A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE A
FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) CONTRACT RENEWAL
ATTACHED HERETO AS EXHIBIT "A", FOR THE CONTINUING MAINTENANCE
AND LANDSCAPING OF SR-AlA (COLLINS AVENUE) AND SR-826 (SUNNY ISLES
BOULEVARD); PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on June 11, 1998, by Resolution No. 98-59, the City Commission approved
and authorized the City Manager to enter into an FDOT Maintenance Landscaping
Memorandum of Agreement ("FDOT Maintenance Agreement") for maintenance and
landscaping of median strips and roadside areas of SR-AIA (Collins Avenue — from 156th Street
to N.W. 196th Street) and SR-826 (Sunny Isles Boulevard — east side of Sunny Isles Bridge to
Collins Avenue), for a period of three years with an option to renew; and
WHEREAS, said FDOT Maintenance Agreement has a renewal option which provides
for a renewal if mutually agreed to by both parties and subject to the same terms and conditions
of the original Agreement; and
WHEREAS, the City Manager has determined it would be in the City's best interest to
renew the FDOT Maintenance Agreement for health, welfare and benefit of the citizens of Sunny
Isles Beach;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
1. The City Commission hereby approves the Florida Department of State (FDOT) Contract
Renewal attached hereto as Exhibit "A," for continuing the maintenance and landscaping of SR-
AlA (Collins Avenue) and SR-826 (Sunny Isles Boulevard) for an additional three (3)-year
period, commencing July 1, 2001 through June 30, 2004.
2. The City Manager is hereby authorized to execute and renew the FDOT Contract for
Renewal and to do all things necessary to effectuate same.
3. This Resolution becomes effective upon adoption.

hereinafter called "Contractor".
WITNESSETH:
WHEREAS, the Department and the Contractor heretofore on June 24, 1998
entered into an Agreement whereby the Department retained the Contractor to perform Maintenance of all landscaped
and/or turfed areas within the Department's right of way on SRA1A (Collins Ave) from N W 156th St to N W 196th St.. and
on SR-826 (Sunny Isles Causeway) from E. side of Sunny Isles Bridge to Collins Ave.
; and
WHEREAS, said Agreement has a renewal option which provides for a renewal if mutually agreed to by both
parties and subject to the same terms and conditions of the original Agreement;
NOW, THEREFORE, this Agreement witnesseth that for and in consideration of the mutual benefits to flow each
to the other, the parties agree to a renewal of said original Agreement dated June 24. 1998
for a period of three year beginning 1_ day of July , 2001 and ending the 30
day of June , 2004 at an annual cost of $ 7,053.12 or an approniation of
$ 21.159.36 for the three year period specified herein.
All terms and conditions of said original Agreement shall remain in force and effect for this renewal.
IN WITNESS WHEREOF, the parties have executed this Agreement by their duly authorized officers on the
day, month, and year set forth above.

and litter removal is performed once a month, which was, and still is, unacceptable to the
City Clerk
City. In June, 1998, the City of Sunny Isles Beach entered into a three-year agreement with
FDOT in which the City agreed to maintain the landscaping for the medians and roadside
strips located on Collins Avenue (from 156h Street to N.W. 196s Street) and SR-826
(Sunny Isles Boulevard, from the east side of Sunny Isles Bridge to Collins Avenue). As
compensation, FDOT agreed to pay the City the sum of $7,053.12 per year or S21,159.36
for the three-year period with an option to renew if mutually agreed to by both parties and
subject to the same terms and conditions of the original agreement.
The current contract with FDOT expires in June and the City has been given us the option
to renew this contract for an additional three-year period commencing July 1, 2001 through
June 30, 2004. It is my opinion, that it would be in the best interest of the City to maintain
this agreement with FDOT.

Enclosed is an original agreement for the contract reference above. The contract time for
this agreement shall begin on July 1, 2001, for a period of three years or until June 30,
2004. Mr. Keith Jimmerson, North Dade Maintenance Engineer and his staff will
administer this agreement. Mr. Keith Jimmerson can be reached at telephone number
(305) 654-7163.
The City may invoice the Department immediately after the end of a quarter. The
quarters are listed below:
First Year:

Second Quarter: October 1, 2001 thru December 31, 2001
Third Quarter: January 1, 2002 thru March 31, 2002
Fourth Quarter: April 1, 2002 thru June 30, 2002
