A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PROVIDING FOR FINANCIAL CONTRIBUTION TO THE CITY OFF-STREET PARKING TRUST FUND; PROVIDING FOR A FEE TEN THOUSAND ($10,000) DOLLARS FOR EACH PARKING SPACE ELIMINATED ACCORDANCE WITH SECTION 801.1.2(b) OF THE LAND DEVELOPMENT REGULATIONS; PROVIDING FOR A FEE ADJUSTMENT PER FISCAL YEAR BASED ON THE CONSUMER PRICE INDEX; PROVIDING FOR THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission approved the Land Development Regulations for the City on Dec 10, 2002, and WHEREAS, Section 80 1.1.2 (b) of the Land Development Regulations provides for [mancial contributions to the City Off-Street Parking Trust Fund for reductions in the number of required parking within a single development; and WHEREAS, the City Commission wishes to adopt a fee $10,000 dollars per space for the reduction of required parking spaces within a development, based on a study of pricing for construction of parking spaces and a review by the Finance Committee, and WHEREAS, the fee shall be adjusted per fiscal year based on the consumer price index. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they fully set forth herein. Section 2. Approval of Fee The City Commission hereby approves a fee of $10,000 dollars per parking space eliminated within a development as required contribution to the City Off- Street Parking Trust Fund and that this approval is conditioned upon proper execution of all documents required by the City Attorney's office. Section 3. Fee Ad1ustment The contribution fee shall be adjusted per fiscal year based on the consumer price index. Section 4. Authority of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this resolution. Section 5. Effective Date This Resolution shall become effective upon adoption. After a study on the pricing for construction of parking garage spaces and a review of the study by the City Finance Committee, for each parking space reduction a developer shall contribution to the fund $10,000 dollars per parking space eliminated within the development.
