RESOLUTION NO. 2001-.31:)
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF
OF POLICE, IN ACCORDANCE WITH SECTION 932.7055, F.S.
(1978) TO EXPEND $19,500.00 FOR THE PURPOSES AS SET
FORTH HEREIN; PROVIDING FOR AN EFECTIVE DATE.
WHEREAS, in accordance with Florida Statutes ~932.70554(b) upon the request by the
Chief of Police to the governing body of a municipality, liens and forfeiture funds may be
expended if accompanied by written certification that the request complies with the provisions of
this subsection; and
WHEREAS, in accordance with Florida Statutes ~932.70554(c)(3) specifically, a law
enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture
Act with a fiscal year must expend or donate no less than 15% of such proceeds for the support
or operation of any drug treatment, drug abuse, drug prevention, crime prevention, safe
neighborhood or school resource officer programs;
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of forfeiture monies. Based on the attached certification, the Chief of
Police is hereby authorized to spend $ 19,500.00 from the last fiscal year of state forfeiture
monies to be utilized in the following manner:
A. $10,100.07 for uniform & equipment for new Honor Guard members and
for expenses related to a trip to Washington D.C. for a crime prevention
ceremony.
B. $9,222.00 for equipment and furniture for the Communications Bureau.
Section 2.
Effective Date. This Resolution will become effective upon adoption.
PASSED AND ADOPTED on this 15th day of March, 2001.

RESOLUTION ALLOWING THE POLICE DEPARTMENT TO
EXPEND MONIES FROM THE LAW ENFORCEMENT TRUST
FUND 2001
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure of
partial forfeiture funds, previously awarded to Police Department as the
result of investigative participation in forfeiture and seizure cases. These
funds are permissible by law to be spent for law enforcement activities.
It is requested that we be permitted to utilize a $19,500.00 of said funds
on deposit for such purposes.
REASON:
To date the City of Sunny Isles Beach Police Department has been
awarded additional monies in confiscated funds. Certain needs exist on
behalf of the department whereby the purchase of suggested equipment
will accomplish those needs. Such items and equipment are attached for
your reVIew.
ADDITIONAL INFORMATION:
To date, the City of Sunny Isles Beach Police Department has been
awarded additional monies in confiscated funds. One of the most
recognizable entities of the police department has been the Honor Guard.
The guard performs regularly at formal ceremonies and functions
throughout the city and other venues. The crowning event for all Honor
Guards is the attendance at the National Police Memorial in Washington
D.C. At this ceremony, all slain police officers and their victim families
are memorialized while the Honor Guards from across the country salute
them. This also serves as an incentive and reward for all that hard work
and dedication the members of the guard donate throughout the year.
The City of Sunny Isles Beach has made great strides in its recognition
as a city and professional police department and this event goes along
with furthering that reputation. The items and expense are attached for
your reVIew.

The furniture that has been requested for the Communications Bureau is
of a quality that should last for a number of years and perhaps still be
utilized when we move into the new building. The Communications
Bureau area is manned 24 hours a day, seven days a week. This results
in usage that can be compared to four years of use to one year of use in
an area that is only manned 40 hours a week, as most office areas.
The specific chairs are designed in such a fashion as to be comfortable
for a person who must remain seated during a full shift. Although the
dispatchers get a lunch break, they are required to remain in the dispatch
area the remainder of their shift, and do not have the freedom to move
about as most office workers.
The console radio has been requested for officer safety, thought the
communications aspect would be made easier and safer with this new
addition.

I Fred A. Maas, certify that pursuant to Florida State Statute 932.0755
section (4) (a) and (4) (b), the attached listed items meet the guidelines of
purchase for law enforcement purposes which include defraying the costs
of protracted or complex investigation, and providing additional
equipment and functions.
