RESOLUTION NO. 2002- 501.0
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF
OF POLICE, IN ACCORDANCE WITH SECTION 932.7055, F.S.,
TO EXPEND $298,850.00, FROM THE LAW ENFORCEMENT
TRUST FUND, TO HIRE THE CONSULTING FIRM OF
CARROLL BURACKER & ASSOCIATES, INC., TO DEVELOP A
COMPREHENSIVE POLICE MASTER PLAN TO ADDRESS
LOCAL AND NATIONAL SECURITY CONCERNS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is a coastal community which is in
need of a Comprehensive Police Master Plan (hereinafter the "Plan"), to address local
and national security concerns; and
WHEREAS, in accordance with Florida Statutes 9932.7055(4)(a)(c)(3)
specifically, the City's Police Department has the authority use Forfeiture Funds to hire a
consultant to provide additional expertise to the Police Department; and
WHEREAS, in accordance with Florida Statutes 9932.7055(4)(b) upon the
request of the Chief of Police to the governing body of a municipality, liens and forfeiture
funds may be expended if accompanied by written certification that the request complies
with the provisions of the aforementioned subsection; and
WHEREAS, the Chief of Police has submitted a certified request for the
expenditure of $298,850.00, in forfeiture funds in compliance with the aforementioned
statute, attached hereto as Exhibit "A," to hire the consulting firm of Carroll Buracker &
Associates, Inc., to develop such Plan;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authorization to Expend Forfeiture Monies. The Chief of Police is hereby
authorized, to spend $298,850.00, from the Law Enforcement Trust Fund, to hire a
consultant on a one time basis to develop a Comprehensive Police Master Plan, for which
the Chief of Police hereby certifies that the hiring of Carroll Buracker & Associates, Inc.,
to develop such a Plan is not a normal operating expense of the Police Department, which
certification is attached hereto as Exhibit "A" and made a part hereof.
Section 2.

Forfeiture Expenditures..
Recommendation:
".It is recommended that the City Commission approve the expenditure of partial
forfeiture funds, previously awarded to the Police Department as the result of
investigative participation in forfeiture and seizure cases. These funds are
pennissible by law to be spent for purchases of police equipment and other law
erforcement activities. It is requested that we be permitted to utilize $298,850.00 of
said funds on deposit for such purposes.
Reasons:
One of the benefits of participating in and providing personnel into high intensity
narcotics investigations is the sharing of confiscated proceeds for the'enhancement
of law enforcement related activities. The utilization of the Consulting Firm of Carol!
. Buracker & Associates, Inc. to address local and national security concerns, both
now and futuristically is deemed necessary and effective.
Additional Information:
Those areas targeted for consultCltion and review include: Police Department Master
Plan, Police Policy Manual, Disaster Response Plan and Technical Assistance and
Direction related to CALEAStandards. To date the City of Sunny Isles Beach Police
. Department has been awarded additional monies in confiscated funds. Certain
needs exist on behalf of the department whereby the agency benefits from long term
projection and development of an overall Master Plan.
