HomeMy WebLinkAboutReso 2002-502 RESOLUTION NO. 2002- 5 O~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND CARROL BURACKER AND ASSOCIATES, INC. ("CBI") TO DEVELOP A PUBLIC SAFETY MASTER PLAN, MANUAL OF PROCEDURES, DISASTER PLAN AND ACCREDITATION STANDARDS, IN AN AMOUNT OF $298,850.00; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is interested in developing a multi-faceted public safety master plan for the future delivery of police services; and WHEREAS, this plan would include the following project phases: a Comprehensive Police Master Plan, including an emergency dispatch element; a Police Department Policy Manual; a Disaster Response Plan; and technical assistance to and written directives for the police department; and WHEREAS, CBI, a firm experienced in public safety master planning and related activities, has agreed to undertake this project, submitting a proposal with individual and total package pricing options; and WHEREAS, staff recommends the total package option, as it would be cost beneficial to the city. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Agreement. The agreement between the City of Sunny Isles Beach and Carroll Buracker and Associates, Inc., attached hereto as Exhibit "A," in the amount of Two Hundred Ninety-Eight Thousand Eight Hundred Fifty Dollars ($298,850.00), is hereby approved. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this agreement. Section 3. Effective Date. WHEREAS, Consultant is a public safety consulting firm experienced In the development of law enforcement master plans for police and public safety agencies; and WHEREAS, the City wishes to employ Consultant to advise and assist with respect to the development of a multifaceted public safety master plan more specifically described in Exhibit "A," attached hereto and made a part hereof; and, WHEREAS, the Consultant is qualified, willing and able to provide the desired services on the terms and conditions set forth herein; NOW THERFORE, in consideration of the premises and the mutual covenants herein named, the parties hereto agree as set forth below: 1. RECIT ALS. The Recitals set forth above are hereby incorporated into this Agreement and made a part of hereof for reference. 2. SERVICES TO BE PERFORMED. Consultant shall perform the following services: a. Specialized assistance in developing a multi-faceted public safety master plan for the delivery of police services and to assist the City in public safety master planning for the growth and redevelopment of Sunny Isles Beach, as well as those services more particularly described in Exhibit "A" attached hereto and made a part hereof. b. Consultant will prepare and present oral reports as needed or as requested on a periodic basis while engaged in special projects. Consultant shall provide, on a monthly basis, to the City Manager, a detailed narrative report delineating all services provided by the Consultant in the previous month. The Consultant shall also provide quarterly, written reports, detailing all of the Consultant's activities in the previous quarter and the results of the Consultant's efforts. Each report required herein will be submitted to the attention of the City Manager. c. The total price for these services is Two Hundred Ninety-Eight Thousand Eight Hundred Fifty and No/IOO ($298,850.00), payable monthly, as invoiced. 3. TERM. Subject to the provisions relating to the termination of this Agreement as set forth in Paragraph 8 hereunder, the term of this Agreement shall be from December 15, 2002, to December 15, 2003, and shall begin within ten (10) days after notification to proceed. Any change in fee, terms or conditions shall be accomplished by written amendment to this contract. Police Consulting Agreement - Carroll Buracker & Assocs. Payment to Consultant for all charges and tasks under this Agreement shall be in accordance with this Agreement and the schedule of charges reflected in Exhibit "A", which fee shall be disbursed on a monthly basis and under the following conditions: a. Disbursements. There are no reimbursable expenses associated with this contract. b. Payment Schedule. Invoices received from the Consultant pursuant to this Agreement will be reviewed by the initiating City Department. If services have been rendered in conformity with the Agreement, the invoice will be sent to the Finance Department for payment. Invoices must reference the contract number assigned hereto. Invoices will be paid in accordance with the State of Florida Prompt Payment Act. c. Availability of Funds. The City's performance and obligation to pay under this Agreement is contingent upon an annual appropriation for its purpose by the City Commission. d. Final Invoice. In order for both parties herein to close their books and records, the Consultant will clearly state "final invoice" on the Consultant's final/last billing to the City. This certifies that all services have been properly performed and all charges and costs have been invoiced to the City. Since this account will thereupon be closed, any and other additional charges, if not properly included on this final invoice are waived by the Consultant. Consultant shall make no other charges to the City for supplies, labor, taxes, licenses, permits, overhead or any other expenses or costs unless any such expense or cost is incurred by Consultant with the prior written approval of the City. If the City disputes any charges on the invoices, it may make payment of the uncontested amounts and withhold payment on the contested amounts until they are resolved by agreement with Consultant. Consultant shall not pledge the City's credit or make it a guarantor of payment or surety for any contract, debt, obligation, judgment, lien, or any form of indebtedness. The Consultant further warrants and represents that it has no obligation or indebtedness that would impair its ability to fulfill the terms of this Agreement. 