A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA, APPROVING A GUARANTEED MAXIMUM PRICE OF $1.5
MILLION DOLLARS FOR THE CONSTRUCTION OF THE TONY ROMA'S
RESTAURANT AND CERTAIN SITE WORK AND; APPROVING AN AMENDMENT
TO AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND THE
WEITZ COMPANY ATTACHED HERETO AS ATTACHMENT "A"; PROVIDING
THE MAYOR WITH THE AUTHORITY TO EXECUTE SAID AMENDMENT;
PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, by Resolution No. 2002-433, the City Commission approved a construction
agreement between the City and the Weitz Company for the construction of the new City Hall
and a new Tony Roma's restaurant; and
WHEREAS, the City Commission has the authority to approve the final guaranteed
maximum price for the new City Hall project as the plans are completed; and
WHEREAS, the architectural plans for the Tony Roma's restaurant and certain site work
are completed and the City wishes to proceed with the construction of the restaurant and certain
site work as soon as possible; and
WHEREAS, this resolution will become part of the contract documents referred in
Article 1 of the construction agreement upon approval of the City Commission.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Guaranteed Maximum Price. The City Commission hereby approves
the guaranteed maximum price of $1,555,746.00* for the construction of the new Tony Roma's
restaurant and certain site work, and grants the City Manager the authority to increase the
guaranteed maximum price by no more than ten percent (10%) of the total price. The guaranteed
maximum price is a sum total of the construction price for the restaurant ($1,108,146.00) and the
price for site work of the entire site ($447,600.00).
Section 2. Approval of Amendment. The City Commission hereby approves the Amendment
to the Agreement between the City and the Weitz Company for a guaranteed maximum price
and certain site work attached hereto as Attachment "A".
Section 3. Authority of Mayor. The City Commission hereby authorizes the Mayor to
execute said Amendment.
Section 4. Authority of City Manager. The City Commission hereby authorizes the City
Manager to do all things necessary to effectuate this Resolution.

Amendment No. 1 to Agreement Between Owner and Contractor
Pursuant to Article 4 and Article 5 of the Agreement, dated May 3, 2002 between the City of Sunny Isles Beach (Owner) and
The Weitz Company, LLC. (Contractor), for Tony Roma's Restaurant and Phase I Sitework (the Project), the Owner and
Contractor establish a Guaranteed Maximum Price and Contract Time for the Work as set forth below.
ARTICLE I
GUARANTEED MAXIMUM PRICE
The Contractor's Guaranteed Maximum Price for the Work, including the estimated Cost of the Work as defmed in Article 7 and the
Contractor's Fee as defined in Article 5, is One Million Five Hundred Fifty-Five Thousand Seven Hundred Forty-Six dollars
($1,555,746.00).
The Scope of work included in the Guaranteed Maximum Price above is the first phase of an anticipated two (2) phases of work. The
Project identified as Phase I, consists of a new Tony Roma's Restaurant shell only with exterior finishes and related site improvements
consisting of utility services to within 5 feet of the building, approximatley 51 parking spaces, and landscaping and irrigation around
the building.
This GMP is for the perfonnance of the Work in accordance with the Contract Documents listed and attached to this Amendment and
marked Exhibits A through D, as follows:

Drawings, Specifications, addenda and General, Supplementary and other Conditions of the Contract on which the
Guaranteed Maximum Price is based on page lA dated October 3, 2002.

