A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A
REQUEST FOR ADDITIONAL COMPENSATION IN THE
AMOUNT OF NINE THOUSAND FIVE HUNDRED DOLLARS
($9,500.00) UNDER THE CONTRACT BETWEEN THE CITY
OF SUNNY ISLES BEACH AND LUFT CONSULTING, INC.,
FOR PROFESSIONAL SERVICES IN CONNECTION WITH
THE PREPARATION OF THE LAND DEVELOPMENT
REGULATIONS; AUTHORIZING THE CITY MANAGER TO
DO ALL THINGS NECESSARY TO EFFECTUATE SAID
CHANGE ORDER; PROVIDING FORAN EFFECTIVE DATE.

WHEREAS, on February 10, 2000, by Resolution No. 2000-198, the City Commission
directed the City Manager on an emergency basis to retain the firm ofLuft Consulting, Inc., injoint
venture with the Chesapeake Group, Inc. as certified planners, to prepare the Comprehensive Plan for
the City of Sunny Isles Beach and waiving all bidding requirements of Ordinance No. 97-10; and
WHEREAS, on February 24, 2000, by Resolution No. 2000-200, the City Commission
approved a contract with Luft Consulting, Inc. for preparation of the Comprehensive Plan and Land
Development Regulations for the City of Sunny Isles Beach; and
WHEREAS, Task Seven of the aforementioned contract requires additional work efforts not
contemplated at the time that the original scope of services was determined.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Request. The request for additional compensation in the amount of Nine
Thousand Five Hundred Dollars ($9,500.00) under the contract by and between the City of Sunny
Isles Beach and Luft Consulting, Inc., is hereby approved.
Section 2. Authorization of the City Manager. The City Manager is hereby authorized to
negotiate said change order as outlined in composite Exhibit "A" attached hereto and do all things
necessary to effectuate the agreement.
Section 3.
Effective Date. This Resolution is effective upon passage.

Dear Jack:
I have considered your request for additional compensation with regards to the formulation
and adoption process ofthe land development regulations for the City of Sunny Isles Beach.
It is acknowledged that your agreement, as set forth to you in the beginning, included the
fact that the then Planning and Development Director, Ms. Marla Dumas, was to handle the
creation and review of the land development regulations chapters concerning definitions,
rules of construction, review and approval procedures, powers and duties of boards. non-
conforming procedures, performance standards, actual subdivision regulations, and several
other elements that you, the City Attorney, and I have discussed.
I realize you have absorbed a significant palt of the entire land development regulation
package that was to be accomplished hy Ms. Dumas. In light of that fact, I am proposing a
supplemental agreement to accommodate the additional work. 1 might add that the City
Attorney has also had to take on additional responsibilitles since Ms. Dumas did not
complete any of these tasks.
With regard to the financial aspect of this, it is no secret that the economy here in Florida has
put in doubt the revenue stream that the current budget is predicated upon. However, in light
of fairness, I am proposing a supplemental agreement in an amount of Nine Thousand Five
Hundred Dollars ($9,500.00) in acknowledgment of your time and assistance to complete
this project and realizing that we have a continued long-term relationship between your firm
and the City, which, in my experience has been most positive.

Thank you for your thoughtful and supportive response to my request for consideration of
supplemental fees in connection with the preparation of the Land Oevelopment Regulations for
the Comprehensive Planning effort we have jointly undertaken these past 20 months.
I accept, gratefully, your offer of $9,500.00 to supplement the prior contract of $19,000 for the
preparation of the LOR package and acknowledge that this amount fully satisfies the
compensation requested for my work effort up to and through my delivery of the draft LOR's on
June 30th, 2001. As stated in my transmittal letter and final invoice for the preparation of the
draft LOR's dated July 1st, 2001, my continuing efforts to implement the LOR's from that point
forward will be billed at the contractual hourly rate of $100 per hour.
I recognize that the City is facing significant challenges to meet numerous financial obligations in
a difficult time and that this supplementary amount is above and beyond the contractual fee
agreed upon in February, 2000. I too, look forward to a continuing and positive long term
relationship that will permit us to mutually pursue the exciting and challenging vision set out in
your Comprehensive Plan. For these reasons, I never intended to seek anything more than an
acknowledgement that my contractual work effort for the first half of 2001 justified additional
fees and a good faith gesture by the City to settle the compensation issue. You have done so.
Thank you. I look forward to an expeditious conclusion to the revitalization planning efforts we
are currently engaged in and providing any additional assistance the City m~y desire.