5. UNDISCLOSED CONDITIONS. In the event that undisclosed conditions are discovered during the performance of this Agreement, the City shall have the right to cancel this Agreement upon thirty (30) days written notice to Consultant. Upon termination, the City may re-bid the project if the Consultant fails to perform under this Agreement due to the undisclosed conditions. 6. INDEPENDENT CONSULTANT RELATIONSHIP. The Consultant is an independent Consultant and shall be treated as such for all purposes. Nothing contained in this 2 Police Consulting Agreement - Carroll Buracker & Assocs. A:/ch P-I - - , - , ., (305) 947-0606 phone (305) 949-3 I I3 Fax agreement or any action of the parties shall be construed to constitute or to render the Consultant an employee, partner, agent, shareholder, officer or in any other capacity other than as an independent Consultant other than those obligations which have been or shall have been undertaken by the City, Consultant shall be responsible for any and all of its own expenses in performing its duties as contemplated under this agreement. The City shall not be responsible for any expense incurred by the Consultant. The City shall have no duty to withhold any Federal income taxes or pay Social Security services and that such obligations shall be that of the Consultant, other than those set forth in this agreement. Consultant shall furnish its own transportation, office and other supplies as it determines necessary in carrying out its duties under this agreement. 7. INSURANCE. Consultant shall, at its sole cost and expense, during the period of any work being performed under this Agreement, procure and maintain the following minimum insurance coverage to protect the City and Consultant against all loss, claims, damage and liabilities caused by Consultant, its agents, Consultants or employees, as more particularly set forth below: a. Comprehensive General liability insurance -- including broad form contractual liability coverage for all operations, including, but not limited to, contractual, products, and completed operations, personal injury and property damage liability with limits of One Million Dollars ($1,000,000) combined single limit occurrence. b. Business Automobile Liability which shall include coverage for all owned, non- owned and hired vehicles for limits of not less than $500,000 per occurrence, Combined Single Limit or its equivalent. Insurance required of the Consultant shall be primary to, and not contribute with, any insurance or self-insurance maintained by the City. Such insurance shall not diminish Consultant's indemnification and obligations hereunder. The insurance policy(ies) shall be issued by companies authorized to do business under the laws of the State of Florida and acceptable to the City. Before any work under this Agreement is performed, and at any time upon request, Consultant shall furnish to the City certificates of insurance evidencing the minimum required coverage and shall be appropriately endorsed for contractual liability, with the City named as additional insured. All policies shall contain a waiver of subrogation endorsement. All policies and certificates shall be in forms and issued by insurance companies acceptable to the City's Risk Management Department. All insurance policies and certificates of insurance shall provide that the policies may not be canceled or altered without thirty (30) days prior written notice to the City. The City reserves the right from time to time to change the insurance coverage and limits of liability required to be maintained by Consultant hereunder. 3 Police Consulting Agreement - Carroll Buracker & Assocs. A:lch P-I (305) 947-0606 phone (305) 949-3113 Fax Consultant shall also require and ensure that each of its sub-consultants providing services hereunder (if any) procures and maintains, until the completion of the services, insurance of the types and to the limits specified herein. ANY EXCEPTIONS TO THE INSURANCE REQUIREMENTS IN THIS SECTION MUST BE APPROVED IN WRITING BY THE CITY. 8. OWNERSHIP OF DOCUMENTS AND EQUIPMENT. All documents prepared by the Consultant pursuant to this agreement and related services to this agreement are intended and represented for the ownership of the City only. Any other use, by Consultant or other parties, shall be approved in writing by the City. Consultant shall deliver to the City for approval and acceptance, and before being eligible for final payment or any amounts due, all documents and materials prepared by, and for, the City under this Agreement. All oral and written information not in the public domain or not previously known, and all information and data obtained, developed or supplied by the City, or at its expense, will be kept confidential by the Consultant and will not be disclosed to any other party, directly or indirectly, without the City's prior written consent, unless required by a lawful order. All drawings, maps, sketches, programs, data base, reports and other data developed or purchased under this Agreement for, or at the City's expense, shall be and remain the City's property and may be reproduced and reused at the discretion of the City. The City and Consultant shall comply with the provisions of Chapter 119, Florida Statutes (Public Records Law). All covenants, agreements, representations and warranties made herein, or otherwise made in writing by any party pursuant hereto, including, but not limited to, any representations made herein relating to disclosure or ownership of documents, shall survive the execution and delivery of this Agreement and the consummation of the transactions contemplated hereby. 