Drawines dated Aueust 26. 2002. Addendum No. 01. and our Clarifications as
follows:
Div. 1 - General Services:
. We have included all of the costs to pay for temporary utility services, such as temporary power and water
consumption only during the construction of the shell.
. We have included a lump sum Contractor's Contingency of 5% of all Construction Cost.
Div.2 - Site Develooment:
. All demolition, earthwork, asphalt paving, concrete walks, pavers, curbing, landscaping, irrigation and site
utilities are included in this proposal for Phase I as an allowance.
. Dewatering is included at open construction pits only. No other site dewatering is included.
. Relocation or modification of existing monitoring wells is excluded.
. We have included two (2) Detention tanks and drainage wells as an allowance.
. We have included eight (8) catch basins in Phase I with the assumption the trench drain will be installed in
Phase II.
. We have included the costs for a portion of the brick pavers, landscaping & irrigation at the Collins Avenue
entrance in the Phase I budget, with the assumption the work will be completed after the existing Tony Roma's
in demolished and new City Hall structure is complete.
. A temporary road will be provided from the new Collins Avenue entrance to the West parking lot to be turned
over in Phase I. The road will be completed once the existing Tony Roma's is demolished. Cost for this
temporary road will be included in the Phase II budget.
Div. 3 - Concrete (Foundations and Structure):
. Includes 8" and 12" thick, exterior masonry bearing walls bear on continuous 24" to 48" wide 34" thick 3'
deep ribbon footings, 14" diameter, 30' deep auger piles and grade beams requiring no special soil
densification operations. 8" Concrete slabs on grade are included using 4000psi standard mix designs.
Div. 4 - Masonrv:
. All exterior walls are 8" and 12" thick, standard ASTM-C90, Grade N, Type II, Normal Weight masonry units;
reinforced as specified for design windloads, using 8" and 12" block and block lintels wherever design allows.
. Exterior glazed block to be Trenwyth Manufacture standard color.
. Interior glazed masonry block and supports are by tenant as specified.
. Decorative block for screen wall is "Demaco standard decorative block", 4" x 8" x 8", screen 810.

. Hollow metal exterior doors, hollow metal frames and hardware is included as specified.
. All exterior storefronts and windows are included as Arch Aluminum 3000 series Impact framing system
(bronze, clear or white) with 9116" tinted laminated Impact glass (bronze, gray or green). Window type "B" is
quoted as PGT Industries Impact Horizontal sliding window. Note, 12" tempered doors and sidelites have no
product approval for exterior installation.
. Doors "C2" include Y.." clear tempered glass.
. Automatic entrance hardware is excluded.

. Exterior wall finish is stucco over masonry block where specified.

Frames are fabricated out of schedule 40, aluminum pipe unpainted mill fmish with stainless steel hardware.
. The 3,500 square foot Dining Room membrane structure is made of a polyester pre-constraint fabric ref Soltis
manufactured by Ferrari. Our proposal does not include cost for certification of inspection approval by Florida
Building Code Inspector during and after installation.
Div. 15 - Mechanical. Fire Sprinklers & Plumbinl!:
. Plumbing consists of underground and overhead storm system to roof drains as indicated on Drawings P. 1.111
and P .1.121. Relocation of conflicting rain leaders or roof drains is excluded.
. Tony Roma's Construction Team must perform their interior portion of underground utilities prior to our
starting our slab on grade work.
. We have included cost in our proposal for one 1200 gal. grease interceptor.
. Site water, ftre line and detector valve, sanitary and storm utilities to within ftve foot of the new Tony Roma's
Building are included in our budget. All interior piping, plumbing ftxtures, sprinkler work and flow switches,
testing and certifications is by Tenant including tie-ins ftve foot outside the building.
. The complete HV AC system and all related piping, ductwork, insulation and support steel is by Tenant.
Div. 16 - Electrical:
. 310 linear feet empty conduit secondary electrical service is included from FPL' s transformer pad ordered and
contracted between the Owner and Florida Power and Light and located on site. We have also included the
other empty conduit work as indicated on drawing E.l.100.
. Phase I Site lighting is included as an allowance of $31,500.
. Empty conduit for site sign and Handicap Door are included.
It is assumed the Owner will provide and pav for the followinl! if applicable:
1. Impact fees, fees for general building, special permits and applicable trade permits other than those specifically
named in the estimate.
2. Costs for any special easement agreements or other accessibility issues with neighboring property owners, if
applicable.
3. Relocating existing exterior gas service and gas meter if applicable.
4. Costs associated with new/revised primary electric service.
5. Removal, storage, installation or relocation of Tony Roma' s existing or new furnishings and equipment.
6. We assume no demucking or other unsuitable in situ soil materials, as well as replacing with acceptable
materials if required.
7. Removal of any hazardous materials (I.E. - Asbestos, Contaminated soils, buried Fuel tanks).
8. Utility Connection Fees and permanent Meters and cost of water meter or deposits.
9. Costs of Special Inspection Services and Threshold Building Inspection Services (if required).
