RESOLUTION NO. 2003 - ~
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AUTHORIZING THE MAYOR TO EXECUTE
AMENDMENT NO.1 TO CONTRACT NO. 02-08-01, BETWEEN THE CITY
OF SUNNY ISLES BEACH AND PIOS & SONS ENTERPRISES, INC., FOR
THE REPAIR OF SIDEWALKS, CURBS AND GUTTERS, IN AN AMOUNT
OF $2,249.05, ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING
THE CITY MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City awarded a contract to Pios & Sons Enterprises, Inc., being the most
responsive, responsible bidder for Request for Proposals No. 02-08-01 for repair of sidewalks,
curbs and gutters, on November 14,2002 via Resolution No. 2002-494; and
WHEREAS, Pios & Sons Enterprises, Inc., was the most responsive, responsible bidder
with a sealed bid of One Hundred Twenty-Two Thousand Dollars ($122,000.00), and the City
added additional curbing work on Collins A venue, bringing the total authorization amount not to
exceed One Hundred Forty-One Thousand, Eight Hundred Fifty-Five Dollars ($141,855.00); and
WHEREAS, hairline cracks in some slab sections had to be replaced that were not in the
initial survey, therefore the City wishes to approve Amendment No. 1 to Contract No. 02-08-01
with Pios & Sons Enterprises, Inc., in an amount of $2,249.05, for a total amount of $144,104.05,
to repair sidewalks, curbs and gutters citywide.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, THAT:
Section 1. Approval of Amendment No.1 to Contract No. 02-08-01. Amendment No.1 to
Contract No. 02-08-01 by and between the City of Sunny Isles Beach and Pios & Sons
Enterprises, Inc., for repair of sidewalks, curbs and gutters citywide, in an amount of $2,249.05,
attached hereto as Exhibit "A", is hereby approved.
Section 2. Authorization of Mayor. The Mayor IS hereby authorized to execute said
Amendment No.1 to Contract No. 02-08-01.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this Resolution.
Section 4.
Effective Date. This Resolution will become effective upon adoption.

AMENDMENT NO.1
TO CONTRACT NO. 02-08-01 BY AND BETWEEN
CITY OF SUNNY ISLES BEACH AND PIOS & SON ENTERPRISES, INC.
SIDEWALKS, CURBS & GUTTERS, REPAIR AND MAINTENANCE AGREEMENT
DATED NOVEMBER 15, 2002
WHEREAS, the Pios & Son Enterprises was hired by the City to perform repair and
maintenance services under the referenced contract for sidewalks, curbs and gutters within the
City and approved by Resolution No. 2002-494; and
WHEREAS, pursuant to Paragraph 14 - Modifications of Work, of the referenced contract, the
City requested additional work to be performed to repair previously undisclosed faults within the
sidewalks and curbs which resulted a substantial increase in the amount of materials to complete
such repairs;
NOW THEREFORE, in accordance with the terms of Paragraph 14 and Contractor's invoice
for an additional $2,249.05, the City hereby amends the contract as follows:
1. Additional service to be performed to repair previously undisclosed faults within the
sidewalks and curbs for the additional cost of $2,249.05. Payment to be made as
invoiced.
2. The original contract amount is hereby increased from One Hundred Forty-One
Thousand Eight Hundred Fifty-Five and No/I00 Dollars ($141,855.00) to One
Hundred Forty-Four Thousand One Hundred Four and 50/100 Dollars
($144,104.05)
3. All other terms and conditions remain the same.