9. INDEMNIFICATION. Consultant agrees to indemnify and hold harmless, the City, its officers, agents, and employees from, and against any and all claims, actions, liabilities, losses and expenses including, but not limited to, attorney's fees for personal, economic or bodily injury, wrongful death, loss of or damage to property, at law or in equity, which may arise or may be alleged to have risen from the negligent acts, errors, omissions or other wrongful conduct of the Consultant, agents or other personal entity acting under Consultant's control in connection with the Consultant's performance of services pursuant to that agreement and to that extent the Consultant shall pay such claims and losses and shall pay all such costs and judgments which may issue from any lawsuit arising from such claims and losses including wrongful termination or allegations of discrimination or harassment, and shall pay all costs and attorneys' fees expended by the City in defense of such claims and losses including appeals. A:/ch P-I - - (305) 947-0606 phone (305) 949-3113 Fax that ten percent (10%) of the total compensation is a specific consideration from the City to the Consultant for this indemnity. 10. TERMINATION. a. If, through any cause within the reasonable control the Consultant shall fail to fulfill in a timely manner or otherwise violate any of the covenants, agreements or stipulations material to this agreement, the City shall have the right to terminate the services then remaining to be performed. Prior to the exercise of its option to terminate for cause, the City shall notify the Consultant of its violation of the particular terms of the agreement and grant Consultant ten (10) days to cure such default. If the default remains uncured after ten (10) days the City may terminate this agreement. 1. In the event of termination, all finished and unfinished documents, data and other work product prepared by Consultant (and sub- Consultant[s]) shall be delivered to the City and the City shall compensate the Consultant for all services satisfactorily performed prior to the date of termination, as provided in Paragraph 4 herein. 11. Notwithstanding the foregoing, the Consultant shall not be relieved of liability to the City for damages sustained by it by virtue of a breach of the agreement by Consultant and the City may reasonably withhold payments to Consultant for the purposes of set-off until such time as the exact amount of damages due the City from the Consultant is determined. 111. After receipt of a Termination Notice and except as otherwise directed by the City, the Consultant shall: 1. Stop work on the date and to the extent specified. 2. Terminate and settle all orders and subcontracts relating to the performance of the terminated work. 3. Transfer all work in process, completed work and other materials related to the terminated work to the City. 4. Continue and complete all parts of that work that have not been terminated. b. Termination for Convenience of City. The City may, for its convenience and without cause terminate the services then remaining to be performed in the event the Consultant 5 Police Consulting Agreement - Carroll Buracker & Assocs. Termination for Insolvency. The City also reserves the right to terminate the remaining services to be performed in the event the Consultant is placed either in voluntary or involuntary bankruptcy or makes any assignment for the benefit of creditors. 11. ASSIGNMENTS. TRANSFERS. SUBCONTRACTING. The Consultant shall not subcontract, assign or transfer any work under this agreement without the prior written consent of the City. Should the Consultant subcontract any services under this agreement, it shall be done with continued liability for the Consultant. The Consultant shall remain responsible for services, responsibilities and liabilities of any person or entity acting under Consultant. 12. TIME OF COMPLETION. The services to be rendered by the Consultant shall be commenced upon execution of this contract and shall be completed within the time specified in this Agreement. A reasonable extension of time shall be granted in the event the work of the Consultant is delayed or prevented by the City or by circumstances beyond the reasonable control of the Consultant including weather conditions of acts of God which render the performance of the Consultant's duty impracticable. 13. AUTHORITY TO PRACTICE. Consultant hereby represents and warrants that it has and will continue to maintain all licenses and approvals required to conducts its business and that it will at all times conduct its business activities in a reputable manner. Proof of such licenses and approvals shall be submitted to the City prior to commencement of work under this Agreement. 