A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, ESTABLISHING AN AMNESTY PERIOD
REFRAINING FROM THE ENFORCEMENT OF SECTION 901.5(9) OF THE
CITY LAND DEVELOPMENT REGULATIONS AS ADOPTED;
ESTABLISHING CERTAIN CONDITIONS OF THAT WAIVER;
PROVIDING FOR THE EFFECTIVE PERIOD OF THE AMNESTY FROM
FEBRUARY 1, 2003 THROUGH JULY 31, 2003; PROVIDING FOR
PENALTIES; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is a major tourist destination in Florida; and
WHEREAS, tourist based businesses located in the city have suffered tremendous financial
hardships since the tragic events of September 11 th; and
WHEREAS, the City Commission wishes to assist local businesses in their effort to
stimulate the local economy with an opportunity to maximize advertisement opportunities;
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.
Amnesty.
Notwithstanding anything to the contrary, the City of Sunny Isles Beach hereby declares a special
period for the temporary waiver of enforcement of Section 901.5(9) of the City of Sunny Isles Beach
Land Development Regulations for all businesses within the City. Specifically, the City will permit
temporary banner signs for a period not to exceed six-months to be known as the "Amnesty Period",
subject to review and approval as set forth in Section 2. All other sections of the City Code of
Ordinances as adopted shall remain in full force and effect.
Section 2,
Conditions.
No banner signs shall be placed on any structure without the prior review and written approval ofthe
Zoning Director of the Planning, Zoning, and Building Department. The City reserves the right to
reject banner signs that may impose a threat to the general, health safety or welfare of our residents
and visitors or that is inconsistent with the Comprehensive Plan or other general regulations ofthe
Land Development Regulations.
Section 3.
Penalties for Violation.
Notwithstanding the provisions ofthis Resolution, the Zoning Director, Building Official, and Code
Enforcement and Licensing Department Director may at all times continue enforcement of the
applicable Codes through any authorized means including issuance of a Waming Notice of Violation
and/or the issuance of a Civil Notice of Violation and associated penalties. This Resolution shall not
be construed or serve as a defense against any enforcement actions brought by any Department based
on other requirements of the code,
Section 4.
Effective Period of Amnesty.
This amnesty period shall begin and become effective on February 1, 2003 and shall continue thru
July 31 st, 2003. All affected business owners' may take advantage of this advertising opportunity
and shall immediately remove any such banner signs from their premises at the termination ofthe
amnesty period as stipulated herein.
Section 5.
Effective Date. This Resolution becomes effective upon adoption but shall alow
retroactive application in accordance with the terms of this Resolution.

ESTABLISHING AN AMNESTY PERIOD REFRAINING FROM THE
ENFORCEMENT OF SECTION 9015(9) OF THE CITY LAND DEVELOPMENT
REGULATIONS AS ADOPTED
RECOMMENDATION
It is recommended that the City Commission adopt, by motion the attached resolution granting a six-
month amnesty period, temporarily waiving section 901.5(9) of The City Land Development Regulations
for our local business community.
REASONS
The Statewide Tourism Industry has been ailing since the September 11th, 2001 tragedies, negatively
impacting our local economy. The Office of the City Manager, Zoning Department, and the Code
Enforcement and Licensing Department wish to aid our local businesses by allowing additional
advertising opportunities.
ADDITIONAL INFORMATION
As you may recall the City Commission initially granted a four -month amnesty for the same issue under
Resolution number 2002 -475. The current amnesty period will not exceed six- months beginning upon
the adoption of this resolution and expiring on July 3Pt, 2003. Additionally, the City retains its right to
continue to enforce all other applicable codes and to review and approve any such banner signs prior to
their placement on any building.
