A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR CS/SB
1418 THAT AUTHORIZES CREA TION OF A CITIZEN PROPERTY
INSURANCE CORPORATION TO PROVIDE FOR WINDSTORM
INSURANCE RA TE ACCOUNTABILITY ; STRONGLY ENCOURAGING
GOVERNOR BUSH TO SIGN THE LEGISLATION; AND DIRECTING
THE CITY CLERK TO FORWARD A COpy OF THIS RESOLUTION TO
GOVERNOR JEB BUSH, AND TO SENATOR RONALD A. SILVER,
REPRESENT A TIVE SALLY A. HEYMAN AND REPRESENTATIVE DAN
GELBER; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, property owners of the State of Florida, particularly those in South Florida
including the City of Sunny Isles Beach, face yearly threats of hurricane and tropical storm
damage to their homes and property; and
WHEREAS, the Florida State Legislature has adopted CS/SB 1418 that authorizes
creation of a Citizen Property Insurance Corporation to provide for windstorm insurance rate
accountability; and
WHEREAS, if the Citizen Property Insurance Corporation (CPIC) is established, it will
have Federal Tax Exempt Status that can provide a savings to property owners within the State of
Florida of approximately $80 million; and
WHEREAS, if said State legislation is signed into law, it will eliminate the proposed
40% premium increase scheduled for July 1, 2002, and cap the insurance premium rates at 10%;
and
WHEREAS, this legislation will provide re-insurance protection for covered properties,
and will require public hearings on the rate formula; and
WHEREAS, establishment of the CPIC would benefit all property owners in Sunny Isles
Beach; and
WHEREAS, the City Commission of the City of Sunny Isles Beach wishes to lend its
strong support to CS/SB 1418, creating the new Citizen Property Insurance Corporation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1: Expression of Support. The City Commission of the City of Sunny Isles Beach
hereby expresses support for the enactment of CS/SB 1418 authorizing the creation of a Citizen
Property Insurance Corporation to provide for windstorm insurance rate accountability, and
strongly encourages Governor Jeb Bush to sign the legislation.

Section 2: Direction to City Clerk. The City Clerk is hereby directed to forward a copy of
this resolution to Governor Jeb Bush, and to Senator Ronald A. Silver, Representative Sally A.
Heyman, and Representative Dan Gelber.
Section 3.
Effective Date. This Resolution shall become effective upon passage.
PASSED AND ADOPTED this 18th day of April, 2002.

Accountability; and Strongly Encouraging Governor Bush To Sign the
Legislation
RECOMMENDATION:
It is recommended that the City Commission add this item to your agenda and then adopt the
attached resolution.
REASONS:
Effective July 1, 2002, property owners in Sunny Isles Beach face the real possibility of huge
rate increases for windstorm insurance. Senator Ron Silver and Representative Sally Heyman
have worked hard to convince the State Legislature to enact CS /SB 1418. If Governor Bush
signs the recently enacted State legislation into law, it will provide windstorm insurance rate
relief for property owners in Sunny Isles Beach and in coastal communities throughout the state.
The new legislation will also provide re- insurance protection for covered properties, and will
require public hearings on the rate formula

I am writing to encourage your city on behalf of its citizenry and property owners, to
contact Governor Jeb Bush through letter, fax or phone call; regarding your support of
CS /SB 1418: Citizen Property Insurrance Corp awaiting the Governor's signature to
become law.
This legislation, passed by the Florida House and Senate contains all key issues Senator
Ron Silver and I have been championing for over two years: Windstorm Rate
.Accountability,
Creating the new Citizen Property Insurance Corporation and achieving federal tax-
exempt status (saving $80+ milljon), this legislation also contains our issues, important to
our communities, that you have helped champion and lobby for:
• Eliminate proposed 40% premium increase scheduled for July 1, 2002
Caps premium increase at 10%
■ Board make -up will include greater consumer representation
Eligible windstorm pool areas will be re- evaluated and scientifically calculated
Rates can be challenged in court by the Insurance Commission. or State CFO
• Homeowner policies requiring windstorm will not automatically have mandated
flood coverage policies.
• Re- insurance protection for covered properties.
• Public hearings and public input on the rate formula.

believe due to the combined efforts of bi- partisan legislators, marry community activists
and local officials getting involved to pass significant windstorm legislation. I hope you
