, including the addition of a spectacular tot lot, and design and oversight from our original landscape architect. It should be noted that since this Administration has personally taken control of the Passive Park design and development, the project has progressed properly and expediently, with the internal drainage working better than could have ever been anticipated. 132 The Office of the City Manager and the Recreation Department agree that after the resodding and landscaping of this park, and the installation of a tot lot. no further work should occur until final decisions are made about the proposed stormwater system to be installed. Moreover, all future improvements, such as sidewalks, sitting walks, and structures, should coincide with the installation of said drainage system. 133
