HomeMy WebLinkAboutReso 2002-425 RESOLUTION NO. 2002- 4-25" A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, INCORPORA TING RECITALS; EXPRESSING SUPPORT FOR THE CONTINUING EXISTENCE OF THE HUMAN RIGHTS ORDINANCE THA T PROHIBITS DISCRIMINA TION BASED ON SEXUAL ORIENT A TION, AS ADOPTED BY MIAMI-DADE COUNTY'S BOARD OF COUNTY COMMISSIONERS IN 1998; OPPOSING THE SEPTEMBER 10, 2002 BALLOT QUESTION THAT WOULD REPEAL THE MIAMI-DADE COUNTY HUMAN RIGHTS ORDINANCE NO. 98-170; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Miami-Dade County's success as a thriving international business and banking center, and its success as an international tourist destination is a result of accepting the diversity of both our local residents and the global clientele we serve; and WHEREAS, the City Commission of the City of Sunny Isles Beach agrees with the business principle that an individual's ability should not be measured with regard to their race, color, religion, ancestry, national origin, sex, pregnancy, age, disability, marital status, familial status, or sexual orientation; and WHEREAS, the City of Sunny Isles Beach is committed to the concept and practice of equal employment opportunity; and WHEREAS, it is the policy of the City of Sunny Isles Beach to recruit, hire, train and promote into all job levels, employees and applicants for employment without regard to race, color, age, sex, national origin, religion, marital status, sexual orientation, or disability; and WHEREAS, the Board of County Commissioners of Miami-Dade County have scheduled a countywide Special Election to be held on Tuesday, September 10, 2002, for the purpose of submitting to the voters of Miami-Dade County the question of whether Miami-Dade County Ordinance No. 98-170, relating to prohibiting discrimination based on sexual orientation in housing, credit and finance, public accommodations, and employment, shall be repealed; and WHEREAS, the City of Sunny Isles Beach is committed to the traditional principles of equality and fairness for all citizens of Miami-Dade County embodied within the Miami-Dade County Human Rights Ordinance, and opposes practices of intolerance and discrimination; and WHEREAS, the City Commission of the City of Sunny Isles Beach shares a concern that a repeal of the Miami-Dade County Human Rights Ordinance would project a very negative and divisive image to the world that could adversely impact the economy of Miami-Dade County. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. reference. Incorporation of Recitals. The recitals set forth above are incorporated herein by R2002- Support Human Rights Ordinance & Oppose Repeal 1 Section 2. Expression of Support. The Mayor and City Commission of the City of Sunny Isles Beach hereby support efforts to ensure that the Miami-Dade County Human Rights Ordinance, which prohibits discrimination in employment, family leave, public accommodations, credit and financing practices, and housing based on race, color, religion, ancestry, national origin, sex, pregnancy, disability, marital status, familial status or sexual orientation, remains intact. Section 3. Oppose Efforts to Repeal the Human Rights Ordinance. The Mayor and City Commission of the City of Sunny Isles Beach specifically oppose any effort to repeal that portion of the Miami-Dade County Human Rights Ordinance No. 98-170 that prohibits discrimination based on sexual orientation, and encourage all voters to vote on September 10, 2002, and to vote: "No - against repeal." Section 4. Authorization to City Clerk. The City Clerk is hereby directed to provide a copy of this Resolution to each of the Miami-Dade County municipalities, to the Miami-Dade County Board of Commissioners, and to Miami-Dade County Mayor Alex Penelas. Section 5. Effective Date. This Resolution becomes effective u adoption. PASSED and ADOPTED this 19th day of March, 2002. Dannheisser, City Attorney Richard Brown- Morilla, City Clerk To: The Honorable City Commission From: Mayor David Samson Date: March 19, 2002 Re: Resolution Expressing Support For The Continued Existence Of The County's Human Rights Ordinance No. 98 -170 That Prohibits Discrimination Based On Sexual Orientation, and Opposing Its Repeal On September 10, 2002 RECOMMENDATION: It is recommended that the City Commission adopt the attached resolution. REASONS: In 1998, the Miami -Dade County Board of County Commissioners adopted Ordinance No. 98- 170, also known as the Human Rights Ordinance. Ordinance No. 98 -170 amended existing law by also prohibiting discrimination based on sexual orientation in housing, credit and finance, public accommodations, and employment. In January 2002, after the Elections Department certified petitions seeking a countywide vote to repeal Ordinance No. 98 -170, the Board of County Commissioners were then obliged to schedule a countywide Special Election that will be held on Tuesday, September 10, 2002. In the election voters must decide whether Miami -Dade County's Ordinance No. 98 -170, relating to prohibiting discrimination based on sexual orientation in housing, credit and finance, public accommodations, and employment, shall be repealed. Many residents of Sunny Isles Beach .have experienced various forms of discrimination in their personal lives and know the hardship and personal harm that can result. I believe we should set an example, and publicly affirm our commitment to principles of equality and fairness for all citizens of Miami -Dade County as embodied within the Miami -Dade County Human Rights Ordinance. Please join me in opposing these misguided efforts to legitimize intolerance and
