HomeMy WebLinkAboutReso 2002-453 RESOLUTION NO. 2002-1.53 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, REQUESTING PERMISSION FROM MIAMI- DADE COUNTY FOR USE OF A SMALL PORTION OF THE RIGHT-OF- WAY AT THE NORTHERN EDGE OF HAUL OVER PARK FOR PLACEMENT OF A CITY ENTRANCE SIGN; DIRECTING THE CITY CLERK TO TRANSMIT THIS RESOLUTION TO MIAMI-DADE COUNTY FOR APPROVAL BY THE COUNTY COMMISSION; PROVIDING FORAN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach wishes to install an entrance sign welcoming people to the City at the northern edge of Haulover Park; and WHEREAS, the City of Sunny Isles Beach would like to use a small portion ofthe Miami- Dade County right-of-way along the eastern side of Collins A venue at the northern end of Haulover Park, for a City entranceway sign; and WHEREAS, the City of Sunny Isles Beach is requesting permission from Miami-Dade County for use of a small portion of right-of-way for a City entrance sign. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authority to Request Permission from Miami-Dade County. The City Manager is authorized to request permission from Miami-Dade County for use of a portion of the County's right-of-way along the eastern side of Collins A venue at the northern edge of Haulover Park, for a City Entrance Sign. Section 2. Direction to the City Clerk. The City Clerk is directed to transmit this Resolution to Miami-Dade County seeking approval by the Board of County Commissioners. Section 3. First Street, Suite 1610 Miami, Florida 33128 -1970 Dear Mr. Hernandez: The City of Sunny Isles Beach would like the County's permission to use a small portion of County right -of -way along the eastern side of Collins Avenue at the northern end of Hau!over Park, just as you enter the City. We would like to install an entrance sign welcoming people to the City in this area, and the median is not wide enough for sign placement. It appears that we would only need to relocate a small section of split rail fencing to accomplish this project. Please advise as to what documentation you require to secure permission for this sign placement, which would be outside of FDOT right -of -way. We look forward to working with you on this important project. Dannheisser, City Attorney Richard Brown - Morilla, City Clerk We have received the attached letter from Aristides Rivera, the County's Public Works Director, regarding the City's request (see Resolution No. 2002 -453, adopted on June 20, 2002) to place a City entrance sign in a portion of the County's right -of -way along the eastern side of Collins Avenue at the northern edge of Haulover Park. Based on a conversation with James Watts, the County Public Works Department has concluded that the proposed site is located within the park and so our City's request was forwarded to the Parks and Recreation Department. Hasan of my staff contacted your Public Works Director, Mr. Jim Watts to obtain a sketch showing the location of the proposed sign. Mr. Watts clarified that this sign will be located inside the Haulover Park property and therefore, outside the Collins Avenue road right -of -way. As such, neither the Public Works Department nor the Florida Department of Transportation has the authority to permit the installation of said sign. Therefore, your request is being forwarded to Ms. Vivian Donnell Rodriguez, Director, Park and Recreation Department for her evaluation and direct response to you. Hasan of my staff contacted your Public Works Director, Mr. Jim Watts to obtain a sketch showing the location of the proposed sign. Mr. Watts clarified that this sign will be located inside the Haulover Park property and therefore, outside the Collins Avenue road right -of -way. As such, neither the Public Works Department nor the Florida Department of Transportation has the authority to permit the installation of said sign. First Street, Suite 2910 Miami, Florida 33128 -1994 Re: Entrance Feature Sign Dear Mr. Ginsburg: REECEIV J NO V 1 2002 f� City of Sunny Islas Beach Via Facsimile and U.S. Mail As you may know, the City of Sunny Isles Beach has requested permission from Miami - Dade County to install an entrance feature sign near the Sunny Isles walk path at the northern part of Haulover Beach. Mayor David Samson has spoken to Mayor Alex Penelas and County Manager Steve Shiver about the City's request. It is my understanding that Mayor Penelas and the County Manager are in agreement with the City's request providing that your office has no objection to the request. We do not believe that your office will have any objection to the request because it appears that the City's request is permissible under Article 6 of the County's Charter. A plain reading of Article 6 suggests that Article 6 precludes "permanent structures" or "commercial advertisement" signs. The entrance sign that the City plans to install is neither a permanent structure not a I commercial sign. Therefore, Article 6 does not apply in this case. Even if we assume that Article 6 is applicable in the instant case, the City's entrance sign would be permitted under the exceptions provided in Article 6. Arguably, the City sign would fall under the exceptions for appropriate monument and work of art. Without access to the legislative history of Article 6, it is very difficult for me to determine the purpose of Article 6. However, a plain reading of the entire Article clearly suggests that the purpose of Article 6 is to prevent the commercial exploitation of public property. Here, we are merely trying to promote a public purpose by providing a destination sign that will benefit the tourists in Miami -Dade County.
