A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING RESOLUTION
NO. 2002-420; APPROVING AMENDMENT NO. 1 TO
CONSULTANT AGREEMENT BETWEEN THE CITY OF SUNNY
ISLES BEACH AND BEISWENGER, HOCH AND ASSOCIATES,
INC. (BH&A), FOR CONSTRUCTION ENGINEERING
INSPECTION SERVICES, ATTACHED HERETO AS EXHIBIT
"A", IN THE AMOUNT NOT TO EXCEED SEVENTY-FIVE
THOUSAND DOLLARS ($75,000.00)*, FOR THE GOLDEN
SHORES DRAINAGE AND STREETS IMPROVEMENT
PROJECT; PROVIDING THE CITY MANAGER THE
AUTHORITY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THE AMENDMENT TO CONSULTANT
AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach entered into a Miscellaneous
Consultant Services Agreement for various engineering related projects b esolution
No. 2001-384, with Beiswenger, Hoch and Associates, Inc. (BH&A); an
WHEREAS, on February 21, 2002, by Resolution No.2 02-420, the City of
Sunny Isles Beach entered into agreement with BH&A for the G den Shores Drainage
and Streets Improvements Project; and
WHEREAS, the City wishes to amend the agreement, attached hereto as Exhibit
"A", with BH&A, in the amount not to exceed Seventy-Five Thousand Dollars
($75,000.00)*, for Construction Engineering Inspection Services to complete the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment to Consultant Agreement. The Amendment to
the Consultant Agreement between the City of Sunny Isles Beach and Beiswenger, Hoch
and Associates, Inc., for Construction Engineering Inspection Services, in the amount not
to exceed $75,000.00*, attached hereto as Exhibit "A", for the Golden Shores Drainage
and Streets Improvement Project, is hereby approved.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to
do all things necessary to amend said Consultant Agreement and do all things necessary
to effectuate the terms of this Amendment to Consultant Agreement.
Section 3.

R2002- Amendment to Consultant Agreement with BH&A 2
AMENDMENT NO.1
TO
CITY OF SUNNY ISLES BEACH
GOLDEN SHORES DRAINAGE SYSTEM
PROJECT OVERSIGHT CONSULTANT AGREEMENT
RECITALS:
WHEREAS, by Agreement dated February 26, 2002, the City of Sunny Isles Beach
employed Beiswenger Hoch & Associates as Project Oversight Consultant ("Consultant") for the
Golden Shores Drainage System ("Project"); and
WHEREAS, said Project and subsequent Consultant Agreement ("Agreement")
referenced above, was approved by the City Commission by Resolution No. 2002-420; and
WHEREAS, due to unforeseen and undisclosed conditions and inclement weather
conditions the Project incurred numerous delays will now require additional time and expense
for completion, more specifically indicated in Exhibit "A" attached hereto and made a part
hereof; and
WHEREAS, pursuant to Paragraph 3 of said Agreement the parties hereto agree to
extend the reference contract through November 30, 2002, with additional compensation to
Consultant, for the period September 12, 2002 through November 30, 2002, in the estimated
amount of Seventy-Five Thousand and No/lOO Dollars ($75,000.00) to complete the project;
and
WHEREAS, by Resolution 2002- 4- ,~ , dated November 14, 2002, the City
Commission approved an extension of this Agreement and fees related thereto;
NOW THEREFORE, in consideration of the foregoing and for the mutual covenants,
representations and warranties and other good and valuable consideration, the receipt and
adequacy of which is hereby acknowledged, the parties agree as follows:
1. RECITALS. The Recitals set forth above are hereby incorporated into this
Agreement and mad a part hereof for reference.
2. TERM. The completion date for the Project under Agreement dated February 26,
2002, is hereby extended to November 30, 2002.
3. COMPENSATION. Payment to Consultant for all charges and tasks under this
Agreement shall be in accordance with Exhibit "A," attached hereto and made a part
hereof, for a total sum due to completion of Seventy-Five Thousand and No/tOO
Dollars ($75,000.00).
4. AGREEMENT TO AMEND CONTRACT. The parties hereto agree to amend this
contract in accordance with the revised fee and completion schedule attached hereto
as Exhibit "A" and incorporated herein by reference. All other terms and conditions
of the Agreement, dated February 26, 2002, remain the same.
