HomeMy WebLinkAboutReso 2001-306 RESOLUTION NO. 2001- 3010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PROVIDING AUTHORIZATION TO THE POLICE CHIEF TO APPROPRIATE AND SPEND $ 5,000.00 FROM THE LAW ENFORCEMENT TRUST FUND TO PAY LEGAL COSTS ASSOCIATED WITH ASSET FORFEITURE PROCESS, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Florida Statutes S932. 7055(4)( a) a law enforcement agency is authorized to use forfeiture funds for school resource officer, crime prevention, safe neighborhood, drug abuse education and prevention programs, or for other law enforcement purposes, which include defraying the cost of protracted or complex investigations, providing additional equipment or expertise and providing matching funds to obtain federal grants; and WHEREAS, in accordance with Florida Statutes S932.7055(4)(b) upon the request ofthe Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsection; and WHEREAS, the Chief of Police has submitted a request for the expenditure of$5,000.00 in forfeiture funds in compliance with the aforementioned statute; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authorization to expend forfeiture funds. Based on the attached certification, the Chief of Police is hereby authorized to spend $ 5,000.00 from the Law Enforcement Trust Fund for the retroactive expenditures from October 1, 2000 in the amount of $5,000.00 for the costs associated with the asset forfeiture process. (Process service, legal notifications, advertisement, filing fees, etc.) Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. Maas,Chief of Police January 29,2001 RESOLUTION ALLOWING THE POLICE CHIEF TO APPROPRIATE AND SPEND $5,000.00 FROM THE LAW ENFORCMENT TRUST FUND TO PAY LEGAL COSTS ASSOCIATED WITH ASSET FORFEITURE PROCESS. RECOMMENDA nON: It is recommended that the City Commission approve a Resolution authorizing the Chief of Police to appropriate and spend $5,000.00 from The Law Enforcement Trust Fund to pay for Legal Costs Associated with the Asset Forfeiture Process. REASON: In accordance with Florida Statutes #932-7055(4) a law enforcement agency is authorized to use forfeiture funds for school resource officer, crime prevention, safe neighborhood, drug abuse education and prevention programs, or for other law enforcement purposes, which include defraying the cost of protracted or complex investigations, providing additional equipment or expertise and providing matching funds to obtain federal grants.