14. MODIFICATIONS OF WORK. The City reserves the right to make changes in the work, including alterations, reductions or additions thereto. Upon receipt of the City's notification of a contemplated change, the Consultant shall (I) if requested by the City, provide an estimate for the increase or decrease in cost due to the contemplated change, (2) notify the City of any estimated change in completion date, and (3) advise the City in writing if the contemplated change shall affect the Consultant's ability to meet the completion dates or schedules of this Agreement. 15. COORDINATION OF SERVICES. The City's representative/liaison during the performance of this Agreement shall be Christopher J. Russo, City Manager, telephone number 305/947-0606. Consultant shall not respond to requests for services under this Agreement unless the request is received directly from Christopher J. Russo or designated personnel. Any requests received from other City departments/divisions shall be referred to the City Manager's Department representative designated above. Services performed without authorization by Christopher J. Russo, City Manager, shall be considered unauthorized and shall not be compensated/paid by the City. 6 Police Consulting Agreement - Carroll Buracker & Assocs. It is the intention of the parties that whenever possible, if a dispute or controversy arises hereunder then such dispute or controversy shall be settled by arbitration in accordance with the procedures, rules and regulations of the American Arbitration Association. The decision rendered by the Arbitrator shall be final and binding upon the parties and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Arbitration shall be held in Miami-Dade County, Florida. The non-prevailing party shall pay all costs of arbitration and attorneys' fees incurred by the parties or, if neither party prevails on the whole, each party shall be responsible for a portion of the costs of arbitration and their respective attorneys' fees as may be determined by the court on confirmation. 17. CONFIDENTIAL INFORMATION. The Consultant shall not, either during the term of this Agreement or any time for a period ofTen (10) years subsequent to that date upon which the Consultant shall leave the employment of the City for any reason whatsoever, disclose to any person or entity, other than in the discharge of the duties of the Consultant under this Agreement, any information which the City designates in writing as "confidential." As a violation by the Consultant of the provisions of this Section could cause irreparable injury to the City and there is no adequate remedy at law for such violation, the City shall have the right, in addition to any other remedies available to it at law or in equity, to enjoin the Consultant in a court of equity for violating such provisions. 18. NOTICES. All notices and communications hereunder shall be in writing and shall be deemed given when sent postage prepaid by registered or certified mail, return receipt requested and, if intended for City to Christopher J. Russo, City Manager, with a copy to Lynn M. Dannheisser, City Attorney, City of Sunny Isles Beach, 17070 Collins Avenue, Suite 250, Sunny Isles Beach, Florida 33160, and, if intended for Consultant, shall be addressed to Carroll Buracker, President, 1881 College Avenue, Suite 100, Harrisonburg, VA 22802. Telephone 540/564-1500~ Fax 19. GOVERNING LAW. The validity of this Agreement and the interpretation and performance of all of its terms shall be construed and enforced in accordance with the laws of the State of Florida, without regard to principles of conflict of laws thereof. The location of any action or proceeding commenced under or pursuant to this Agreement shall be in Miami-Dade County, in the State of Florida. 20. AUDIT. The Consultant shall make available to the City or its representative all required financial records associated with the Agreement for a period of Three (3) years. 21. NON-DISCRIMINATION. The Consultant agrees to comply with all local and state civil rights ordinances and with Title VI of the Civil Rights Act of 1984 as amended, Title VIII of the Civil Rights Act of 1968 as amended, Title I of the Housing and Community Development Act of 1974 as amended, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, Executive Order 11063, and with Executive Order 11248 as amended by Executive Orders 11375 and 12086. 7 Police Consulting Agreement - Carroll Buracker & Assocs. A:lch P-I . -- (305) 947-0606 phone (305) 949-3113 Fax The Consultant will not discriminate against any employee or applicant for employment because of race, color, creed, religion, ancestry, national origin, sex, disability or other handicap, age, marital/family status, or status with regard to public assistance. The Consultant will take affirmative action to insure that all employment practices are free from such discrimination. Such employment practices include but are not limited to the following: hiring, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, termination, rates of payor other forms of compensation, and selection for training, including apprenticeship. The Consultant agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City setting forth the provisions of this non- discrimination clause. The Consultant agrees to comply with any Federal regulations issued pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 D.S.C. 708), which prohibits discrimination against the handicapped in any Federally assisted program. 