HomeMy WebLinkAboutReso 2002-463 RESOLUTION NO. 2002- ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH SECTION 932.7055, F.S. TO EXPEND $21,876.00 FROM FORFEITURE FUNDS, FOR THE PURCHASE AND INST ALLA TION OF TWIN MERCURY BOAT ENGINES, INCLUDING PARTS AND LABOR; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Florida Statutes ~932.7055(4)(a) and (4)(b) specifically, a law enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less then 15% of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, school resource officer programs or for other law enforcement purposes; WHEREAS, in accordance with Florida Statutes ~932.7055(4)(a) and (4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsection; and WHEREAS, the Chief of Police has submitted a request for the expenditure of $21,876.00 in forfeiture funds in compliance with the aforementioned statute; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of forfeiture monies. Based on the attached certification, the Chief of Police is hereby authorized to spend $21,876,00 from the Law Enforcement Trust Fund for the purchase and installation of twin Mercury boat engines, including parts and labor. The vessel was older and needed some repairs. Over the past three years, the wear and tear from use has caused additional needs and repairs including the replacement of both engines. The vessel itself is extremely seaworthy and useful in law enforcement activities. The repairs and replacement equipment would ensure marine patrol coverage for many years to come, The requested expenditures are authorized under Florida law and are designed to enhance Community Policing and law enforcement within our city. Additional Information~ The existence and usefulness of a marine patrol by the police department has been a well-known community-policing tool highly accepted and appreciated by the residents of Sunny Isles Beach. In order to continue this practice and to ensure the safety of those residents who live in areas with water access and to control the safety of our waterways, it is recommended that the above expenditure be granted. TNT is a reputable dealer and service center used by numerous local law enforcement agencies, $21,876,00 Certification; I, Fred A.
