A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, A PPROVING AMENDMENT NO.2
TO AGREEMENT BY AND BETWEEN THE CITY OF SUNNY ISLES
BEACH AND VILA & SON LANDSCAPING CORP., FOR LANDSCAPE
IMPROVEMENTS FOR STATE ROAD A-I-A (COLLINS AVENUE), IN
AN AMOUNT OF THIRTY-ONE THOUSAND, SIX HUNDRED FIFTY
DOLLARS ($31,650.00), ATTACHED HERETO AS EXHIBIT "A";
AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF AMENDMENT NO.2;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Resolution No. 2002-442, dated May 14, 2002, the City Commission
approved an agreement between the City and Vila & Son Landscaping Corp., for landscape
improvements for State Road A-1-A (Collins Avenue); and
WHEREAS, after Vila & Son Landscaping Corp., completed their work on the Collins
Avenue medians, pedestrians trampled the plants in the medians, and it is now necessary to
replace the destroyed plants; and
WHEREAS, the Florida Department of Transportation created a new pedestrian
crosswalk in front of the Pinnacle Condominium, making the median wide enough to provide a
safe island, enabling the City to now install three new medjool date palms plus ground cover in
this median; and
WHEREAS, the City Manager established a Jay-Walking abatement program to stop
pedestrians from trampling on the plants in the median, and the City now wishes to approve
Amendment No.2 to Agreement, attached hereto as Exhibit "A", with Vila & Son Landscaping
Corp., in a total amount of $31,650.00, for landscape improvements for State Road A-1-A
(Collins Avenue).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment No. 2 to Agreement. Amendment No. 2 to Agreement
by and between the City of Sunny Isles Beach and Vila & Son Landscaping Corp., for landscape
improvements for State Road A-1-A (Collins Avenue), in an amount 0 f$ 31,650.00, attached
hereto as Exhibit "A", be and the same, is hereby approved.
Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said
Agreement.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of Amendment No.2 to Agreement.

Section 4.
Effective Date. This Resolution will become effective upon adoption.

AMENDMENT NO.2
TO LANDSCAPING CONTRACT BY AND BETWEEN
CITY OF SUNNY ISLES BEA.CH AND VILA & SON LANDSCAPING CORP.
DATED MAY 29, 2002
FOR ADDITIONAL LANDSCAPING & IRRIGATION

OF COLLINS AVENUE (SJ1. A-I-A)
WHEREAS, the Vila & Son Landscaping Corp. was hired by the City to perform landscaping
and improvements under the referenced contract for landscaping and irrigation of Collins
Avenue and other sites within the City as approved by Resolution No. 2002-442; and
WHEREAS, pursuant to Paragraph 2 - Additional Services, of the referenced contract, the City
requests additional landscaping and irrigation work to be performed on Collins Avenue due to
the recent widening of the median by FDOT, for which additional work the City has received a
Statement of Probable Construction Cost, dated April 1, 2003, from O'Leary Design Associates,
P.A., in the amount of$31,650.00; and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of Vila
& Son, wishes to contract with Vila & Son Landscaping Corp., to perform this additional work
via this Amendment No.2 to Vila's landscaping contract referenced above;
NOW THEREFORE, in accordance with the O'Leary Design Associates, P.A.'s Statement of
Probable Construction Cost, dated April 1, 2003, and attached hereto as Exhibit "A," in the
amount of $31,650.00, the City hereby amends Vila & Son Landscaping contract as follows:
1. Additional landscaping and irrigation service to be performed on Collins Avenue at
an additional cost of $31,650.00, as more particularly described in the attached
Exhibit "A." Payments to be made monthly as invoiced.
2. The original contract amount is hereby increased by Thirty-One Thousand Six
Hundred Fifty and No/I00 Dollars ($31,650.00) to One Million One Hundred
Five Thousand Forty-Two and 40/100 ($1,105,042.40).
3. All other terms and conditions of the contract remain the same.

II) Auto damage at Lehman Causeway $

III) Pedestrian damage to medians
(See correspondence dated 3/27/03) $ 8,000.00
IV) New median at The Pinnacle $23.000.00
Total $31,650.00
Please be advised that the cost of replacing Item ITr (Pedestrian damage) is approximate only
since the exact quantity of plants required will only be known after the work is complete.