22. CONFLICT OF INTEREST. The Consultant agrees to adhere to and be governed by the Miami-Dade County Conflict of Interest Ordinance Section 2-11.1, as amended; and by Sunny Isles Beach Ordinance No. 99-82, which are incorporated by reference herein as if fully set forth herein, in connection with the Agreement conditions hereunder. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirectly that should conflict in any manner or degree with the performance of the services. 23. CONFLICTING PROVISIONS. The terms and conditions in this agreement supersede any other conflicting provisions that are contained in any other document. 24. MISCELLANEOUS. a. The rights granted to Consultant hereunder are nonexclusive, and the City reserves the right to enter into agreements with other persons or firms to perform services including those provided hereunder. b. Consultant and its employees shall promptly observe and comply with applicable provisions of all published federal, state and local laws, rules and regulations which govern or apply to the services rendered by Consultant hereunder, or to the wages paid by Consultant to its employees. c. Consultant shall obtain and keep in force during the term of this Agreement all necessary licenses, registrations, certificates, permits and other authorizations as are required by law in order for Consultant to render the service(s) required hereunder. d. Consultant shall not use the name or official seal of the City in any promotional material without the prior written consent of the City. 8 Police Consulting Agreement - Carroll Buracker & Assocs. Except as expressly provided for in this Agreement, Consultant is not authorized to act as the City's Agent hereunder and shall have no authority, expressed or implied, to act for or bind the City hereunder, either in Consultant's relations with sub-Consultants, or in any other manner whatsoever. 25. ENTIRE AGREEMENT. This Agreement and Attachment Exhibit "A," which is expressly incorporated herein by reference, shall constitute the entire agreement between the parties with respect to the subject matter hereof, and it shall supersede all previous and contemporaneous oral and written negotiations, commitments, agreements and understanding relating hereto. This Agreement may be executed in multiple identical counterparts, each of which shall be deemed an original for all purposes. 26. AMENDMENT. Any modification of this Agreement shall be effective only if in writing and signed by the parties to this Agreement. No waiver of any provision of this Agreement shall be valid or enforceable unless such waiver is in writing and signed by the parting granting such waiver. The focus ofthe plans is to assist City officials in public safety master planning for the growth and redevelopment taking place in Sunny Isles Beach. Specifically, the project phases of the master planning are as follows: 1. Develop a Comprehensive Police Master Plan, including an emergency dispatch element, relative to the current and future requirements of the Sunny Isles Beach Police Department; Develop a state-of-the-art Police Department Policy Manual; Develop a Disaster Response Plan; and, Provide technical assistance to and develop written directives for the Sunny Isles Beach Police Department to be accredited through the national Commission on Accreditation for Law Enforcement Agencies (CALEA). 2. 3. 4. The police master plans by CBI incorporate the projected growth in the cities, including the current and projected commercial, residential, and recreational development. Two of the three largest cities in the U.S. have retained the firm to evaluate emergency dispatch: the City of Los Angeles and the City of Chicago. The City of Los Angeles selected the firm to redo an emergency dispatch study that had been conducted by another consulting firm. When the City of Chicago wanted its new $215 million police/fire/EMS emergency communications system and facilities evaluated to determine whether the system functions as implemented by 12 major vendors, the city selected Carroll Buracker & Associates, Inc. The firm has also evaluated emergency dispatch in municipalities with populations of 12,000. Carroll Buracker co-chaired the development of the Washington, D.C. Metropolitan Area (District of Columbia, Virginia, Maryland) Disaster Response Plan, which has been implemented on multiple occasions. Accreditation of Police A&encies Carroll Buracker & Associates, Inc. has assisted in and coordinated the development of accreditation standards and provided on-site accreditation technical assistance for eight (8) federally funded police departments through the Commission on Accreditation for Law Enforcement Agencies (CALEA) for the U.S. Government. Coordinated Police & Security A police department master plan and disaster response plan for the City of Sunny Isles Beach by Carroll Buracker & Associates, Inc. will include the resources available for public safety, including the public and private sectors. The firm has evaluated corporate and private security for foundations, corporations, city