A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, PROVIDING
AUTHORIZATION TO THE POLICE DEPARTMENT TO
APPROPRIATE AND SPEND FUNDS FROM THE LAW
ENFORCEMENT TRUST FUND, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with Florida Statutes ~932. 7055(4)( a) a law enforcement agency
is authorized to use forfeiture funds for school resource officer, crime prevention, safe neighborhood,
drug abuse education and prevention programs, or for other law enforcement purposes, which
include defraying the cost of protracted or complex investigations, providing additional equipment or
expertise and providing matching funds to obtain federal grants; and
WHEREAS, in accordance with Florida Statutes ~932.7055(4)(b) upon the request of the
Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended
if accompanied by written certification that the request complies with the provisions of the
aforementioned subsection; and
WHEREAS, the Chief of Police has submitted a request for the expenditure of $159,675 in
forfeiture funds in compliance with the aforementioned statute;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of forfeiture monies. Based on the attached certification, the Chief of
Police is hereby authorized to spend $159,675 from the Law Enforcement Trust Fund for the
following:
a. Expenditure in the amount of $80,000 for the purchase and installation of
police vehicle radios.
b. Expenditure in the amount of$15,000 for the purchase and installation oflight
bars.
c. Expenditure in the amount of $7,000 for the purchase and installation of
pnsoner cages.
d. Expenditure in the amount of $5,500 for the purchase and installation of
biohazardous prison seats.
e. Expenditure in the amount of $7,790 for purchase and installation of strobe
lights and headlights.
f. Expenditure in the amount of $19,200 for the purchase and installation of
vehicle computer stands.
g. Expenditure in the amount of$8,000 for the installation of police equipment on
vehicles.

h. Expenditure in the amount of $7,500 for purchase and installation of agency
markings, striping and window tinting on police vehicles.
Section 2.
Effective Date. This Resolution shall become effective immediately upon adoption.

Subject: Forfeiture Expenditures
Recommendation:
It is recommended that the City Commission approve the expenditure of partial
forfeiture funds, previously awarded to the Police Department as the result of
investigative participation in forfeiture and seizure cases. These funds are permissible
by law to be spent for purchases of police equipment and other law enforcement
activities. It is requested that we be permitted to utilize $159,675.00 of said funds on
deposit for such purposes.
Reasons:
One of the benefits of participating in and providing personnel into high intensity
narcotics investigations is the sharing of confiscated proceeds for the enhancement of
law enforcement agencies including new or additional equipment. This is designated so
as not to impact so greatly upon the financial concerns and budget of the city. All of the
attached and listed items are necessary for the performance of officer's duties and the
benefits derived by the residents of the City of Sunny Isles Beach.
Additional Information:
To date the City of Sunny Isles Beach Police Department has been awarded additional
monies in confiscated funds. Certain needs exist on behalf of the department whereby
the purchase of suggested equipment will accomplish those needs. Such items and
equipment are attached for your review.
Certification:
I, Fred A. Maas, certify that pursuant to Florida State Statute 932.0755 section (4) (a)
and (4) (b), the attached listed items meet the guidelines of purchase for law
enforcement purposes which include defraying the costs of protracted or complex
investigation, and providing additional equipment.
