RESOLUTION NO. 2002- 41 ~
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, REQUIRING S & G OF
MIAMI BEACH, INC., ITS SUCCESSORS AND/OR ASSIGNS,
TO REIMBURSE THE CITY OF SUNNY ISLES BEACH FOR
NECESSARY PROFESSIONAL FEES INCURRED, IN
ACCORDANCE WITH ORDINANCE NO. 2001-132, IN THE
AMOUNT OF $3,167.10; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, S & G of Miami Beach, Inc., a Florida corporation, has requested a
vacation of a portion of the right-of-way (which is not a roadway) along Atlantic Boulevard and
175th terrace, adjacent to lots 5, 6 and 7, Block 9, Sunny Isles Shores, Section "B," as recorded
in Plat Book 65, at Page 47, of the Public Records of Miami-Dade County more particularly
described in Exhibit "A" attached hereto and made a part hereof, and this unusual request has
required extraordinary time and consulting in connection therewith; and
WHEREAS, Ordinance No. 2001-132, requires an applicant to reimburse the City for
extraordinary professional fees; and
WHEREAS, it is estimated that no less than 30 hours of legal and other professional
time has been devoted to getting this matter to be heard by the City Commission on behalf of the
property owner;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
1. Incorporation of Recitals. The recitals set forth above are incorporated herein by
reference.
2. Reimbursement of Professional Fees. The City Commission hereby requires S & G
of Miami Beach, Inc., its successors and/or assigns, to reimburse the City of Sunny
Isles Beach for extraordinary and professional fees in the amount of $3,167.10,
payable in accordance with Ordinance No 2001-132, within 30 days of this
Resolution, regardless of outcome of the matter.
3. Effective Date. This Resolution will become effective upon adoption.