governments, and the Federal government. CBI recently developed a Coordinated Law Enforcement and Security Master Plan for the Seattle South Downtown Foundation. This plan and technical assistance to implement the plan followed the WTO and Mardi Gras problems in downtown Seattle. Based on an attached letter from Seattle officials, the plan has been and will continue to be implemented. Implementation of Plans The written recognition of the work performance ofCBI indicates that municipalities and the Federal government have implemented up to 90 percent of the recommendations in police department master plans. "- CBI was selected on a competitive bid by the U.S. Department of Housing & Urban Development to evaluate law enforcement and private security services to public housing residents in seven major U.S. cities; the budget was $1.5 million. HUD also selected CBI on a competitive bid for a $7.5 million, five-year grant to manage the upgrading of policing in 10 federally funded agencies. The letter from a HUD official reflects the activities of those agencies in implementing the plans. Community Policin& Carroll Buracker served as the project manager and executive producer for the first nationwide community policing training video on 'Best Practices' and "How to set up a Community Policing Program." He has authored more than 200 public safety plans for police departments, sheriffs' departments, fire departments, security departments, emergency dispatch departments, and downtown improvement districts within municipalities. Mr. Buracker has 22 years of practical police experience, having served in all divisions and ranks of the Fairfax County Police Department--patrol officer, detective, sergeant, lieutenant, captain, major, deputy chief, and chief. As the Chief of Police for the Fairfax County Police Department, the largest police agency in the State of Virginia, he managed more than 1,400 employees serving more than 700,000 residents. As the Chief of Police, Mr. Buracker received the county governing board's two highest awards for management excellence. He served as the chairman of the Metropolitan Washington D.C. Police Chiefs Steering Committee of the Council of Governments; this committee consisted of 16law enforcement agenCIes. Mr. Buracker co-chaired the development of the Washington D.C. Metropolitan Area's Disaster Response Plan for the Council of Governments (COG), which includes the District and local governments in the region from two states. This plan has been implemented on several occasions, including the 9/11 tragedy in 2001. A graduate of the FBI National Academy, Mr. Buracker holds a B.S. Degree in Police Administration and an M.S. Degree in the Administration of Justice from the American University in Washington, D.C. Adams Mr. Adams, the former Deputy Fire Chief of the Montgomery County, Maryland Fire and Rescue Department, has 28 years of emergency management and dispatch experience. He has served as the operations deputy fire chief of a fire department that serves 850,000 residents. During his career, he managed the Montgomery County emergency dispatch center. Mr. Adams has served as a public safety consultant with Carroll Buracker and Associates, Inc. for 10 years in 41 cities and counties. In emergency and dispatch master planning by CBI, Mr. Adams has served as a consultant. Mr. Adams has served as the Chairman of the International Association of Fire Chiefs (IAFC) Personnel Mana&ement Committee. P""' He holds a B.S. in Business Administration from the Columbia Union College, and has completed course work on a Masters degree in General Administration. Develop a Police Department Master Plan with Dispatch Element We will develop a Police Department Master Plan that relates to the current services and the anticipated needs of the department in the next 10 years. The plan will be based on current and projected growth in the City; current and future practices, programs, staffing, structure, equipment, automation, costs, initiatives, stakeholder input; and the anticipated demands on the police department over the next 10 years. The plan will include state-of-the-art plans and activities within the department and those that the city/department may wish to consider for the future. CBI plans to develop the Police Department Master Plan within four months. 2. Develop a Police Department Policy Manual ""- We will develop a model police policy manual that incorporates the department's existing policies, revise existing policies as necessary, develop new policies as needed, reformat the structure of the policies to be consistent with CALEA standards, and submit the policies for approval by the Chief of Police. CBI plans to submit the manual within four months. 3. Develop a Disaster Response Plan We will develop a Disaster Response Plan that can serve as a stand-alone action document relative to managing natural or manmade disasters. CBI plans to submit the Disaster Response Plan within four months. 