RESOLUTION NO. 2002- ~ 19
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING THE RANKING OF
CONSTRUCTION MANAGEMENT FIRMS PURSUANT TO ~287.055, F.S.
(2000) AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN
AGREEMENT BY AND BETWEEN THE CITY OF SUNNY ISLES
BEACH AND THE WEITZ COMPANY, INC., FOR THE
CONSTRUCTION OF CITY HALL AND ACCESSORY STRUCTURE (S)
RELATED TO THE CITY HALL; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE WITH THE SECOND AND THIRD
RANKED FIRMS SHOULD THE CITY BE UNABLE TO NEGOTIATE A
SATISFACTORY CONTRACT WITH THE WEITZ COMPANY, INC.
THAT IS FAIR, COMPETITIVE AND REASONABLE; AUTHORIZING
THE CITY MANAGER TO DO ALL THINGS TO EFFECTUATE THE
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is in need of Construction Management
Services for the construction of City Hall and accessory structure(s) related to the City Hall; and
WHEREAS, the City noticed Request for Qualifications No. 01-12-02 for qualified
Construction Management Firm(s), which were opened on January 17, 2002, four firms
responded, four firms were selected and presented their proposals to a Selection Committee on
January 24, 2002; and
WHEREAS, the Selection Committee heard the presentations, reviewed materials
submitted and then, ranked the top three respondents in accordance with ~ 287.055, F.S. (2000)
as follows: 1) The Weitz Company, Inc.; 2) James A. Cummings, Inc.; and 3) Grace & Naeem
Uddin, Inc.; and
WHEREAS, The Weitz Company, Inc., has been "qualified" by the City Commission to
perform construction management services for the construction of City Hall and accessory
structure(s) related to the City Hall; and
WHEREAS, James A. Cummings, Inc., and Grace & Naeem Uddin, Inc. have been
"qualified" as the second and third ranked firms, respectively, by the City Commission to
perform construction management services for the construction of City Hall and accessory
structure(s) related to the City Hall construction management; and

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approving Rank Ordering. In accordance with S 287.055, F.S. (2000) the
Selection Committee's rank ordering of the landscape architectural firms is hereby approved as
follows: 1) The Weitz Company, Inc., 2) James A. Cummings, Inc., and 3) Grace & Naeem
Uddin, Inc.
Section 2. Authorization of City Manager to Negotiate with The Weitz Company, Inc. The
City Manager is hereby authorized to negotiate an agreement with The Weitz Company, Inc. for
the provision of construction management services for the construction of City Hall and
accessory structure(s) related to the City Hall, and do all things necessary to effectuate the
Resolution.
Section 3. Authorization for City Manager to Negotiate with Second and Third Ranked
Firms. Should the City be unable to negotiate a satisfactory contract with The Weitz Company,
Inc. that is fair, competitive and reasonable, such negotiations shall be formally terminated and
the City Manager is hereby authorized to undertake negotiations with the second ranked firm of
James A. Cummings, Inc.; and if not satisfactory, the third ranked firm of Grace & Naeem Uddin,
Inc. for the provision of construction management services for the construction of City Hall and
accessory structure(s) related to the City Hall, and do all things necessary to effectuate the
Resolution.
Section 4.
Effective Date. This Resolution will become effective upon adoption.

Attached are the results of the interview and presentation by the finalist Construction Manager for
new City Hall & Accessory Buildings on January 24, 2002, for the Request for Qualifications RFQ
01 -12 -02 (Construction Manager Services).
The Committee approved the firms in the following order.
1. The Weitz Company, Inc.
2. James A. Cummings, Inc.
3. Grace & Naeem Uddin, Inc.

RE: ACCEPTANCE OF RANKING OF CONSTRUCTION MANAGEMENT FIRMS
AND AUTHORIZATION TO NEGOTIATE CONTRACT WITH SAME
RECOMMENDATION
It is recommended that the City Commission adopt the attached resolution approving the ranking of
construction management firms, and providing the City Manager with the authority to negotiate a
contract with the number one ranked firm, and should those negotiations fail, with the number two
and three ranked firms, respectively.
REASONS
The City is in need of construction management services for the building of a City Hall and
accessory structure(s) related to the City Hall. Therefore, the City issued and advertised Request for
Qualifications #01- 12 -02. Four (4) construction management firms submitted qualifications for
consideration. Those four (4) firms were invited to make presentations before the Construction
Management Selection Committee, which was comprised of the City Manager, the Building Official,
the Zoning & Planning Director, and the architect for the City. The top three firms, as ranked by the
Committee, are as follows:
(1) The Weitz Company, Inc.
(2) James A. Cummings, Inc.
(3) Grace & Naeem Uddin, Inc.
ADDITIONAL INFORMATION
Upon approval of the attached resolution, we will begin contract negotiations for the provision of
construction management services. Once a contract has been successfully negotiated, it will be
brought before the City Commission for approval.
