A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING AMENDMENT NO.3
TO AGREEMENT BY AND BETWEEN THE CITY OF SUNNY ISLES
BEACH AND VILA & SON LANDSCAPING CORP., FOR LANDSCAPE
IMPROVEMENTS FOR SUNNY ISLES BOULEVARD RETENTION
AREAS I AND II, IN AN AMOUNT OF ONE HUNDRED FIFfY-EIGHT
THOUSAND FOUR HUNDRED THIRTY-TWO DOLLARS AND
THIRTY-FIVE CENTS ($158,432.35), ATTACHED HERETO AS EXHIBIT
"A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT;
AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE TERMS OF AMENDMENT NO.3;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Resolution No. 2002-442, dated May 14, 2002, the City Commission
approved an agreement between the City and Vila & Son Landscaping Corp., for landscape
improvements for State Road A-1-A (Collins Avenue); and
WHEREAS, the City is in need of landscaping services for Sunny Isles Boulevard
Retention Areas I and IT, and Vila & Son Landscaping Corp" has agreed to undertake this project
and has submitted a proposal for services, and O'Leary Design Associates P.A. has
recommended that the contract be awarded to Vila & Son Landscaping Corp,; and
WHEREAS, the City wishes to approve Amendment No, 3 to Agreement, attached
hereto as Exhibit "A", with Vila & Son Landscaping Corp., in an amount of One Hundred Fifty-
Eight Thousand Four Hundred Thirty-Two Dollars and Thirty-Five Cents ($158,432.35), for
Sunny Isles Boulevard Retention Areas I and IT,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment No, 3 to Agreement. Amendment No, 3 to Agreement
by and between the City of Sunny Isles Beach and Vila & Son Landscaping Corp" for Sunny
Isles Boulevard Retention Areas I and IT, in an amount of $158,432.35, attached hereto as
Exhibit "A", be and the same, is hereby approved,
Section 2, Authorization of Mayor, The Mayor IS hereby authorized to execute said
Agreement.
Section 3. Authorization of City Manager, The City Manager is hereby authorized to do all
things necessary to effectuate the terms of Amendment No, 3 to Agreement.
Section 4,
Effective Date, This Resolution will become effective upon adoption,
PASSED AND ADOPTED this 15th day of May, 2003,

AMENDMENT NO.3
TO LANDSCAPING CONTRACT BY AND BETWEEN
CITY OF SUNNY ISLES BEACH AND VILA & SON LANDSCAPING CORP.
DATED MAY 29, 2002
FOR ADDITIONAL LANDSCAPING & IMPROVEMENTS
FOR SUNNY ISLES BOULEVARD RETENTION AREAS 1 AND 11
WHEREAS, the Vila & Son Landscaping Corp. was hired by the City to perform landscaping
and improvements under the referenced contract for landscaping an,d irrigation of Collins
A venue and other sites within the City as approved by Resolution No. 2002-442; and
WHEREAS, pursuant to Paragraph 2 - Additional Services, of the referenced contract, the City
requests landscaping services for Sunny Isles Beach Boulevard Retention Areas I and 11, for
which the City has received a Statement of Probable Construction Cost, dated April 21, 2003,
from O'Leary Design Associates, P.A., in the amount of$158,432.35; and
WHEREAS, the City, being satisfied with the performance and quality of workmanship of Vila
& Son, wishes to contract with Vila & Son Landscaping Corp., to perform this additional work
via this Amendment No.3 to Vila's landscaping contract referenced above;
NOW THEREFORE, in accordance with the O'Leary Design Associates, P.A.'s Statement of
Probable Construction Cost, dated April 21, 2003, and attached hereto as Exhibit "A," in the
amount of $158,432.35, the City hereby amends Vila & Son Landscaping contract as follows:
}, Additional landscaping and irrigation service to be performed on Collins Avenue at
an additional cost of $158,432.35, as more particularly described in the attached
Exhibit "A." Payments to be made monthly as invoiced,
,2, The original contract amount is hereby increased by One Hundred Fifty Eight
Thousand Four Hundred Thirty Two and Thirty Five/l00 Dollars ($158,432.35)
to One Million Two Hundred Sixty-Three Thousand Four Hundred Seventy-
Four and 75/100 ($1,263,474.75).