4. Provide technical assistance to and develop written directives for the Sunny Isles Beach Police Department to be accredited through the national Commission on Accreditation for Law Enforcement Agencies (CALEA). We will provide orientation training for police members assigned to CALEA accreditation, and prepare a draft a directive/memorandum on each CALEA standard that applies to the City of Sunny Isles Beach Police Department. It is anticipated that many of these standards would be developed in conjunction with the police policy manual. In fact, the standards relating to a Written Directive System are essential as the first step. A number of the CALEA standards require a policy on specific practices; therefore, the policy would be inserted in the file folder corresponding to the CALEA standard. It should be noted that developing the written directives/forms/ for each standard will not result in automatic accreditation. The Sunny Isles Police Department staff would have to prove compliance with the standards in an on-site review by CALEA assessors outside the State of Florida before gaining accreditation; this proof of compliance typically involves copies of reports/forms/documents in each of the CALEA file folders. Moreover, the police department would be required to train all personnel on the policies/directives related to CALEA accreditation. The final time line for assuring compliance with the CALEA standards and training should be established by the Chief of Police ofthe City of Sunny Isles Beach. This could take from an additional six to 12 months, depending on the resources and priorities set by police administration. -.. The policies relative to CALEA accreditation and a manual would be provided to the department for approval. Phase I: Data Collection In this phase, we will collect data relating to the City of Sunny Isles Beach, including the police department, relative to growth, law enforcement services, workload, and staffing. During this phase, we will interview key personnel in Sunny Isles Beach, including the City Manager, the Mayor and other members of the Commission, members of the Finance Committee, Human Resources director, Police Chief, police lieutenants, police sergeants, police corporals, detectives, officers, dispatchers, clerical, area law enforcement officials, area fire/EMS officials, and area medical professionals. In addition, we would like. to interview a number of stakeholders: residents. business officials. developers. and civic group representatives. We believe input from those receiving the services and paying for emergency services should be afforded maximum opportunity to provide input relative to the current system and the future expectations and needs of the police department and the City of Sunny Isles Beach. Phase III: On-site Observations and Fact-findin& In this phase, we will conduct on-site observations of police personnel in the workplace. We have found in our experiences that police personnel like to talk about their work if the setting is appropriate. Phase IV: Analysis of Data In the fourth phase of our review, we will analyze the data from written directives, interviews, workload, crimes, service spectrum, efficiency, and on-site observations and fact finding. The analysis will cover the Master Plan, Police Policy Manual, Dispatch Element of the Master Plan, and CALEA accreditation standards. Phase V: Comparative Analysis -, In this phase, we will compare our findings and observations of the City of Sunny Isles Beach Police Department with trends and industry standards in the field oflaw enforcement. Since our staff have assisted in the development of accreditation standards, assisted in the accreditation of police departments and worked with elected officials, administrators, stakeholders, and law enforcement officials throughout the United States, we offer the City of Sunny Isles Beach unique credentials in the area of comparative analysis. A key component of this phase is to recognize the strengths of the Sunny Isles Beach Police Department. We have no pre-conceived notion about the management style or operations of the police department, and we have no personal knowledge of anyone working for the City of Sunny Isles Beach Police Department. Phase VI: Alternatives and Recommendations In the sixth phase, we will consider whether alternatives would be in the best interest ofthe City of Sunny Isles Beach. '"" 12 A PROPOSAL TO THE CITY OF SUNNY ISLES BEACH: Public Safety Master Planning While there are some common indicators of organization and staffing requirements, we recognize that each municipality has its own distinct characteristics and environment that must be considered in assessing service delivery and considering alternatives. Additionally, Carroll Buracker & Associates, Inc. will be in contact with City officials and Project Team members throughout the project to assure communication and gain the necessary concurrence with our conclusions before finalizing the plans, policy manual, and CALEA standards. Phase VII: Comprehensive Written Plans/Manual/CALEA Standards During this phase, we will provide the City of Sunny Isles beach with well-documented plans, manual, and directives related to CALEA standards. The plans will contain an implementation timetable anchored to recommendations and associated costs and/or savings to each. We will present data in easy-to-read graphic charts, as well as table formats. Our firm has extensive experience in the presentation of data for management decisions and public understanding. Phase VIII: Oral Briefin& Once the plans, manual and policies related to the CALEA standards are completed, we will provide an oral briefing to City Officials. Our staff has considerable experience in briefings of this nature. Project