RESOLUTION NO. 2002- 475
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, APPROVING THE TEMPORARY WAIVER OF
SECTION 33-95(F) OF THE CITY CODE OF ORDINANCES AS ADOPTED
WITH CONDITIONS; PROVIDING FOR THE TEMPORARY WAIVER
THROUGH JANUARY 31, 2003; PROVIDING FOR PENALTIES;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is a major tourist destination in Florida; and
WHEREAS, tourist based businesses located in the city have suffered tremendous financial
hardships since the tragic events of September 11 th; and
WHEREAS, the City Commission wishes to stimulate the local economy by providing local
businesses with an opportunity to maximize advertisement;
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
]Section 1-1. Amnesty.
Notwithstanding anything to the contrary, the City of Sunny Isles Beach hereby declares a special
period for the temporary waiver of section 33-95(f) of the City of Sunny Isles Beach code of
ordinances for all businesses within the City. Specifically allowing temporary banner signs for
advertisement for a period not to exceed four months to be known as the "Amnesty Period". All
other sections of the City Code of Ordinances as adopted shall remain in full force and effect.
.Section 1-2. Conditions.
All such banner signs shall be subject to the review and approval of the Zoning Director of the
Planning, Zoning, and Building Department prior to their placement on any structure. The City
reserves the right to reject banner signs that may impose a threat to the general welfare of our
residents and visitors.
!Section 1-3. Penalties for Violation.
Notwithstanding the provisions of this Resolution, the Zoning Director, Building Official, and Code
Enforcement and Licensing Department Director may at all times continue enforcement of the
applicable Codes through any authorized means including issuance of a Warning Notice of Violation
and/or the issuance of a Civil Notice of Violation and associated penalties. This Resolution shall not
be construed or serve as a defense against any enforcement actions brought by any Department based
on other requirements of the code.
Section 1-4. Effective Period.
This amnesty period shall begin on the effective date of this Resolution and shall continue thru
January 31st, 2003. All affected business owners shall utilize for the referenced purposes and
immediately remove any such banner signs from their premises at the termination of the amnesty
period as stipulated herein.
Section 1-5. Severability.
If a court of competent jurisdiction declares any section, subsection, clause or provision of this
Resolution invalid or unconstitutional, the remainder shall not be affected by such invalidity.
