RESOLUTION NO. 2001-~
A RESOLUTION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, APPROVING THE LETTER AGREEMENT FOR
CONSULTING SERVICES FROM LUFT CONSULTING, INC.
FOR ON-GOING REVIEW OF LARGE SCALE PROJECTS
WITHIN THE CURRENT RU4-A DISTRICT; AUTHORIZING
THE CITY MANAGER TO EXECUTE SAID AGREEMENT
ATTACHED HERETO AS EXHIBIT "A" AND DO ALL
OTHER THINGS NECESSARY TO EFFECTUATE THE
TERMS OF THE AGREEMENT; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with the discussion of Tuesday, February 13, 2001, Luft
Consulting, Inc. was requested to submit a proposal for consulting services to continue to assist the
City of Sunny Isles Beach in the on-going review oflarge scale projects within the current RU4-A
zoning district; and
WHEREAS, Luft Consulting, Inc. has submitted such proposal, which is attached hereto as
Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Letter Agreement. The Letter Agreement by and between the City of
Sunny Isles Beach and Luft Consulting for on-going review oflarge scale projects, attached hereto as
Exhibit "A", be and the same is hereby approved.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to execute
said agreement and do all things necessary to effectuate the terms of this agreement.
Section 3.
Effective Date. The Resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED this 15th day of March 2001.

Re: Consulting Services - Review of large Scale Projects.
Dear Mr. Russo,
In accordance with our discussion on Tuesday, February 13th, luft Consulting, Inc. is submitting
this proposed letter of agreement for consulting services to assist the City of Sunny Isles Beach in
the on-going review of large scale projects within the current RU-4A zoning district.
My services would include:
· Review of large scale development plans (principally within the RU-4A district) for
consistency with the parameters of the adopted Comprehensive Plan. This review,
however, would not replace the required review and determinations to be made by the
City Zoning Administrator as to certification of measurements and calculations for
compliance of plans with zoning measures (FAR, Setbacks, parking calculations, etc.). My
recommendations are to be considered advisory only. Final responsibility for the
Administration's interpretations and recommendations vis-a-vis the zoning code and
Comprehensive Plan rests with the Zoning Administrator and the Director of Planning and
Community Development. It is agreed that these services are considered an interim
measure to assist the City in its transition to full implementation of the Comprehensive
Plan and that the need for such services shall be reviewed after 90 days from the
execution of this agreement and shall be extended only upon mutual agreement of the
City administration and luft Consulting, Inc.
· Design review of said plans to provide recommendations to the administration and to the
Commission for modifications that will enhance the overall project design consistent with
the objectives of the Comprehensive Plan.
· If necessary, testimony before the Commission or board reviews as a part of the approval
process to convey aspects of my review conclusions and to answer questions or discuss
options available in consideration of submitted plans.
My fees for the above-described services are as follows:

. For large-scale development plan review, including a written memorandum of findings
and recommendations and one meeting, if necessary, with staff and/or the project
architect or applicant, a fixed fee of $500.00 per project submission. Should additional
meetings with staff and/or the applicant be necessary, or additional reviews due to revised
or amended submissions, my time will be billed at an $100.00 per hour. Public hearing
presentations, if necessary, will be billed at an hourly rate of $100.00 per hour
(Government Rate) with no charge for travel time.
I appreciate this opportunity to provide assistance to the City in furtherance of its development,
planning and regulatory program objectives.