Time Line Figure 2 represents CBI's best judgement for a time line to complete the outlined tasks. A final time line will, of course, be arranged to best suit the needs of the City of Sunny Isles Beach and law enforcement officials. It is anticipated that the Police Master Plan, including the Dispatch Element, and the Disaster Response Plan will be completed within four months. Provide all requested information that is available; Assign a designate from the City to work with CBI for development of the plans; Apply for CALEA accreditation in early December 2002 with the application fee to receive the CALEA ASAP software for development of the standards; Assign a member of the police department full time to the accreditation program and designate a police supervisor to coordinate with CBI staff for preparation of the policy manual and directives related to CALEA standards (an accreditation manager is required for accreditation); Assist in setting meetings with city personnel, developers, and other stakeholders; Provide suitable work space within City Hall to conduct interviews and review City/Police Department records; Review policies, procedures and directives as developed by CBI in a timely manner; Train police members on policies, procedures and CALEA directives (may require refocus of current training initiatives); and, Complete the accreditation process~ to include relevant documents to show proof of compliance (CALEA software-ASAP, ISSR reports) and a mock assessment, once CBI has completed the orientation assistance and develop files with draft standards. 4. 5. 6. 7. 8. 9. Weare submitting the costs for each individual phase under Option A and a combined package under Option B. Since travel and time for interviews would be less if the tasks were completed simultaneously, there seem to be major cost savings to the City when comparing the individual costs of each task. Moreover, and most importantly, there should be less time on the police staff, City staff, and stakeholders if the plans and policies are developed concurrently. Additional benefits should result from a 'seamless' approach to public safety master planning and policies/directives to guide the agency into the future. I have recently returned from the meeting in Knoxville, Tennessee. where two more departments achieved this prestigious, international status with CPS' support. In 1996, you involved CALEA when the U.S. Department of Housing & Urban Development (OOD) awarded monetary grants to ten housing authority police departments. The careful selection of CPS for provision of technical assistance and grant monitoring was a wise decision. Among the grant requirements. each recipient had to apply for, and complete. the accreditation program. Factoring in CPS' intimate knowledge of accreditation. both HUD and the recipient agency benefited. For HUD, effective results could be tracked and monitored. For the applicant agency. a blueprint was provided for achieving professional status, with an added reward of international recognition when the job was done. Early on. the talented, professional staff at CPS engaged CALEA, co-opting a successful partnership between our organizations and the participating agency. The resulting triage was mutually beneficial to all. As I write, six have benefited from CPS' expertise and have been recognized by CALEA for their demonstration of professional excellence; three are still in process. That prompted me to bring you up to speed on some relevant information that has taken place in the City of Fort Lauderdale since your 1995 study of our Police Department. Often times there is a tendency of governmental officials or the general public to feel that professional consultant studies are never really utilized, or the recommendations seldom implemented. When your firm completed a very thorough and professional review of the Fort Lauderdale Police Department in the spring of 1995, Fort Lauderdale had the highest number of reported Part I crimes (cities with a population greater than 100.000) in the United States. In addition, the local press described the Department as "one of the most problem-plagued and controversial police forces around" and quoted what your study called the "contentious and disrespectful" relations between the union and city officials. Although I was retired from the Seattle Police Department at the time, I was hired as the Fort Lauderdale Police Chief several months after your study was completed. One of the very first things that I did was to review the material and some 120 very specific recommendations contained in your study. Within the first 2 years. we implemented well over 85% of those recommendations. The results have been outstanding. Our city has dropped from # 1 in VCR crimes nationwide to #25. There has been an overall drop of nearly 50% in Part I crimes (1999 compared to 1994). That has continued this year with a 16% drop for the first half of this year compared with the first half of last year. Although crime has been dropping throughout the U.S., Fort Lauderdale's drop has been at nearly twice the rate of reduction of the national rate during the same time period. We have dropped from #1. to #25 in the nation. \.". In addition, our internaIlabor atmosphere is now one of mutual respect and trust. We are now starting our 6th year of positive partnership with our employees.
